Lecture is outstanding but in wrong direction in my opinion, the argument is flawed and more concerning on the criminal who is alive only because of his physical presence in this materialistic world but the voice of the innocent victim who was killed is of no importance only because he/she is not alive to appraise their pain and loss attributed to himself and to their families. Secondly who is the Supreme court to leave behind the sentiments and emotions of the general public? The very constitution which we refer to and the lordships drew their power is given by the People as it starts with "We the people of India.......". The progressive/reformative state theory postulated tilts only towards the people living and completely leaving the valuable and innocent life of the people killed. In my opinion the reformation and the repentance of the criminal after completion of the term of punishment cannot be equal to, nor to any extent equivalent to the pain or loss endured by the person killed and of their families. Moreover to what extent the reformative theory is progressive in stopping or reducing the crimes in the society is a matter to be considered. What fear we as a humane society could bring in reducing the crime thereby protecting our families in this disturbed society. lastly the criminal law is not only to establish the crime committed but what impact it will have on the society and how as an individual or a family feels secure to live is a matter of importance. In the pretext of prejudice that a vague availability of reformative nature of the criminal which comes at the very cost of the state which in turn is from the taxes raised from the people of the country, to what extent Supreme court denies the consideration of the general public opinion at large and confines the capital punishment only in the rarest of the rare cases. SC should not override the true conscience of the general public who are of course elects the government but not have a say in how they are to be treated, ruled and what laws are to be enforced upon them. The ultimate decision makers in a healthy democracy are the people and not the proxy lordships.

Country like India capital punishment still requires, we have to travel thousands of miles yet in order to repeal such penal law .
