    For everyone hollering about trespassing, let's be careful to understand what's going on here. thelawdictionary.org/article/what-is-a-police-welfare-check/ Welfare checks are an integral police function and are constitutional and legal. 99.99% of the time these officers are doing good work to just make sure people are safe. He's been asked by his shift supervisor to check in to make sure the guy is okay...what do you expect him to do in this instance, shrug and not try because the gate is locked? It's expected to be locked...these are country folk, they lock their gates a lot. He was acting very reasonably.

      even though your justification is correct. law is law and a defense against trespassing that evolved into assult against an officer and assult with a deadly weapon against an officer of the law is all we saw here. he became the bad guy after the police officer was pursued in flight.

      even then to attack an single officer who did not in any way pose an obvious threat to you or your property was more than enough for the officer to respond in a much more forceful fashion than we see here. I couldnt imagine the emotional and spiritual battle that took place that prevented the officer from shooting until he was literally on his back facing death eye to eye. I dont like to see our officers reduced to such a state but I understood his hesitation.

      Walter Strong the only person in danger in this situation is the cop. he has no obligation to kill someone to protect himself, if there was a hostage being threatened then it'd be a different situation. Ending a life affects your life in a massive way, he clearly wasn't ready for that change

      he can't trespass private property without a warrant, so the man who owns the property has the right to shoot him, if the officer shot him then the officer could get arrested, the reason why the officer probably didn't want shoot him was because the officer knew that he was in the wrong trespassing and knows the consequences, so stop calling him a coward he knew what he was doing.

    The deputy should have been ready when he heard the shots fired at the patrol vehicle . The deputy should have been able to get the jump on the suspect . He needs to reconsider a career change . I'm glad he made it .

    I know that Deputy! My dad works with him! Lol.. Happened in Troup County where I live. The dude in the video has been a huge problem for our law enforcement. Dad worked for the Lagrange police department for 30 years and before he passed away from cancer he was working for this department. Thankful our deputy survived this one.

The actual landowner/homeowner called our sheriff's office to request a deputy to respond and do a welfare check giving him every right to enter the property. The son was making threats to harm himself and to harm his mother. But yeah fuck the trespasser.

      Its funny how cops have the legal ability to fire on escaping home invaders that have a weapon, but a citizen whose home has been illegally invaded by a police officer is not able to do the same while trying to stop them. I'm not saying the guy was right in doing so in *this* instance, as it doesn't look as much like a citizen's arrest rather than a cold and calculated kill, but its an interesting perspective in my opinion.

    That was not a Taurus Judge. If it fired shotgun shells at all, It was one of several Derringers that fire .410 or .45 Colt. You may have noticed that he fires two shots at the car, and reloads before getting into the truck. He then fires two shots at the Deputy. The Deputy probably made his escape when the guy was reloading. The at the fence, he fires two more shots before running away. Why always two shots at a time when the Taurus holds five?

      LOL did you not see the wire anchor on the post the gate was attached to? That's the only thing keeping that gate suspended. You could very clearly see it drop to the ground when the officer climbed it twice.

    How does one give verbal instructions to "get on the ground", "put it down", "please put it down"....without having an opportunity to draw your weapon? It should have been over after the first verbal command.

      im assuming the guy already had his gun drawn when he exited the vehicle. the officer saw this and knew to try and deffuse the situation. you never draw on a drawn gun. in the end the officer did all he could correctly with the knowledge he had of the situation. he got a decent shot on taget after retreating to cover and made it out alive.

      Sadly men/women like this have no place in law enforcement. I would love to be a police officer but recognize my inability to 100% control my anger. Instead of shrugging it off and trying to be a cop just to possibly lose control, I move on. This deputy needs to think about his response and in my opinion resign. Not everyone is cut out for it, no harm in admitting you cant. Otherwise serious issues could arise in future situations.

    I’m just now seeing this vid. I understand everyone reacts differently in tense situations. But I have never seen or heard of an officer running away like that. His weapon should’ve been drawn the second he heard the shots he reported. Seeing an officer flee like that is just one more reason we need the 2nd & I personally rely on myself first to defend my own life. I support law enforcement 100%, but I’m not sure I would want that officer patrolling my neighborhood.

      Retreating is one thing. Obviously you want to deescalate the situation as much as possible before using deadly force. But a trained officer sworn to protect, to not even have his weapon out after hearing shots & tucking tail & running away from the situation?? That doesn’t sit well with me. It shouldn’t sit well with the people in the district he is sworn to protect either. What if it was an active shooter situation at a school? Is he going to run over kids trying to get to the exit?? I do agree with your court comment though. With society today LEOs are more hesitant to draw their weapons & dispense justice if needed because of the possible consequences & that is really sad. Of course no sane officer wants to end up in a shooting, but if it is thrust upon you protect yourself of course, but do your job & protect all the innocent people counting on you.

    Correct me if I'm wrong , but I believe the Taurus Judge also takes .45 LC ammunition... I don't know how you can tell , from the video, what is being shot out of the perp's firearm..

      Have you ever shot .45 LC out of a Judge? They aren't rifled for accuracy and LC's will keyhole at about 10 yards. The long bbl Judges might do okay with LC at a greater distance, but the shorter bbl lengths make it an ineffective round for any kind of distance shooting. A Judge is designed to be a CQB defense weapon only. Anything beyond 10 yards you'll be wishing you had a different gun. The written report indicates the deputy had buck shot in his face, so it's likely the perp didn't have any LCs in the gun. Keep a Judge in the nightstand, but carry a Glock.

      My point is that pleading for mercy never works when facing someone that already expects to kill you/someone that day. Whether a murderous armed robber, or a mass shooter or serial killer, I've never heard of any situations in which someone survived or was let go because they pleaded. I've heard of people being let go in mass shootings, like Columbine, but it was because the shooters liked the people that they spared and let go.

      Yes, .410 your load is very important. My favorite out of my Circuit Judge is 5 pellet 0000 Buck. Bird shot just flies all wild. Not worth using for bird, snake, or anything unless you stick the muzzle against it.

      If I was dispatched to this residence for a welfare check I would have asked. What is the welfare check in regard to? Are their registered weapons at the home? Send a back up unit, two if possible. Also, if the gate was locked I would have got the phone number to the residence and called them out to my vehicle. You don't always have to enter their home until you know it's safe. Plus he could have just spoke with them at the front door, that way when the deputy heard the shots fired he could have drawn his weapon and been ready when the guy came out of his car. Talking about it and being there are two different things but you have to prepare yourself mentally for any call. Any simple call can go south real quick.

      Officer was probably scared, thinking he's trespassing, and dude can get away with it, probably didn't want to take a life, and probably in fear for his career... all boiled into a matter of 15 secs where he can't compute to either fight, or flight.. and he chose flight... probably hoping to get back to his squad car, call for back up, and let them handle the situation.

      Or those discs, I bought a judge and used it at the range. Those discs can absolutely ruin your day at up to 20-30 feet. The discs still go relatively straight so those 4 discs will usually hit and if not the bbs inside will graze them. The 410 shells were no where near as effective

      A year late on this- But small follow up.
      I have a judge poly myself, but I dont (usually) carry shotgun shells in it- I carry lehigh maximum expansion rounds.
      These are special 45 cal bullets that take advantage of the extended cylinder length, and have very, VERY long bullets that fill up the rest of the cylinder. Theyre all copper (no lead), hollow, and double bisected.
      The result is should anyone be unfortunate enough to be hit by this bullet, the bullet "pedals" out into a giant X shape, and puts about a 3" cross cut in flesh.
      Shootingthebull has a rather decent video reviewing/covering these rounds- worth a watch if youre interested in this type of material

    Both men were in the wrong.
    The man acting as a deputy violated his Oath of Office by trespassing on the other man's property without a warrant.
    The man that owns the land was in the wrong by attacking the deputies car and the deputy without first giving the deputy a verbal trespass notice and 2 minutes to leave the property before taking further action.
    If he would've properly given the deputy notice then the man lawfully has two choices; 1. Get the deputy's name, badge number, and bond number to sue in court for illegal trespass, (that's what I would have done) or 2. Shoot at the deputy until he leaves the property, which the man went way beyond that especially after the deputy retreated, hopped the gate and ask for him to stop, (I don't recommend this option ever unless you want to die and be slandered as mentally ill or a criminal).

      Without a warrant a law enforcement officer can only enter the property with someone who lives on the property.
      If the father was at his son's property at the time of the incident, (which he wasn't according to the court records) and called 9-1-1 from the location and said he feared for his own life, then an officer can enter the property without a warrant to find the man in distress who called 9-1-1. If no one is on the property who is in distress and the officer is told he is trespassing then he must leave.
      I'm not arguing that Matthew Edmondson's, (the man shooting at the deputy), actions were right, I said he was wrong. The deputy also was wrong, he didn't have the proper paper work, reasonable articulated suspicion of a crime or permission to trespass.

      That means, in your example, an officer can write in his report and say in court that he had a reasonable suspicion that a crime was being committed by way of his dispatcher informing him of your 9-1-1 call, so then he can legally enter the home to investigate a possible home invasion or a burglary.
      As to your statement of, "we saw him entering the property", no, I saw a man dressed as a deputy look at a well written no trespassing sign, ignore that sign, climb over a locked gate and begin to illegally search for someone who didn't call 9-1-1 for help.

      I went to the Georgia legal web page on exceptions related to searches and seizures and read all the way down to "Exception 3". (The following situation illustrates this exception:
      SITUATION 8 An officer sees an armed robber holding up a drugstore, taking money and drugs. The robber leaves by foot. The officer initiates a chase. Bolting around a corner, the robber disappears into an old house.
      The third exception to the warrantless search and seizure involves "exigent circumstances" (emergency situations), which applies here.
      Exigent circumstances occur when there is no time for the officer to obtain a warrant, as when there is a bomb threat, or as in situation 8, when police are chasing someone who has just committed a crime.)
      I'm not trying to argue with you Jay, you and I believe in different things and that's okay.
      I believe police don't like to follow the rules that they want everyone else to live by.
      I believe that no man that hasn't hurt another man or woman or hasn't stolen from anyone or hasn't damaged anyone's property shouldn't be illegally or unlawfully harassed and trespassed upon.

      And he is not to arrest someone, this mean he is actually allowed to get in to the house. Imagine if you sit in your car waiting for that person to come as close to you and pull out the revolver and shoots you just because you want to respect their property even though you got called by the suspect own family members. More over, the only reason why the dispatch was alive is because the gun cant should far. Waiting for the suspect himself to go home and open the gate is just getting him killed.

      Guy took his mom hostage for 6 hours before surrendering. He’s being charged with attempted capital murder, damage to public property and unlawful imprisonment among other things.

    Why on Earth did that deputy jump the fence? Did he have a warrant, or even probable cause? Of course the homeowner was out of his mind, shooting at the car, then the deputy, but that deputy trespassed unless he had a warrant...put himself in danger of being treated as any other criminal trespass, he should have known better. I guess next time he won't be trespassing on people's property because someone "called him".
