    Here in Florida I have looked at a lot of houses for sale. The asking price of a house in an HOA is almost always lower than an equivalent house not in an HOA. People are willing to pay more not to have to deal with an HOA. That fact completely destroys the myth that HOA's maintain property values because it is easy to prove that they don't.

      HOA fee feels like paying rent as a homeowner. That is one reason I avoided homes with HOAs.

      The developer of HOA communities will subsidize the cost of building things like internal roads. But when you move in he dumps all of that on the homeowners causing the HOA fees to skyrocket. The communities are also usually built with golf courses to make the area seem more desirable but always fail.

    I live in a community with an HOA. The home I bought was the first house I ever bought. It is a corner house and thus has twice the landscaping of any other house (big mistake). Five huge pine trees in front and on the side, and four very tall palm trees in the back garden. The landscaping maintenence is a significant expense. The trees have to be professionally trimmed each year. The pine trees drop carpets of needles which have to be blown and vacuumed. Two pine trees became diseased and cost $2000 each to remove (mandated by HOA). In short, don't underestimate the cost of maintaining trees, bushes and lawns. Buy a house with the minimum landscaping needs.

      I think blowing out needles is not healthy for the trees. They are supposed to be reclaimed by the tree while also preventing rival plants growing near because they make soil more acidic when they decompose. So it is no surprise to me that after such "care" some trees got sick. Pine trees probably have hard time growing on a lawn.

      I don't have HOA, but I totally agree with the trees 😂
      I am surrounded by trees, and the amount of leaves that fall in autumn is too much. And some trees lose their leaves throughout the winter until spring. And these trees are not even on my property... but the leaves land on my property.
      Sometimes, I wonder why I am cleaning leaves that are not from the trees on my property.

      I had an HOA when I owned a condo. Went to the meetings and voted on agenda items, such as painters and landscaping contractors. I didn't know single family home owners had to pay out of pocket.

    I'm an American expat, that lives and owns properties in Central America. One of my properties is within a HOA in Costa Rica. This is my first HOA experience, and my last! The HOA is polarized, toxic and problematic. I plan on selling this property in the near future.

    Excellent, straight forward info. We are in a Florida HOA community which has a golf course. The amenities are open to the public (golf course, restaurant) all have lost big money over the last five years. Our yearly HOA fees have increased dramatically over the last few years with most of proceeds supporting golf course. I have serious concerns going forward and considering selling. Unfortunately, our fees do not pay for anything related to our homes, yards or roads. It feels like we are throwing $$$$$$ down a black hole.

      There are too many golf courses for the number of people that play golf. Work to get it turned into a park ahead of time rather than let it get developed.

You see the developer of our community still owns the course and leases it to us for a ?? nominal fee. Unfortunately, we (homeowners) are 100% responsible for maintenance, upkeep and improvements. Bad situation.

    I had an ex girlfriend who owned a house in an HOA. She had the habit of always ignoring their mail, and she didnt pay the fees for maybe 18 months...it was like $3500. They sold her house at auction and put a note on the door that she had 30 days to vacate the property. She tried to fight it legally, but was told it was too late.

    My neighborhood used to have an HOA. They got rid of it before we moved here. Amazingly enough.....the neighborhood didn't go downhill. It's actually a selling point now for people who need to move or sell their homes, since so many people have gotten burned by HOA's in the past.

      Things like broken down cars in the front yard would likely be against local ordinances, not requiring the intervention of an HOA.

      Even with no HOA there can still be rules. Often a city has rules of its own about weeds, bushes, trees and unregistered vehicles. I was ordered by the city to reduce the height of my bushes and to cut down a dead tree (in my rear garden but visible from the street).

    Bought a house in a great area. Know people who live there and all was well for many years. Then a group of “busybodies” slowly wormed their way into leadership of the hoa and quickly ruined it. There were over 50 homes sold in a year from people moving out myself included.
    Stay involved in your HOA and vote.
    My mistake was thinking it would always be run right.

      Better yet, get yourself and some likeminded friends on the board and dissolve it. If for whatever reason full dissolution is challenging then at a minimum pass into the bylaws that any and all future actions (including everything) can only proceed and pass with 100% total unanimous voting consent of all HOA members. That means that literally nothing can ever be done if even just one person says no. Effectively it nearly destroys the HOA.

      We are living in a very degraded and unethical era. Nothing is being run properly anymore. Look at what’s going on in the schools with all this weird gender stuff. It sure wasn’t an issue when I was a kid. This country has lost its sensibility. We really need to get the lead, fluoride, arsenic and other neurotoxins out of the water supplies.

    I live in a 55 plus community north of Tampa Florida. There are 60 units here built in 2017. Our HOA fee is 75.00/ mo. which is unheard of! There are no amenities but I wouldn't use them if there were. People are very nice here and everyone takes care of their property. Lawns and fencing are taken care of plus garbage. Our HOA board is very efficient and they don't get into your business. I love living here but it's a one of a kind situation. The HOA fee was a big plus when moving here 3 yrs. ago.

    The problem is that no matter how amenable the HOA is when you go in rules can change and fees can go up and that ALWAYS makes your investment into a home unsecure.
    Even if there’s a guarantee there’s no guarantee they will always find a way around the guarantee so you might get stuck and possibly even lose your home in the process

    In 4 years, our condo in Garden City HOA went from $600 to $900. Also many random assessments for several thousand dollars at a time. After Hurricane Ian in September, we had $7000 assessment and that was the last straw for us. Just sold and are grateful to be out!

    Based on the horror stories I have read, the board is key. If the board is a bunch of jerks(or thieves), living the HOA can be hell. If not, living with the HOA may be okay, at least as long as the present board is in power. The problem is that the board may change from one to the other.

Get your research goin in order to fight back if necessary, and if a matter is concerning LAW-retain an attorney period or you WILL live to regret it!     Great information. I live in Florida, which has tons of HOAs. I don't mind living in one but if I had to do it again, would have asked the following: when was the last time dues increased, when was the last time there was a special assessment, are there any special assessments coming up, and how much money is in reserve...

      Your realtor should be asking this when getting the docs, or you should be asking. Be as nosy as a condo commando before you buy.

    In nyc many - if not most - apartments are co-ops, not condos. Co-ops are essentially condos where the building forms an HOA. They are typically 15-20% cheaper than a condo, which is substantial in nyc. I live in a co-op and did all the due diligence you’re describing. I find the board to be super reasonable and the fees are partially tax deductible. This model probably works better for an apartment building, since I have no property that is “outside” that the HOA can impose arbitrary rules on. We just pool together to save money on shared buildings costs.

      Yes but in a co op the underlying mortgage on the property which is over and above your mortgage can be very very high. You didn't mention that. I would never buy in a coop

    My mother spent most of her last years in an HOA community. She told me the neighbors don't get up in your business, but otherwise, it does nothing if a neighbor causes issues for your property. I have other close relatives who live in HOA communities. One of them was hounded over fake shutters that had barely noticeable damage. He got tired of it, and just removed them. Neither of their communities offer shared amenities, except a small park in one of them.

    In a small, affluent Dallas-area subdivision, we thankfully had NO problems in over 10 yrs. with the HOA, nor did any of the neighbors have conflicts with each other. Families were all very polite & usually too busy to find picky fault with neighbors. Best place ever!

      It is ALWAYS up to the buyer to chase about for information. The seller will only do the absolute minimum required. You will NOT get the information willingly handed to you that you are seeking. The barking dogs next door? I love dogs! The sewer smell that wafts by every night? I can't smell well so I didn't notice! The apartment complex that is being planned in the nature area across the street? Finally someone is doing improvements to that empty lot! Yeah, you won't be told what you want to know.

    Is maintaining property values worth granting other people the power to fine you and possibly foreclose on your home? When you factor in that most mortgages are 20-30 years and you have no idea who’ll be running the HOA 10 or 15 years from now. I think not.

    We owned a condo in the Fort Myers area for about 10 years. It was a small neighborhood part of a larger development. Ultimately we were under three management boards. Luckily the three different boards had hired responsible professional management companies. I was on the HOA Board of the local neighborhood board the last few years. Another lucky break was we sold our condo for a nice profit in June, a few months before Ian hit. We returned to our place in the North full time. All the points you made in this video and the later one (Florida Home Buyers Blindsided) are spot on. I would highly recommend them. Even though we have just experienced winter for the first time in a decade +, we are even more delighted with our decision.

    New sub. Doing a lot of binge watching! Excellent video. But… I think you should not mix HOAs of multi-family units with HOAs of single family home neighborhoods. Completely different HOAs. Also I think you should do a video on how much power the HOA board can hold, and how difficult it can be to oust board members. I have over 30 years with multi-family HOAs and they can be a nightmare.

    When looking at an HOA/Condo Association's financial statements, you need to pay particular attention to the percentage of revenue being generated from fines/penalties. If the community is getting more than an immaterial amount from these fines/penalties it could be due to an overzealous board/manager being nitpicking (especially management companies that get a slice of the penalties) or a community of scofflaws. Neither of these is desirable.

    Good explanation Jerry, but in times like these, when good property comes up, you basically have 24 hours to send the offer, otherwise property is pending already.
    This scenario is still happening in Florida, so if you’re out of State, your time to explore those HOA’s are kind of limited

    I live in a townhome with a HOA. At the time I bought it, it was one of the very few homes in my budget even with the fees. Finances are in good shape and there was a only $10 a month increase this year and no increase at all last year. A special assessment for roof replacement before buying my house just ended. Still, I hold my breath every fall when they set their budget for their year.

    I'm just 3:40 in but people can also obtain a copy of the declaration, bylaws, and rules and regulations from the county records or seeing if that HOA has a website with the info. Please also check out reviews online about the HOA. Some counties will even provide you with this information if you call and provide them an email to send it. If you're already going through the process you can also reach out to the title agent, they can provide a copy normally.

      The meeting minutes will also let you know about the structure of the buildings and if there's any foreseeable issues that may cause a special assessment in the future. Also ask for a copy of the approved budget so you can verify reserves.

    I am glad I live in an HOA community. I don't have to worry about yard work, exterior building maintenance, snow removal. My neighbor can't leave their rusty old car leaking oil in the driveway and paint their house in bright fuchsia pink. Units sell in reasonable time at good prices.

    I bought a condo in a small complex. I didn't know much about HOAs, but I knew the smaller the better. Nice people. I've now joined the board. The only problem is that they're too cheap. Soon some expensive maintenance will need to be done and I think they're currently in denial. The value of the small complex is extremely high, and expecting to get by on the cheap isn't realistic. Jerry is absolutely right. Single family residences (especially without HOA) are great. I get it. But people that say they'll never pay HOAs should add up their own single residence maintenance bills. Unless it's a very new house the bills for roofing and such and repairs come to bigger numbers than they let on.

Don't get married and squat in a hut in the woods. Otherwise, you choose your tradeoffs to allow you to do what you need or want to do involving banks, local governments, and sometimes HOAs depending on the options available to you and/or the tradeoffs you chose to make.

    I’m very happy with my HOA, it’s one of the reasons we bought the townhouse where we did. The grounds are meticulously maintained, if we ever have a problem it’s addressed immediately, it covers everything but electric. I’ve lived here for 5 years and never had an increase, and I even got a new roof last year. True it’s not for everyone, but it’s perfect for us.

      You are fortunate. My dues have gone up each year for the past three, and I had a special assessment for a new roof. I also had to pay to replace the skylights out of pocket.

    I've been renting a unit for about 5 years. What I found a bit odd is that they change the managing company almost every year! That smells like a red flag but I can't understand why. The owner is also stonewalling and never lets know what's happening in HOA. Otherwise all looks good on the surface, never ran into big issues.

    I was looking at Eagle, Colorado property on Zillow. One of the property caught my eyes, it was an unimproved large acre of lands. The property is listed for $100K. HOA due is $100K per year with no house on it. Ouches, not sure if this is a misprint.

    At one point, I was searching for homes in Colorado, and I saw that non-HOA communities often had some serious junkyard homes, homes with cars and scraps in the yard, and even one horror show house that honestly looked like from Freddy Kreuger, eerie! I prefer a very cheap HOA community ($30/mo) that just does yards, trees, and trash.

    In my HOA area the biggest issue is parking lot not having enough spaces for cars 2nd is painting the house or fences and load music. When we moved in back in 1999 it was peaceful area now it just went CRAZY

    We don’t have HOA here in the UK. You get some tenement style buildings that have service charges, including ones now that are trying to charge millions for cladding replacement since the Grenfell fire a few years back (building owners put cheap cladding up and are now charging people to replace it).
    Evil.

    Can you request the bank statements from the HOA? See if they match the annual budget/ statement sent to residents. I strongly suspect monies being misused/ pocketed off the books. Mgt. and board are running the club like its their private kindgom. They continually ignore valid safety issues. They are extremely lax with the security never removing outsiders from beach areas. Its become a public beach in a private community.

    Like with every business; management makes a big difference. As for HOA inclusions, the last year of looking while renting in South Florida I’ve seen like only two HOA’s including basic cable. The rest just water, lawn care and access to the pool, and clubhouse. By the way rents are outrageous yet people are still competing to get anything to live in.

    Loose covenants, conditions and restrictions are not loose for you to enjoy your home with more freedom . They are loose for the board and management company to interpret however they want and to refine with additional rules and regulations whenever they want.

    I'm in FL, HOA's are very common. Have lived in one over a decade. Over the years, only a few letters for doing some minor things which I quickly resolved. No big deal. Most bylaws are on websites of the communities, so you can find them there. No, homes do not have problems selling or sell cheaper, I've seen homes around me sell within just a few days! People don't care, they have other things they are looking for like location. No, I don't want to live next to somebody with broken cars in the front yard or irritating neighbors doing odd things, or some who think extremely odd color combinations for the house look good. They don't. Property value is maintained because you don't have a bunch of eyesores right next to you. Everything looks as nice as when the community was built. 2003! That isn't bad! To have a neighborhood still look new. Nobody freaks out over anything, rules are not hard to follow. Usually, it is the person who does something first without even a thought to check and see if it is allowable who has problems. People do really stupid things. You find that out quickly in a non HOA neighborhood. Money is managed well, no issues. I know other people in other communities who say basically the same thing. Are there extreme ones out there? Sure. But finding out info is a lot easier than it used to be. If you see one you are interested in, go to their website, you most likely will see the bylaws there to download and review.

    the information isn't new. You didn't say about HOA fees limits. Technically there is no limit to how much an HOA can raise dues each year in Florida. That said, within each HOA's CC&Rs there could be specific rules on raising dues. For example, some declarations may state that there can only be a 5% increase each year, however, this is on a case by case basis.

    I live in an HOA, what I detest most is having to ask permission to fix or repair my home. HOA says when work is finished to let them know so they can inspect it, I NEVER contact them---never. Homeowner vote to increase dues or not, dues been increased 3 years in a row, I always vote no.

      Just look in your town or village and see properties that are non-HOA compare that square footage with the communities that are Hué and some even have amenities on site.     Subdivisions and the almost automatic HOA's which go along with them are in a large way southern creations. Due to a lack of strict zoning laws, you get planned higher density subdivisions and HOA's. HOA's for single family detached housing are almost unheard of if you come from northeastern or midwestern states. I say this because huge numbers of people are coming from these two regions.

      You're correct. I just saw a history of North Long Island where huge mansions were built in the late 1800s. Less than a third are still standing. The trend was (and is) to demolish them and build high rise like they did with Rockefeller Center. 200 brownstone homes were demolished to build it. High density neighborhoods with single family homes that have 9 ft between them is normal now. But if a person wants to have their own garden, they should not have lawn maintenance imposed upon them without their consent. I battled this for years, they scalped my grass and killed it. Then it was up to me to replant the grass out of pocket.

It might not be bad now but some pushy neighbors might get themselves on the board and then wreak havoc. I was against HOAs from a long time ago and then I saw John Oliver's piece. Whooey!

      A POA rarely owns the property. And HOA on the other hand may or may not own the property on which the home sets. Another key difference is the type of entities involved with the organization. Hué is mostly deal with homes, whereas POA‘s represent homes and businesses.

      They are enforced arbitrarily. Some rules are ignored completely, some are enforced to the letter. It all depends on who complains and who is in power. The only safe thing to do is follow all of the rules to the absolute letter or someone who doesn't like you might make your life hell.

    Some other things about HOAs ...in some states they (the HOA) can foreclose on your house for unpaid fees. That's not just HOA fees either. That's late fees (you might not even know you owe). That's fines for you not putting your garbage can away on time. If you don't pay those fines or fees, and the HOA hires an attorney...that $400 fine can turn into a $12,000 fee overnight...and if you don't pay...you can get foreclosed and you house auctioned off...for real. There have been HOAs with people on the board that have done this to residents only to buy them out from under them at auction for pennies on the dollar. You can get copies of the rules, and the minutes of meetings...but that's not going to tell you about the personalities of the people on the board. I would never in 100 years live in a place with an HOA...ever.

    I was an HOA property manager for years. Everything stated here is accurate. There is another part. How approachable is the management and the board? Good to bad management can turn on a dime. You can go from a board who has a sense of community to a board who's more interested in power and control.
    As an HOA property manager, please understand I had to take hard nosed stances on many of the rules. If I didn't, things like parking would have got out of hand real fast. I can't begin to tell you how many residents felt they were special--the rules didn't apply to them or they're only skirting the rules just a little. Even if it was the board who started to make exceptions, then everyone wanted an exception. Soon it becomes impossible to enforce any rules.

    We live in a small HOA. There are 13 units. It is fanatical. The HOA fee is reasonably. The management company is efficient and responsive. What I like about this HOA is that there is no queen bee. At the moment, there is NO ONE on the board.

    I’ve heard HOA horror stories , but personally, I’d never even consider living in a neighborhood without a strong HOA. Property costs too much these days to risk someone moving in next door who parks a massive truck with jacked up wheels on the front lawn, or thinks that purple is a perfect house color. As you rightly say, it’s absolutely key to get a copy of the HOA Rules and go over it carefully, BEFORE you buy the property, so you know you’ll be a good fit from the start.

      Tell me you're a Karen without saying you're a Karen. The only real pro to an HOA is that if a neighbor does (Or has) something you don't like, you can complain to the HOA and they can hopefully get them to stop. But that can also be a big CON if a neighbor weaponizes the HOA to cave to his unreasonable demands.
      Case in point? I used to work with someone who told me that a buddy of his had a really nice house in an HOA neighborhood with a 3 car garage. He had a vintage 1960's Camaro that was in concourse condition with all numbers matching. As such the engine produced that lovely "lopey" sound, and anyone can tell you that the sound comes from the cam in the engine, not the exhaust. All the neighbors liked his car and thought it was cool.... until a manbaby moved a couple of houses down and started complaining about it. The car's owner offered to not rev it up, drive past his house, not start it up during certain hours, etc. Very reasonable. The manbaby wanted him to take the car and store it offsite somewhere or "fix" the sound. Yeah, uh.... no....
      ....So anyway, the car owner started receiving letters from the HOA that a neighbor complained about his car. His responded back that he offered to make reasonable concessions and the guy turned them all down, so he is out of luck. Fast forward two more letters and one day he sees a tow truck backing into his driveway. The tow truck driver said "I'm here to remove a nuisance vehicle from this residence." The car owner said "The hell you are not." The tow truck driver actually had the nerve to get out of his truck and make a beeline for the guy's garage. Well after the man threatened to call the police - because the tow truck driver was technically attempting breaking and entering - the two truck driver left and said "Call your HOA I'm not dealing with this crap." So he turns. Turns out the HOA has a "nuisance vehicle clause" where if they receive more than three complaints they send a tow truck to remove it. Needless to say, he put his house up for sale due to the HOA siding with the manbaby.
      Now if that was me, I would choose to live in a non-HOA house so I if a neighbor doesn't like my car's engine sound I can tell him to kiss my ass. Also, let's say he doesn't like that security cameras I put up records audio. I'll tell him to pound sand. What's he going to do, call the HOA? Haha.

    I have lived in both and I will take HOA every time it keeps out so many problems like political signs and flags,people having cars up on cinder blocks in their drive way. How about the guy who puts a 23 foot camper in his drive way and let his daughter and 3 kid live in it.I don t like rules but they can come in handy some times

      Probably depends . I personally will not live in one. I've got a friend who isn't allowed to cut a tree branch without permission.

    I think they need to present there audit to the members. And that they need to be investigated by state authorities. Not local since they have influence

    I am looking for raw land, and having a hard time finding one that doesn't already have an HOA. Gimme a break... $500 a month? There is nothing on it. It only has electricity!

    My HOA was very selective about what they would enforce. My next door neighbor would let her dog out of the front door unsupervised and come into my yard and urinate on my bushes and poop on my grass. I complained over and over and they would do nothing about it. But someone hit my mailbox and I bought a replacement that was identical except the door had a handle instead of the little tab on the front and the ‘board’ lost thier minds and wouldn’t allow me to put it up. Moving soon…
