    Thanks for your great advice. I have a question and would appreciate any guidance you can give. Can you advise where someone has studied in Canada and having completed school was able to apply for a post graduate work permit that was granted for 2 years. However that work permit is about to expire in a month’s time. An application is being prepared for the permanent residence and prior a profile had been submitted for Express Entry but has not yet received an
    Invitation to apply for PR. What are the options open to me as I currently have a job and financial commitments within Canada and would like to stay and work legally whilst my PR is processing. What should I be applying for in order to stay in Canada

    Thank you for the info. I received my PGWP and want to apply for TRV. I know it’s very straightforward. However I have my spouse (open work permit) and kid (student visa) and want to add their TRV application too. While filling application online there is a question:
    What does your family memebr want to do in Canada
    1. Apply to remain in Canada as a visitor
    2. Apply for or extend an open work permit
    3. Apply for or extend a study permit
    4. Apply for or extend both a work permit and a study permit.
    Is this the option 1st that I need to choose based on my scenario? Please advise. Thanks

      I’m not 100% sure how it would look in the GC Key for applicants so it’s tough to advise on this. But you want to get to the point where, you, and your family members will need to fill out each an IMM 5257, show proof they are on valid status, and be given the opportunity to complete an IMM 5713 (use of a family representative) if it’s all in one GC Key. I believe it would be as a visitor, because you are submitting a visa application. It’s worded poorly, but on 5257 you’ll have the option to select “return to Canada to study” or “to work” (for
      Your wife). I wouldn’t select 2,3,4 because you’re not applying for permits or extensions (going to Edmonton), you’re applying for visas (going to Ottawa).
      If you choose 1, and it gives all your family the necessity to upload a 5257, you are on the right track. I’d try with the other options as well, and see if you can get to the IMM 5257 for your family members, or the ability to select “apply for a temporary resident visa” www.canada.ca/en/immigration-refugees-citizenship/services/visit-canada/apply-new-temporary-resident-visa-within-canada.html#how-apply

    Great explanation. Had a question: My mom has a valid visit visa til Aug 2025 (because that is when her passport expires). I am planning to get the pp renewed (for another 5yr validity, the country of her citizenship renews only for 5yrs at a time) and then enter Canada on the visit visa that was issued with the old passport, and at that time, can I renew the visit visa now that my new passport is valid for another 5yrs?

    Hi there.
    Actually I have applied for my PR and still waiting for my invitation from more than 2 years, I did not get any acceptance or rejection since then. so in order to make my status legal I applied for my visitors status and got approval and last month I got an Extension on my Visitor Record.
    Now the problem is that my previous TRV stamp has been expired with the validity of my passport.
    Now I got my passport updates but cant get any option to apply for TRV stamp as per my new Visitor Record.
    Could you please help me getting my TRV stamping on my visa.

      I have no idea what type of PR you've applied for and why you're on visitor status. How long have you been on visitor status, is it impossible to apply for a work permit? You can apply for a TRV from inside Canada, I would provide a strong letter of explanation, and all supporting documents required, as to why you need to leave and re-enter. The checklist and requirements are guidelines, and aren't always correct, but I feel in your case, I can't see why you wouldn't be able to renew your visa stamp from within Canada, while being on valid status, even visitor. If you want case-specific immigration advice, I invite you to book a consultation through my website, and I'd be happy to have a deep dive into your file and circumstances.

    I loved your very detailed explanation.
    Is it possible to renew your TRV from inside Canada if a minor child, who is in elementary school, is under a visitor record? I only found the TRV option for work and study permit holders not for visitors.

    • @sjpimmigration
      @sjpimmigration  6 หลายเดือนก่อน +1

      It will be possible. They do not indicate it clearly on the website, so it seems confusing. Since minor dependents can study without a permit (as visitors), I would approach the TRV application considering the visitor record, and proof of enrolment in public schools, is the valid status document that allows your child to study.
      If it's just your dependents application, I would recommend you include all the other stuff too in client information (your permit, your visa, birth certificate listing you as parent).

    I have a vital question to ask. I’m currently inside of Canada, can I apply for a visitors record to extend my stay if the validity of my visa expires soon. So the visa on my passport will no longer be valid from 31st July 2024. Can I apply for a visitors record?

    • @sjpimmigration
      @sjpimmigration  5 หลายเดือนก่อน

      I believe you can. The actual visa stamp in your passport is what can allow entry to Canada. What gives you visitor status is being admitted to Canada as a visitor, or applying for a visitor record within Canada. Is your passport only valid until July 31st? Cause they wont issue a status document for longer than your passport validity.

      You can remain in Canada beyond the validity of your visa (stamp in passport), as the visa is only what authorizes entry (after examination by border officer of course). The visa does not grant status. Do not get this mixed up with applying for a visitor record to extend or change the conditions of your stay/status in Canada. This video refers to getting a TRV stamp from within Canada, while on valid status. If you are trying to extend your status to remain in Canada beyond the expiry of your PGWP, I would recommend applying for a visitor record, to enable you to remain in Canada past the expiry date of your status, and then apply for the TRV at a later date if you wish to be able to return/re-enter Canada.
