So, I have over 100k in student loans. Some are private, most are federal. I havent taken a hard look at the federal loans but I did take a hard look at my private loans since i had a cosigner. I originally borrowed $18,500. I've paid them over the last 7 years (minimum payments) and now my balance is about 39k. Im on an income based repayment plan for fed loans and my payment is $0. Ive been applying for jobs with no luck so far. I work to pay my student loans while putting food for my family on a credit card. I have $111 in my bank account. At this rate, I feel like I'll never get ahead. Do I qualify for this or am I too young at 35? I try to sell stuff and have two jobs but I cant get ahead of this debt.
35 is a bit young yes, but if you have been in loan repayment including forbearances for over 10 years you may still qualify. The 10 yr mark appears to be important. If you are in Florida, please reach out to us.
Private loans - if they do NOT appear on studentaid.gov, don't receive the benefit of any of these federal programs. They are subject to possible discharge in bankruptcy though, and good settlements can be reached - if settled/paid before 12/31/25 the forgiveness is also tax free. @@ArkovichLaw If you don't consolidate your loans but leave them as is, could you avoid filing a new chpt 7 bankruptcy by arguing that the loans should now be reviewed in light of the new DOJ process to discharge?
Hi, Christie, this news is interesting. I am currently in yr 4 out of 5 for ch. 13. I filed in AL however now I reside in GA. My attorney has not reached to say that is possible to discharge student loans in bankruptcy. All my loans were with FedLoans, then transferred and now are being serviced by a new provider for the government. Will you please advise on whether or not this option is possible for me and next steps to take if any. Thank you.
Yes, since you are in a pending case, you can still file an adversary action to discharge your federal student loans in that Chapter 13. If your attorney doesn't want to do this (many are not up on this area of law), you can reach out to us to determine if this would be possible. Our office phone is (813) 258-2808.

If you file chp 7 while in school and have federal loans active. Will they stop you from getting your loans disbursed while in school. They put my loan in forbearance because i file chp 7
Grad loans are credit based and may be impacted. Undergrad loans should remain unaffected. We don't deal with the getting of loans so my knowledge isn't strong there, we deal with trying to deal with and get rid of the debt afterwards. A financial aid office would know what you would be eligible for.

I was told by my attorney that it's still not possible to get student loan discharged, unless you are truly not able to pay them back.
Can't say, all depends on your Court, ED and your local AUSA and how many factors you fulfill on the attestation form if federal loans.
Exactly! Don't know y they keep making it seem like it is. U have to be destitute or very close to it.
