    I know a Special who tells a tale of interest. He & a regular colleague were flagged down by members of the public and told of a suspected rather drunk soul sleeping in their car in a public car park, they’d seen the person stagger & fall while crossing the road. My friend Did note in their notebook entry that no keys were in the ignition but the suspect was asleep in the driver’s seat.
    They roused the driver, whom seemed dazed and confused initially. They admitted to having had a pint, (this was After my friend had had one driver admit to having a single glass of wine the night before & blowing over 4x the legal limit at the roadside…), and was having a nap before driving home. The breath box was out of calibration, and the called for another that was soon supplied but that also was out of calibration. By this time the suspect had perked up, and was very understanding, and happy that they were being treated with dignity & respect, and when arrested on suspicion of drunk in charge (based on eye witness, admission of pint, & necessity to secure evidence of evidentiary breath test), was then perversely (not sexually) pleased that it was one off the bucket list.
    The suspect had expressed that they had a medical issue affecting their balance, but, again, not an uncommon excuse. This actually transpired to be the case, as the suspect blew zero back at the station. They were then conveyed back to the car park, and unfortunately their stay had exceeded their ticket so a PCN had been issued. My friend gave the suspect a note (official) with their details and a CAD number on it & told the suspect to challenge the ticket, using them as a confirmation. Nothing more was heard thus my friend suspects the council rescinded the ticket.
    His point in telling the tale;
    In such cases they Must suspect and arrest to secure evidence. It is up to the suspect to prove they were not going to drive. If it were to fall upon police to prove intent before arrest, there would be more actual drink drivers and our roads less safe.
    My friend adds that in a serious injury or fatal collision, you may have 10-12 plus officers protecting the scene for between 6-15 hrs while investigations are completed; and these officers are Not available for even the most severe offences, thus two officers tied up for 4 hrs with a suspect being held overnight is a much better thing, (except for the suspect…)

    Trying to do me for drunk in charge I was in driver seat and the van was searched no key was found and I didn't have a key on me how can they do me with no key

    Hi I was wondering if there is a minimum amount of time they should hold you in custody for before letting you drive home. By the way this is for drug driving. I know someone who recently got arrested and held for approx 2.5 hours but was told they need to hold him for 4? So we were a little confused about this?
    Also they did his blood test, the woman had two vials ready but apparently struggled to get enough blood for two. So she kind of suggested he didn’t have one for himself and asked him if that’s okay, where he felt the need to say it’s fine. Does this change anything as they couldn’t provide him with his own?

    So if i was asleep in the back of my car, seats down, camping mattress and duvet parked on private land (friends driveway) there would be no problem?
