I've known instances locally where politicians/state employees buy land where a future highway was going, that took land by eminent domain. Ultimately they did receive more per acre than surrounding landowners. It happens more often than most realize.

They feel they can get it on the cheap because of what you said, "hope value." However, an easement generally trumps an imminent domain claim, especially if there are other locations nearby that could be used instead. Just because it's the most convenient location for the County doesn't make it the ONLY location for the County.

Ever notice that it's always some ordinary person that has had land in the family for 100+ years that gets targeted and never some industrial park or office park or HOA that gets targeted. You want land? Go seize the land of the county commissioner and see how that works out.
I watched a video about a month ago, a family in Louisiana or Georgia was being forced to give up their land for a road project. The house was passed down a few generations and the current owner was planning on passing it to his kids. I’ve seen others, not one had a politicians house involved.

Eminent domain appertains to every independent government. It requires no constitutional recognition. It is an issue of sovereignty. The 5th Amendment does require just compensation and limits the seizure to public use. That's what court is for....is the compensation enough and will the land be used for the public good.
Elections tend to have cycles associated with them that restricts when remedies can potentially be addressed. Also, it takes council candidates that have the political will and capability to deal with problems within a community, including consideration of legal avenues.

That jump in projected water usage is due to the Data Center they want to put in the county. Data Centers need a lot of water to keep them cool. It's not for the people, it's for that Data Center tax money and the promised assistance to them from the county to get going. It doesn't take much to put 2 and 2 together here.

But they are kindof ruining these people's history and future, so there should be a pricetag on that. Therr are different ways to assess value. As a farmer myself, the USA citizens should be deeply concerned by the current governments in many many states, if not all. Water rights, land seizures, farm closures, property tax increases, the amount of regulations both federal and local on top of the prices to produce the food itself. Its no wonder I've seen farm after farm close down around me. It's a real shame and our country is already facing the consequences via inflation on our food prices. It will get worse if people don't wake up and realize our farmers are the ones who feed us all! Food doesnt grow from the grocery store shelves! time to contact a good lawyer, you all your neighbors should join together and file class action lawsuit against county claiming overpayment of property taxes. If the property is worth so little, why are the taxes being levied and collected from you and your neighbors based on a higher value? Guess they will be refunding millions of dollars to property owners in the area due to over payments of property taxes due to their inflated property values just to get more money out of you and your neighbors. Someone told me when the government wants what you have they will do whatever they want, come crook or hook, they will find a means to legally take it from you. It sounds to me that what has happened in my state of South Carolina also applies to Caroline County. County officials blindly approved new permits allowing growth to undermine their area's ability to support that growth and the county then expects its citizens to pay in one form or another for the county's lack of proper impact studies and accountability. This farmer nor any other citizen should not be made to sacrifice their property, freedom or their heritage because of bureaucratic ineptitude.

I country tried to take my land as well. Thankfully we have protection in place to block any form of government from touching our land they do not rightfully own. This land has been in our family since 1908 and all of this government overreach is out of control. You need to do your homework to secure the land you own and make sure any politician who has tried to take your land is terminated from all positions of power. It does not take much work on your part to speak to your neighbors, social media etc to make sure all the parties in those positions of power are replaced.

The fair market value today isn’t the fair market value that land would be worth in 20 years. This is why people say not to get rid of land, because it’s a non depreciating asset. Then, they go on to talk about power lines, roads, etc. what would we do with public infrastructure without eminent domain? The same thing cell phone companies did when they wanted to expand. They rent or buy the property owner out to put a cell tower on their land. They didn’t force them, it was mutually agreed on. My family just paid 250k for 56 acres and 300k for 43 acres. So yes. 7000 is more than a reasonable price. I dont know why so many people things its not a reasonable price for farm and woodland. Its actually quite a good price.
They will send an evaluator to raise your taxes on property but when its time to make an offer they will never offer the evaluation value, although you've paid the taxes for it.
The increased demand for water needs of commercial and residential development can be addressed in another manner, just limit the growth. Caroline County Virginia is predominately rural. It has the misfortune of straddling Interstate 95 and is part of the Washington-Richmond corridor. As people are moving south from the close in Washington area counties, land developers are salivating over plowing under farmland to grow expensive housing which usually end up being only 20 feet from each other. Some of these rural counties should be declared slow growth or limited growth. Minimum of five to ten acre lots would do that. Housing like that can depend upon well and septic instead of public water and sewer.

They need to put in roof collection for rain water because this part of country gets plenty of rain water to fill in voids. We get 5 inches a year but it waters the grass all summer once collected off 2000 sq ft of roof. Send to an underground drum then pump out to sprinklers.
Avonmore seized my home & property (near Ottawa Ontario) with no compensation. Taxes were paid up. They just didn't want us to have a pet store on our commercial/residential property and they didn't want indigenous peoples in their town. It is happening all over Canada & the US.

A water intake station is mostly underground and any utility building would be along the river. They aren’t going to need to take this guy’s entire farm for that. Probably an acre along the river and an easement where the pipe would run underground.

Yep the city of lynchburg, Virginia took my families farm to expand the lynchburg airport. Took over 300 acres and paid them enough to buy 10 acres out of town with enough left over for a septic system and well. My father and uncles came together bought the material and built their new house for them. Half the size of the old house, and none of the barns, sheds, smokehouse, and tobacco barns. After they stole his land my grandfather didn't live another whole year. I know he was heartbroken, and I blame lynchburg city for his early demise.
Farmers grow soy for livestock feed, biodiesel, cooking oil, baby food, crayons, candles, printing ink, margarine, tofu and many other products. The US government actually pays farmers to NOT grow "food" crops in some areas.
They tried this in my town in an attempt to build a new highway, one which would have cut through the middle of the farmer's property of which their family has owned over 100 years. Took years of battling it in court, but the family won the case. I don't recall if they were rewarded a settlement.

It’s apparent that they see the value of cash flows associated with additional data centers rather than farm land. Eminent domain appertains to every independent government. It requires no constitutional recognition. It is an issue of sovereignty. The 5th Amendment does require just compensation and limits the seizure to public use. That's what court is for....is the compensation enough and will the land be used for the public good.

That jump in projected water usage is due to the Data Center they want to put in the county. Data Centers need a lot of water to keep them cool. It's not for the people, it's for that Data Center tax money and the promised assistance to them from the county to get going. It doesn't take much to put 2 and 2 together here.

But they are kindof ruining these people's history and future, so there should be a pricetag on that. Therr are different ways to assess value. If they assessed it as rezoned for commercial or industrial development, it would surely be worth more. Such a paltry amount is insulting.

As a farmer myself, the USA citizens should be deeply concerned by the current governments in many many states, if not all. Water rights, land seizures, farm closures, property tax increases, the amount of regulations both federal and local on top of the prices to produce the food itself. Its no wonder I've seen farm after farm close down around me. It's a real shame and our country is already facing the consequences via inflation on our food prices. It will get worse if people don't wake up and realize our farmers are the ones who feed us all! Food doesnt grow from the grocery store shelves!

This is why possessing the land patent for your property is important. With it YOU have eminent domain and the state has no say in anything pertaining to your property. time to contact a good lawyer, you all your neighbors should join together and file class action lawsuit against county claiming overpayment of property taxes. Proof of the actual property value, which they provided, shows the land to be worth far less. If the property is worth so little, why are the taxes being levied and collected from you and your neighbors based on a higher value? Guess they will be refunding millions of dollars to property owners in the area due to over payments of property taxes due to their inflated property values just to get more money out of you and your neighbors. Someone told me when the government wants what you have they will do whatever they want, come crook or hook, they will find a means to legally take it from you. However, that doesn't mean you can not fight back by using their own claims, documented claims at that, against them in court. Its funny how class action lawsuits can cause havoc on county plans. They have told you what they value that parcel of property at, compare that to the value your being taxed via their own property value assessment. A good lawyer will have a field day with them in a heartbeat.

It sounds to me that what has happened in my state of South Carolina also applies to Caroline County. County officials blindly approved new permits allowing growth to undermine their area's ability to support that growth and the county then expects its citizens to pay in one form or another for the county's lack of proper impact studies and accountability. This farmer nor any other citizen should not be made to sacrifice their property, freedom or their heritage because of bureaucratic ineptitude.

I country tried to take my land as well. Thankfully we have protection in place to block any form of government from touching our land they do not rightfully own. This land has been in our family since 1908 and all of this government overreach is out of control. You need to do your homework to secure the land you own and make sure any politician who has tried to take your land is terminated from all positions of power. It does not take much work on your part to speak to your neighbors, social media etc to make sure all the parties in those positions of power are replaced.
So these good stewards and OWNERS are expected to effectively “give away” their land to the ROBBER BARONS that are poor stewards of water, and people moving into the area ?!?

Everyone in the comments talking about how eminent domain has its uses but they should give fair market value have no idea what they’re talking about. The fair market value today isn’t the fair market value that land would be worth in 20 years. This is why people say not to get rid of land, because it’s a non depreciating asset. Trading land for cash isn’t a good investment, especially farmland like this. Then, they go on to talk about power lines, roads, etc. what would we do with public infrastructure without eminent domain? The same thing cell phone companies did when they wanted to expand. They rent or buy the property owner out to put a cell tower on their land. They didn’t force them, it was mutually agreed on.
Imagine selling your land for 100,000 and 20 years later, you have housing development projects come out towards your land and now the land you sold for 100,000 20 years ago, is now worth millions of dollars. You’d be very upset with yourself. Now imagine instead of selling the land, the government took it from you. The government just stole millions of dollars from your children. I’m not sure how it’s possible to be so naive in 2024. The government doesn’t care about you or your family.
We lost a few hundred acres in Caroline back when what was then called Fort A.P.Hill opened. Thankfully my Great Grandfather was a Dollar man during the war and they didn't take the rest!

Only the government can come in and demand you sell your land for pennies on the dollar, to them. Claiming the right to eminent domain. My family just paid 250k for 56 acres and 300k for 43 acres. So yes. 7000 is more than a reasonable price. I dont know why so many people things its not a reasonable price for farm and woodland. Its actually quite a good price.

They will send an evaluator to raise your taxes on property but when its time to make an offer they will never offer the evaluation value, although you've paid the taxes for it.
The increased demand for water needs of commercial and residential development can be addressed in another manner, just limit the growth. Caroline County Virginia is predominately rural. It has the misfortune of straddling Interstate 95 and is part of the Washington-Richmond corridor. As people are moving south from the close in Washington area counties, land developers are salivating over plowing under farmland to grow expensive housing which usually end up being only 20 feet from each other. Some of these rural counties should be declared slow growth or limited growth. Minimum of five to ten acre lots would do that. Housing like that can depend upon well and septic instead of public water and sewer.

They need to put in roof collection for rain water because this part of country gets plenty of rain water to fill in voids. We get 5 inches a year but it waters the grass all summer once collected off 2000 sq ft of roof. Send to an underground drum then pump out to sprinklers.
Avonmore seized my home & property (near Ottawa Ontario) with no compensation. Taxes were paid up. They just didn't want us to have a pet store on our commercial/residential property and they didn't want indigenous peoples in their town. It is happening all over Canada & the US.

A water intake station is mostly underground and any utility building would be along the river. They aren’t going to need to take this guy’s entire farm for that. Probably an acre along the river and an easement where the pipe would run underground.

Yep the city of lynchburg, Virginia took my families farm to expand the lynchburg airport. Took over 300 acres and paid them enough to buy 10 acres out of town with enough left over for a septic system and well. My father and uncles came together bought the material and built their new house for them. Half the size of the old house, and none of the barns, sheds, smokehouse, and tobacco barns. After they stole his land my grandfather didn't live another whole year. I know he was heartbroken, and I blame lynchburg city for his early demise.

Farmers grow soy for livestock feed, biodiesel, cooking oil, baby food, crayons, candles, printing ink, margarine, tofu and many other products. The US government actually pays farmers to NOT grow "food" crops in some areas.
They tried this in my town in an attempt to build a new highway, one which would have cut through the middle of the farmer's property of which their family has owned over 100 years.
Took years of battling it in court, but the family won the case. I don't recall if they were rewarded a settlement.

I’m not surprised. Just take a look at exactly where Caroline County is located - between Richmond and D.C. Extremely valuable real estate given that the Virginia area is home to the most densely packed corporate cloud computing infrastructure worldwide.
And given the rapid growth of AI, cloud computing platforms are now in much greater demand for real estate that is in close proximity to a water supply. That’s because AI data centers have temps 10X higher than traditional cloud computing systems. Hence the need for land near a viable water supply. 💯
Given this, it comes as no surprise why a money hungry local government would try to invoke an eminent domain statute. It’s apparent that they see the value of cash flows associated with additional data centers rather than farm land. Wouldn’t be surprised to learn if the local government has had any discussions with an industry lobbyist regarding this matter.
