    I just ripped the phone accessory off my phone and threw it in the trash. I will no longer purchase anything from that phone accessory place and I encourage everyone else to boycott them. Together we can make a difference!!!

    At some point, eBay, Poshmark, and other online platforms are going to have to stand up for sellers and fight these frivolous lawsuits, because it will start affecting their bottom line at some point in the future.

      They do. They stopped, or at least postponed the 600$ tax reporting bill in 2023 by bringing sellers to DC to meet with congress. They're standing up for us but we also have to get our senators and congressmen on our side.

      It’s there to protect the owner’s income from that product if it is trademarked or copyrighted. Those laws exist for a reason because then the rich people would be poor if they didn’t make a law to protect the rich.

    Ebay should offer some layer of protection to its sellers against ridiculous lawsuits or accusations not throw you under the bus and hand over your money to whoever sues you

      i think ebay has been sold to the enemy. i honestly feel that is true. just like alot of other entities have been sold to the enemy. The consumer protection in this country is damn near non existent. been that way for a long time. system is set up to continue to rape and pillage the people. no upward momentum for the people . no forward progress. oh got too much upward momentum. gotta knock them down a couple pegs.

      Ebay dint do shit for sellers, they only care about buyers, where is all the buyers gonna be when sellers disappear, im leaving eBay due to their treatment of me, they don't listen to anyone, not even buyers, I have excellent feedback, my buyers praise me, but I've been knocked from top rated plus for years to below standard because I've had to cancel a few orders in the last year, that's it. Ebay can bite me

    Assuming the way the law was described in this video is accurate, eBay has a vested interest in getting their legal team on top of this. In the event all manufacturers take this hard lined approach, eBay's entire business model is in jeopardy.

      @@RockstarFlipperhave you seen where over 200 people on ebay are being sued by bunch o balloons for selling fakes? I sold about 2 and had 10 listed and have been named it it. Ugh! I messaged the attorneys back and am waiting to see what they will do next. I have no idea what they will go after and i'm freaking out! Help!

    The scary part of this is that any company can suddenly decide to start bullying resellers.
    These big companies need to be accountable for their behavior.
    I don't understand the reasoning behind it because it's such bad PR.
    I don't sell those products but now I'll never purchase from them either

    If you are getting sued, checking reddit might be a good way to meet others who are being sued under the same lawsuit. I heard of a girl from Germany who was being sued this way. After struggling to handle it herself. She found others on a Reddit thread and they split the cost for a lawyer and the charges were ultimately dismissed.

      I wonder if it isn't a scam? I know this type of thing happens to small businesses with bricks and mortar locations regarding ADA rules. They go on google earth and measure for "compliance" and call the company demanding thousands claiming they are going to sue because their ramp is a quarter of an inch too short.

    We need to reform the trademark system. This is just way too much. You shouldn't be able to trademark a word that's in the dictionary at all. While looking at trademarks the other day I found so many stupid trademarks.

      So many things are trademarked or copyrighted. Fonts, logos, words, phrases, etc. Some that have been around 'forever'.

    Let 'em lose all the extra free advertising they get from all the resellers not to mention turning their brand into poison in the market. Chinese fakes are one thing but them sticking their heads up their own asses and going after resellers that sell used products? Well, I hope if they're doing that they go broke as soon as possible.

    A few years ago retail resellers like tj max & Marshall’s stopped writing the brand of shoes on their shelves and changed it to “popular brand”. This is very scary knowing how companies copy each other and want to force people to buy new.

    The law states that the owner of any legal item is allowed to sell it. However, fascist companies don't like the competition. What's baffling is that Ebay panders to this, when they should be telling these companies to pound sand.

      @@RockstarFlipper Ebay gets sued everyday. They could counter sue for loss of revenue. Instead they buy a company with program that searches for cheap t-shirts and hats with company logo and tag that doesn't match.

    All this for a 15$ shirt? I felt like I was a target when I sold a couple of remote controls for ceiling fans and who knows - it might still come back and bite me, but I only had two bought from a garage sale who's inventory came from a gaylord from our local Goodwill. These companies need to track back to these other businesses if they have a problem with their inventory ending up in the wrong place.

    These monster companies that do this stuff to people selling legitimate products are living the high life while most of the people that sell one or a few of their products are just trying to make $20 to keep their lights on and feed their family and pay bills. All the while they are eating the best of the best food and living in multi million dollar homes, and the sad part is they enjoy what they are doing. If the shoe was on the other foot they may just have a different outlook but that will never happen unfortunately. I wish there was a way to stop these billion dollar companies, and take them from the penthouse to the outhouse, that would thrill me to no end. Thanks for the information as always. Keep up the good work on spreading the word to keep us safe on these important issues.

      Ebay is getting in the middle if they are shutting down accounts and relinquishing their funds to anyone other than the account holder.

    I am involved in something similar. I got sued by an american university. I lost my business over this. I even got a lawyer and still no luck. Few points to add:
    The defendants are only sealed as it goes through the court this is a tactic to give the defendant no time to defend the defendants are all unsealed near the end.
    The cost for a lawyer to file lawsuits like this is ~$450 unlimited defendants can be named.
    You can find all the lawsuits by getting a pacer legal account and searching illinois copyright lawsuits. Its scary how many there are.
    The vero list does nothing any company can decide to sue you.
    It can be new or used items.
    The settlements prices and fighting this is getting harder. People were able to settle before easily while now their tactics are more difficult.
    I dont know what to do...

    I am a supersmall seller. And haven't even been fully focusing on my store much these past 6 months or so, cause of life and health. However, I had an emoji birthday/party set of items up, including the 💩. So took that s*** down. Unlikely they'd come after someone like me...but with my luck, it'd happen lol. This whole thing is so frustratingly ridiculous.🤦‍♀️

    It’s beyond absurd to be able to control a second hand item this way. Are they going to sue every thrift store, every person who gives their item to a thrift store? Are they going to tell customers when new they can never donate, share, sell what they are buying?

    I was told by Ebay that a dog scarf which had a "velcro" type closure could not be listed with the word "velcro" in the title or description because of similar copyright or patent issues.

      Velcro is the brand name. Hook and loop tape, or dots, is what I see used as the generic description.

    I had a p**p imoji hat so I took it down, and two no name phone sockets that I just went ahead and took down to be safe. None of them were worth much and no way worth possible trouble later. I am so shocked. I have gotten counter fit designer watches in my Goodwill mystery boxes that I obviously would never sell, yet Goodwill can sell them to me !!! This is so frustrating, I luckily sell mostly stuff that would never be an issue, vintage glass ware, my handmade stuff and vintage knick knacks, and some random household type things, but I do have a lot of costume jewelry listed and I had some clothes I wanted to list, now I am not so sure I want to. Hopefully the jewelry will continue to be safe, just costume, nothing expensive.

    Needs to be a scale back approach if the person/company they going after costs them more trouble. They drop it as it’s not worth their time. Not the other way around where they suck them out to dry for a single item they knew nothing about. This is very similar to the farmer getting sued for a termination seed growing on their land because a few seeds “blew” over……

    There should be some sort of 'league' of re-sellers that distributes information so if many are being sued they can find each other via some sort of reseller network. It's easy to bully small businesses when they're not banded together.

    I mean I get it. If I had a trademark on some thing and people were selling my trademarked item, I would want to be the only one to sell associated products.
    HOWEVER, I would also want to extend grace and kindness to those who may be completely unaware that they’ve infringed on my trademark and kindly inform them. Why can’t people be kind???

    It's not worth selling on eBay any more. Between companies suing and the stupid $600 tax rule. The increase ebay fees and shipping fees.. I quit.

      It’s not a $600 tax rule. It’s a $5000 tax rule. And it’s actually neither. It’s a one cent tax rule. If you make money online, you have to report the income. It doesn’t matter the amount. The tax law for reporting 1099 does not apply to you. Income tax law applies to you and it always has. The new law only affects the companies themselves having to send you a 1099. You still have to report your earnings no matter how much you make.

    Well good luck on a company suing me for that kind of money. Id be going to my congressmen and file a complaint against them. Its really pathetic comming to small one time users for this. Atleast give a warning to take it down. Ive told ebay tons of times that we as sellers dont always know whats on the banned list. And as humans sometimes put things up we may not know is not legal to sell. And a warming to take it down 99.9% of the time.. would be suffice.

      How about contacting your congressman or senators? How about the Commerce Department?
      There should be a way to raise awareness about what these so called lawfirms are getting away with.

      I don’t understand why everyone is saying stuff like “contact congress” and “someone has to protect us”.
      You need to protect yourself. If you are running a business, you should have general liability insurance. The insurance protects you from exactly these situations. They hire an attorney to defend you in these cases.
      It’s not anyone else’s job or responsibility to protect your business. It’s yours.

      ​@@RockstarFlipperits not. find some good lawyers. Have a group and anyone who finds the group and is under a particular lawsuit can be added to the cost of lawyer. This way they will start thinking twice before starting a lawsuit for fun. Also the major problem is the law. The law should specifically say that they should make efforts to warn you before they start a lawsuit. If you dont listen then they can put you in a lawsuit.     This is a GREAT example of why you do NOTHING in your own name and EVERYTHING in a LLC and I would even do another step to go further and do an LLC where they cant figure out who owns it. The lawyers will get fed up and go right past you.

      That's probably because you failed to set up your llc properly. Just registering an llc doesn't do squat, following through the entire registration process does. If you did the correctly, YES you would be projected and secure behind an llc.

    Our courts systems are beyond broken. Fairness and justice is not how our court systems rule. It is only about who has the most money. The deeper the pockets the better chance of winning a case. It doesn't even matter if you are guilty or not.
    And, as far as product manufacturers not allowing their items to be resold, screw them, I say everyone should boycott their products until the company goes broke from a lack of sales. Who cares how good their product is.
    Once I buy a product, I should be able to do what I want with it. It becomes my property. What are the producers / manufactures going to do next? Tell you when or how can use their product. They should never be able to have that kind of control or overreach after it leaves the store where it was legally purchased from. Ridiculous!
    I don't understand why reselling platform companies are not banding together for a class action lawsuit. Resellers should unite to pressure the reselling platform companies to help reform laws against this kind of bullying. If we don't, soon there will not be any merchandise to sell for resellers. Which means resellers and reselling platforms go out of business. A "reseller alliance" needs to be formed, together with mass publicity to the public. This is the only way.

    This happened to my husband when he barely started his ebay store and we settled on $1,000. It's terrible and the lawyers are so rude! We had no idea and tried to tell him that but they don't care at all. They used a fake name to purchase the item also and it was sent to a p.o box.

    There are an estimated 24 million sellers online. It will take those 24 million sellers to contact (consistently) our federal legislation to have these laws fine-tuned. The only way to fight these billion dollar companies, is to find someone with more money and power than these companies. AKA the Federal Government.

    Thank you for the information! I, unfortunately, am using a P_S holder on my phone because I have bad grip strength due to neuropathy. Now I need to find a similar but different product to switch to that is as quality as this one. The ring style hurts my hands but the squish in and out circle kind is the one I use. As for the emoji situation, good to know, too! I don't gravitate toward those types of products but if I see one I'll pass it up. I'm only just getting started on my journey into reselling, so this is super helpful news. Thanks.

    I've been hearing that now is the time to up the clothes as more people will be buying used clothes online in the next 5 years, but with that said that will make more stores close down and start online sales....which makes me think to stay above the resellers out here they will all start going after non company sellers like this to save their businesses....any thoughts ?
