  • Malaysia's top court Friday struck down over a dozen Shariah state laws, saying they encroached on federal authority.
    Many Muslims denounced the decision, and said they feared it would undermine religious courts in Malaysia.
    In an 8-1 ruling, the nine-member Federal Court panel invalidated 16 laws made by the opposition-run Kelantan state government, which imposed punishments for offenses from sodomy, sexual harassment, incest, and cross-dressing to giving false evidence.

    I myself is Malay Muslim and I'm tired of hearing people say "we cannot practice Islam fully if there is no sharia law". If you go and live in Germany or Norway or Russia, you can still practice your religion without any problems lol. Clearly these people never travel outside of their country.       The foreign countries have a lot of hurdles, France has banned home schooling and other western countries have banned segregation in schools. There are a lot of issues other issues that are actually significant. The basic idea is quite simple to understand, step by step, inch by inch, Islam must be erased from the society. It all starts from the top. European countries are already in process of banning Imams from abroad and home train the Imams with state sanctioned cirriculum. It might take 50 years or 100 years, but that is the ultimate aim and objective.
      It is only a matter of time before western countries succeed in making Muslim governments pass law where a girl can have sex with anyone including other girls and not have to marry and the same will apply to boys. The national TV will be controlled so as to not issue programs that are considered Islamic and so on. It is in motion gradually all over the Muslim world.

      I agree with you my friend. I am Canadian and we have an open border policy and we have even built mosques for Muslims to worship. The government even lets you have a religious exemption for your occupation so that you can maintain your Namaz on time

    Malaysia is a federation comprised of Malaya, Sabah & Sarawak. Though Islam is the religion of the federation, the country is secular in nature as it places the Federal Constitution as its highest law. All communities accepted this when Malaya gained its independence in 1957 and when Malaysia was formed in 1963. Unfortunately some politicians are riding on this issue to garner votes from conservative Muslims.

    This was not about 'Islamic Laws'. It was about the Constitution. If those so-called 'Muslim Politicians' really wanted to enforce 'Islamic Laws' what they should have done was to amend the Constitution. Why they did not ? They wanted to politicise the issues. They wanted to create a situation where Islam as a Religion is under attack. Those politicians wanted to be a hero. In order to be a hero you need a villain. Now they have a villain, the Court.       for so many years the state of kelantan called the federal government to amend the Constitution to allocate for the installment of Syariah Law for the whole country!
      when the call was not heeded the state of kelantan had no choice but to at least establish syariah law for the State of Kelantan!

      @@justrawr6856Eventually it will be enforced to non-Muslims as well. The Indonesian province of Acheh uses the Shariah Law as well as Indonesian legal system to administer the province. Shariah law is supposed to be only used on Muslim offenders but there are cases where non-Muslims are punished according to Shariah Law. Several men are caned publicly for gambling, but they are not Muslims. An elderly Christian woman is also caned publicly for selling alcohol.

If people want to voluntarily participate, that is up to them except when it involves manipulation, mental, or physical abuse, especially of others. It’s a slippery slope when you ban beliefs, but I agree those practices must be prosecuted according to secular law. If you have a parallel system, like Sharia courts, then prosecute in accordance with those laws as well. That said, the secular law prevails when it comes to punishments like imprisonment, torture, and the death penalty.

      Yes it's cause in Islam the religion permeates through every aspect of life and government. Outlines how literally almost everything should be. Christianity does not control everything to that extent which is why it's so compatible with secular society and democracy. It allows culture to be preserved while still worshipping the same God as other believers around the globe.

      @@andrewsantillan6020 as a Christian I agree we do separate state and church which is why liberty is a much bigger trend in Christian dominated countries but if Islamic countries do this separation straight away it won't work because then the constitutional laws would be directly taken from religious law book and I m referring to the hadeef which is another discussion anyways... The solution is to always put religious courts at a permanent disposition by making it less than the official judiciary of that country... However any challenges to sharia means putting secular law above religious law which will threaten the effect of the religious law. Islam as a spiritual belief is way to barbaric and the actions of Isis are just an eye opener to the actual rules and regulations to be followed by the quran... The West must not entertain a cultural hug with such countries and vice versa!

    For context, the issue isn't even being anti shariah or anything, the issue is that there were already federal laws dealing with the specific issues mentioned which had more severe punishments than the shariah enactments made state level. Due to this, 16 out of 18 of the the state level enactments became null. Almost all the issues in question are still punishable, not legalised.

      You made an important point when you noted that the punishment meted out by Sharia law is generally not as harsh as federal law in Malaysia. Because of Sharia, muslim men can get away with lenient or nonexistent punishment for crimes like rape, domestic violence, honor killings, and such. This change is a really big deal, especially for women!

      The ruling this time was 8-1. Muslim countries do not become more tolerant over time. The case will come up again in the future. There will be a new judge, and the ruling will be 7-2 in favor of freedom. A couple years later the court will need to decide again, but the ruling will be a narrow 5-4. It's only a question of time.       I have a better solution, might as well merge Perlis, Kedah, Terengganu and Kelantan into some kind of New Federation of Caliphates and secede them from Malaysia so that they can build a nation based on whatever syariah law they want, then they will be dubbed the “Afghanistan or Pakistan of Southeast Asia”. Don’t involve the whole Malaysia, we are a multi racial and multi religious country with different beliefs and cultures. Those Malaysians especially the fundamentalist minded Muslims whom don’t like the idea of multicultural or a multireligious identity can move to the newly Islamic Republic of Kelantan or whatever you want to call it.

      @@glurppuffloid9796 To understand this problem of Malayisa’s religious division we need to look back at history of how Malaysia became radicalised, This all this started after the Iranian Revolution in 1979 which the secular system was abandoned in favour of the fundamentalist Islamic governance led by Imam Khomeini all because they want to depose the secular but autocratic Shah monarchy whom was viewed as the agent of the Zionist west by the radicals under the slogan “Islam is the solution”.
      This move then spillover into other Islamic countries including Malaysia which some of our major Malay Islamic parties adopted this motto and this causes a political competition between UMNO and PAS during the 1980s to see who can out”Islam” each other to see who is more “Islam” and this is how we got into this mess today.
      Not only that, Some of our ulamas whom have studied in countries like Egypt, Saudi Arabia and Pakistan where Islamic fundamentalism is rampant even in some institutions, brought back the radical form of Islam back into Malaysia and this adds more salt to the wound.

    The protestor might want to read the judgment. This has nothing to do with Islamic laws but has everything to do with the jurisdiction that the state legislature has over the subject matters that it can or cannot make laws for.     Let me tell you an anecdote about Sabah based on Philippine history, cause I'm Pinoy.
    Once upon a time Sabah used to be a Philippine territory. We'll it was going to be by the 1960s or 70s something. Why? Let's just say that the president of that time (Google it, it's interesting between the global POV and the Pinoy POV) requested it be settled, cause that's how territory-making worked, old school style or something.
    But then came along the president's infamous "opponent": his very own bestie. Yes. Just a jealous one, cause the girl who the guy ditched ends up becoming the president's girlboss goddess of a wife.
    Another to consider is that bestie was like in his head to the president "that was supposed to me bro!" cause guy actually liked power, covering it by being righteous and heroic and sht.
    Which was why bestie met with the homies who haven't moved on from WW2 and said "if this means war it means war".
    So they blew things up around the country.
    Now here's the interesting part. Bestie made a deal with terrorists from Malaysia. He was like "I receive= gang gang; you receive= Sabah".
    And because the new jaundice government of 1986 didn't give a fck about Sabah, hence it's free real estate for Malaysia who were probably like "I see this as an absolute win".

    People don't know exactly what sharia is. They think it's Islamic Law and that's why all these confusion. Basically a tribal law where a group of people fallows. It it's not the law for the whole community due to other tribal existence. When a solution aren't in tribal affairs than they go outside of the tribe. Now combined tribes are formed in one, so sharia is not acceptable.

    Muslim Countries are different from the west, so the ideas many people expose here will not necessarily apply to Muslim Countries. The problem with Malaysia and every other Muslim Country is that Islam is a System that includes rules for Social, State, Political, Justice, Behaviour and Existencial norms, more than any other Religion. Their justice system relies mostly on the words of the Prophet than in actual facts. And that was reflected in the decision. That guy is one of the reasons that I will never visit Malaysia again, or any other Muslim country due to their retrograde and unfair laws. Look at Saudi Arabia, Iran, Pakistan, etc, and see the denigrating laws and conditions those countries have, I know coz I lamentably been there........

    Religion should never be involved in the legal system. Anybody that thinks it should has a primitive mind. Religion is for your heart and your home not for Law. This primitive mindset should not be tolerated anywhere.

    I have lived in several SE Asian countries, including Malaysia, Thailand, Indonesia, the Philippines, and Vietnam, also having traveled through Laos, Cambodia and many others. In my view, Malaysia has the most potential to develop into a very strong regional economy and become a significant international player. This recent court decision just further confirms that Malaysia is on the right path of development. It's as if Singapore had a child with a very bright future! 🙏

      A country like Malaysia which doesn't allow its citizens to marry whom they want to marry, except they convert to another religion, is not the place where I want to live in. In the Philippines, the state doesn't care about religion, when two people fall in love and want to get married. My wife and I have totally different religions and neither her family, not any officials nor she herself cared about it. And I don't care about it either.

      @@wernerschneider4460 I believe divorced isn't allowed in Philippines for their citizens, and its due to religious (Catholicism) interference with the state? That is one thing that had made me really uncomfortable with Philippines as there's no separation of religion from government.

      Oh. Wouldnt it be Indonesia who has the potential? They have an enormous land mass and population to be mobilized to what their direction is. Also, they have vast amounts of natural resources. And Indonesia still shares the same Malacca Straits. They have more potential imo. Just my opinion tho

      Of course its peaceful. If we compare with hindus where they dont care about the environment, or buddhist where its all about money, or christians where theres a lot of crime in majority christian people, muslim still way better

    One time Malaysians are all Buddhist, Hindhus, they were converted to Islam so may be a Islamic country present because of Islam population secondry but first which religion was there must not forget reality.Born to a mother she is real mother may be you got 2nd mother it will not be equal to first.
