      Hi, Sir! I have a question, I have an american husband and we are married here in the Philippines last year, after 2 weeks we got our certificate of marraige and send it to the VA since he is a veterans. Is our marraige valid there in the US? I am now one of his beneficiaries in the VA and now I am going to start school in the Philippines using his GI Bill since it is free.     It depends in their conscience but if youre in Philippine territory jurisdiction youre still married to that person.If you visit the Philippines,American,other foreigner spouse is not recognize in the Philippines.The Filipino spouse could still claim youre married to him/her legally,Its better to clear air out to both.Annull your Philippine marriage to your Filipino spouse both civil,church(?)marriages to prevent complication of jurisdiction issues,it takes a lot of time,legal financial issues.Filipino citizens are still under the jurisdiction.of Philippine marriage laws.

    I agree with your legal opinion. I'm just worried that Filipinos in the US who had a prior marriage to a fellow Filipino has also guarantee of a criminal liability in the Philippines. Different jurisdiction, different laws, Atty. Anyway, thanks for this helpful information.     But your marriage here in the US is recognised ONLY HERE in the US. When you go back to the Philippines, your maariage in the US is noy recognized IF your previous marriage in the Philippines has not yet been annulled

      Hi po tanung ko lang po kasi almos 6 yrs na kami ng boyfriend kung American as LDR , ang problema ko is kasal Kami ng ex husband ko iniwan nya ako 25 yrs and 7 month's ago.     I believe you have neglected to say that the divorce you described is not recognized in the Philippines and the person will possibly be prosecuted in the Philippines should they ever return there...please correct me if I am wrong.

    The quickest way from the Philippines is become an OFW and get a divorce from that country as they will be a resident there. If they are already overseas resident it’s a lot easier.

      How about changing name on the Philippines passport after the divorce process granted, I would probably get back my maiden name how it possible to change since divorce is not recognize in the Philippines.

      @@ceciliensiaboc5004 a divorce is recognised to Filipinos if they are a resident overseas in another country. But they need to remain a resident overseas until the divorce proceedings is complete.
      Some American got done for adultery as he was living in Philippines. went back to the states to file for divorce but was still living in the Philippines with his new partner. Got remarried when the divorce came through and the ex filed for adultery charges. So because he was classed as living in the Philippines the divorce wasn’t valid.

    Im annulled in the church already but not yet in the civil court here in the Philippines they said it takes time and lots of money to spend

      Is there such a thing? Annulment in the church in the Philippines,i think they don't have civil registry there officially giving them authorization to annul the marriage,absurdity though it may helps if it is also recognizable by the PSA-Civil registry that don't require court rulings and erase the marriage any moment allowed first by the church,but impossible😋

      Isnt chruch annulment enough? If its already annulled by the church thetes nothing more civil courts can do about a marriage thats no longer existing. Right?

      In the Philippines, church and government is separate. If you are annulled in the church but still married in Civil Registry then you are still married under the law of the Philippines

    This could be true for IMMIGRATION PURPOSES. But if the Spouse who is in the USA, is still a PH citizen during the obtention of the divorce, he or she is contracting a bigamous marriage from the perspective of the PH as the divorce is not validly obtained. There are consequences for doing this. Yes, the divorce may be valid in USA if the law states that divorce is valid if it is validly obtained from said country. But this is a circumvention of the law in the eyes of the PH law. In the PH, you are still considered married.
    Also, how will the divorce court obtain jurisdiction over the person of the spouse who is in the PH? well, unless he signs the divorce papers sent to him (which may be accepted by courts as acquisition of jurisdiction).

    If a woman from the Philippines has been separated from her spouse for 10 years and she met a man from the US and he filed for a fiancee visa for her to come to America and get married. How can she come over to America if her marriage in the Philippines had not yet been annulled? Immigration papers require women from the Philippines to get a "single status" proof that she is really single and free to marry her fiance? I do not believe it is this easy as he is stating here.

      In this case,"the US should not ask any pertinent papers just to prove you are single status"🧐,it's" beyond their law to require what they call here in the Philippines Cenomar?" Not directly necessary to get remarry ,"just be married in the US and register the marriage there,until the Civil registry there would found out you are married within their territory" 🧐🤯,if their "computer program of instructions is automated to release all the personal information regarding Civil Status" there🧐💀😱🔎💯📖🐍Mat.13:18-23,John1:47,"ang hirap pala maging uragon,you cannot just remarry"😋Mat.19:3-9,Mat.5:48, but in my case i can," in other country not requiring certificate of single status",isn't this lawyer is what he tried to specify the problems in remarrying with married status in the Philippines but longtime separated? Huwag na kasing mag-asawa,the way i'm in 52, never to be ambitious to remarry, just to bring back my maiden surname as simple as that should i think about Divorce petition here😍John1:47,Rev.21:1-4,📘or maybe i can remarry much younger than me but physically matured,and mentally immature?     True but if you want to remarry another filipino and you only divorce in the US ,you still required to annul that marriage because you are still married in the Philippines, therefore you cannot merry her unless she’s living here in US as well.

    Even they files divorce in US. Filipino still need to clear or change their name to single. Most all Filipino used their husband lastname. And if the apply for spouse visa they will need all the documents. Like Passport, Birth cert. cenomar and it should be issued by PSA.

    Thank you for sharing this video. My problem was my ex husband he was a US citizen. He don't know how to apply in California. many times we discussed about divorce but he always told me that they will not recognize the divorce in California because we only married here in Philippines and not in US. I was waiting for long time to end up our marriage I wait him to file the divorce. because it's been 7 years since he left and never came back. I hope someone can help me what should I do 🥺. I got so much stressed 😥

      You can get a divorce in California, even if you get married to your American husband in the Philippines. Your American husband maybe doesn't want a divorce, that's why he's lying to you.

    You have to annulled first before marry a US citizen.Philipines not allowed to a Pilipino married, to have a visa to married to another foriegn ...They have to know your status..if you abandoned your family or your pilipino husband,just because you find a more good partner...so you have to make legally annulled..

    That’s the reason why an American told his Filipina estranged spouse in the Philippines that it’s only him who can remarry after cheating & breaking up with her… even if he won’t file for divorce in US. He loves the fact that she can’t remarry so he didn’t file for divorce. I hope the Philippines will stop allowing marriage of a Filipino citizen with an American in the Philippines. If they wanna get married, they better do it in US to prevent Americans from taking advantage of Filipinos and to make sure that both parties have the option to file for divorce or annulment which is more affordable & faster in US.

    In my humble opinion if you are a Filipina woman marrying an American its all good, but if you are a Filipino man marrying an American woman the laws in America makes it too risky and I almost feel sorry for you if you do it..

    It’s not a Philippine annulment. It’s a Catholic annulment. For conscientious Catholics, they will look for one before remarrying.

    Yes, I did that. My only problem is when I am on a greencard, my US married name does not match with my Philippine passport so traveling is a hassle.

    I thought that is applicable if the Filipino is already a US citizen, then he can file a divorce in the US and that divorce should be filed in a Philippine court to be effective here in the Philippines. Correct me if I am wrong.

    I’m a US citizen went back to the Philippines for business and got married. Came back here in California and filed for petition. During the process he’s been lying here and there and talking to other girls. I stopped the petition and it’s been 4 years since we broke up. His mom begged to continue and gave another chance but disrespects and broken promises to support so I decided stop and never again. I’ve been single since but i want to get a divorce and just free myself. I wonder what can I do to make the process quick. Not marrying anytime soon. Just busy with work and kids.

      Hi Miss Love, we have same situation. I was married in the Philippines and my ex cheated on me. I found out few months after his petition to come to the US was approved. I went to my lawyer and signed an affidavit to stop the petition and it was granted. Then after that I filed a divorce with the help of the same lawyer. Divorce was filed March 2018 and was granted on October 2018. What we did was someone who’s also a resident of New York (my friend) went to the Philippines and served him the divorce paper (fyi he didn’t need to sign anything) Then my friend who gave him the papers, when she came back to the US signed an affidavit that she personally gave my now ex husband the divorce papers together with copies of her passport with a stamp to prove that she traveled to the Philippines and her boarding passes. I paid $1500 atty fee and roughly $500 processing fee. Hope this information helps you. I would still suggest that you consult with a lawyer because I’m not sure if same law/process applies in California.

    Pls. Make a distinction between civil Divorce and church annulment...if one is married in the Catholic church and is residing in the US even if he or she is civily divorced in the US she or he cannot remarry in the church if she or he is not granted church annulment with her previous Church marriage...he or she can only do civil marriage again but not church wedding...

      DF you are correct. As a majority of Filipinos are catholic, the church in the US will require an annulment to be married again in/by the church. This is a Vatican rule.

    Hmm..in Japan,they only need a Singleness certificate from the NSO here. And because my sis hubby at that time already have other woman,, my sister did pay someone inside NSO to get her that certificate.
    Now she's 15yrs.happily married to a japanese.
    Life.
    Idk why do we need to experience this hiatus.
    Me I don't want to be married again..I just want to be free.

    Thr problem is that the filipino needs to be under the us courts jurisdiction. this means they need to be living in the courts jurisdiuction a certain amount of time...normally six months. tourist visa is only six months so hard for filipino to do thid

      @@cecilemovilla4656 if you want to annul marriage in the philippines , under old law just wait more than 5 years after filing Your Annul Case in RTC Court & must pay a Dr. who can Certify that your husband or wife is psychologically incapacitated (mistiso or kalhati sira ulo) again pay fifty thousand 50,000.00pesos for Dr. fee. Then pay a Professional Lawyer fees to handle your case, it depend how hard or how much money you have, that was my experiences. I do Not know New Divorce Law in Philippines how easy & how much or time you will consume. In America just pay less than $1,000.00 & Lawyer will handle everything for you & receive your certificate of divorce less than a month, then marry again as many as you can as long as you can handle so much head ache.

    Attorney, what about an overstaying tourist who is still married to her Philippine husband? Can the overstaying tourist who is also working without a work permit annul by filing a divorce petition in the US to sever her Philippine marriage? Can she use that document to remarry in the US, using that Divorce decree? Does the tourist need to become either a permanent resident or a U.S. citizen before she can file a Divorce to declare her Philippine marriage null and void?     Sadly, not all information was included. Sir, u seem to suggest that divorce can be done unilaterally - that u, acting alone, can complete the process in the US while the opposing party is in the Philippines. And why can't a CA person not get a Las Vegas divorce? Isn't divorce in the US nationally recognized?
