    I think its a good idea, as its a very serious matter and there are many things to consider. Financial, emotional and children !

      Yeah, divorce is a complicated process, and I think it is great that people now have an extra month to make sure that their children will be well taken care of

    We in Australia had a great marriage with China, but Morrison destroyed that through bullying and mental abuse, unfortunately our family is now suffering, hope fully a better partner will come along in the future and we will have an even better marriage .

    I was married in Shenyang, 8 years ago, now living in the UK and going thru a divorce, my Chinese wife was not impressed with the length of time it takes for a divorce in the UK, for a basic amicable divorce, like mine, it will take a year to 18 months, she said her first divorce in China over 10 years ago, she just went into the local Solicitors /Lawyers office and if it was amicable just fill some paperwork stamp and stamp job is done (well little more involved, but you get my point )..but interest subject...just a side note i am not a divorce expert this is just my personal experience ...Peace and JaYoe

    Hey Harry, thanks again for bringing up an interesting and important issue.
    I thought Canada’s one full year legal separation requirement before the divorce could take place is a good one. China’s 30 day cooling off period is a tiny step in the right direction.
    I’ve been visiting China frequently for 20 years, during which I’ve noticed a significant change in people’s attitudes towards divorces; from very conservative 20 years ago, to almost nonchalantly recently, especially in the bigger cities. Some jokingly said that they are now more ‘westernized’.
    Marriage is an important event, its ending shouldn’t be trivialized.

      Yes - attitudes in China are changing a lot, regarding a variety of issues. Honestly, the changes I have seen over the last ten years, especially in regards to how young people in China view certain things, have been astonishing.

    For me, it's a good idea especially for couple to cool off their head from fights, arguments.... A person will get more insight of their situations once they've calmed themselves down.. But one month is quite short, three months will be better for couple to have their own personal spaces to decide important decisions...

      My uncle got stabbed by his wife in that time. He's fine now, and they're divorced, but still stabbed.

    It’s definitely a good idea. Impulsive decisions often lead to mistakes, so you want to make sure the decision is not made at emotional peaks. If you really intend to divorce, you can move out anyway, so an extra month won’t be too onerous.

      You should not be impulsive when you decide to get married! So why not have a period before which you can repent when it comes to getting married?

      @@personwithnomeans709 actually, there is a cooling off period of sorts in HK. You have to register your intent to marry at the Registry with at least 90 days notice, before you can be legally married. During those 90 days, you can cancel any time.

    I think the current divorce rate is relatively high because many people, especially young people, are bad-tempered and stubborn. In many cases, they don't want to give in to each other, so they get a hasty divorce. In fact, some people feel regret when they calm down after divorce, but it's too late. So I think this cooling-off period has some significance.

      Yeah - I agree - I do know people that had gotten a divorce here but ended up regretting it - and due to fear of losing face, did not get remarried. Very complex...

      I think if you don't have children then divorce is not a big deal, but if you do, you should think longer before separating

    In Canada: "If you have already been separated for at least a year, an application for divorce that does not include other claims, such as custody or access, support or division of property, can usually be completed within four to six months."

    Then all women in Australia would divorce their husbands in Australia.
    From memory, years ago, people had to be separated for 24 months before they could apply for a divorce. I'm not sure if there's any change.

    It’s a great decision yes. There’s all types of people in this world, some are more impulsive than others. A couple may have a fight and feel it’s so dramatic that they may need to divorce, only to realise a short time later that they feel way better.

    I am glad China this new legislation to prevent easy divorces without couples consider the ripple effects and long term consequences. I attended a Singaporian civil marriage ceremony for a Christian couple in front of a judge or magistrate to consider the serious matter. I think especially for the children, the psychological scars could be very devastating. I have met this kind of people over the years. So I totally endorsed and besides what God said about divorce is quite clear.

    In NSW you need to go through 3 counselling before submitting to the family court and grace period applies from there.

    With some exceptions, divorce cooling off period is a great idea to give the couple sometimes to reconsider their decision.

      @@Hali88 Yes, that is me - but it was for the purposes of a television program. It was quite an awkward experience - that was the first time we had ever met, plus it was like 40 degrees that day, so it was extremely hot out in the sun wearing a suit. I feel sorry for the girl I filmed that with - it must have been much harder in that wedding dress!

    Hi, I'm new here - just want to mention in Germany there is actually a waiting or "separation" time of one year. Yes! One year. In fact you hand in you will to divorce, then wait one year and then you'll get officially divorced.
    There is only one way around that - If both parties can proof to be "separated" from bed and kitchen for already a year.
    keeping that in mind - 30 days is peanuts. smile

    in Italy we have a separation period that was 2 years but now it is 6 months, that became 1 year and half if there is a children.

    Some hotheaded couples do need a cooling off time to think over their impetuous decision to call it quits and the consequences / impact it brings. Good thing this is now in the marriage law.
    If in the future, you can get hold of people who did go through this, that would be more interesting from their perspective (without revealing their identities.) Thank you for bringing up this topic.

    The process in Australia, under normal circumstances, is 12 months separation before the application for divorce can be lodged, and this must be confirmed by both parties. After divorce papers are lodged, they will be reviewed by the court in a period of maybe 3 months or longer, after which if all criteria is met, divorce is granted. Only one party need lodge papers, as long a a copy has been served on the other party. Once the court grants the divorce, it does not take effect for another month. As you can see, the overall time amounts to about 16 months from separation date to finalisation date of the divorce.

      Hi Frank - thanks for watching. Yeah, as I said, this is for divorces where both sides have agreed, so hopefully they will be able to sit down and sort out the financial issues amacably as well

    Nice content! I believe 30 days is not that long , there are places that you need to be separated for 1-2 years . I’m a foreigner and I’m about to have a divorce with my wife, argues..different culture clashing. She wants to file and get 50% of my salary for child support ! What? I believe that’s a bit high considering that I also need to live and somehow later on get my shit together . It really sucks , she is not working but her father has money , I believe all women should also work hard for their kids .

    In Italy we must apply for separation, wait for the judge to allow the couple to live separate, wait 3 YEARS and then apply for divorce. Need a lawyer for both procedures and it cost time and money.

    Did you know in Australia you have to be separated for 12 months before you can apply for a divorce? You are considered single already by social security agencies during the separation but legally only 12 months later can you divorce.

    Seems logical having a cooling off period, in some situations. Some people have hot heads and this is a way of overcoming it. At the end I suspect that if people want to get divorced nothing will stop them.

    If no children are involved, it should not be a problem to divorce. Violence and threats for sure a divorce should be accepted and maybe a fine or some kind of punishment for the abuser should be warranted to make it safer for the the victims from either side.

Divorce should be the last resort I believe. Every marriage is worth saving especially if children are involved. Also, the a grieved couple must have love each other....once🤔 But, time out/cooling off is important to try to work things out. It doesn’t always work. I am sure you must have watched, Kramer bs Kramer, Mrs. Doubtfire.... it’s sad ending, but may be a beautiful beginning too. Thanks 🙏

      @@alanx1522 I agree - I might be a bit old fashioned, but I don’t think marriage is something that should be taken lightly... and even if things aren’t going to well, there should always be a way to sort things out. I think it is about respect and understanding... some things in life are worth persisting at

      Hi Walter - Yes, although since I do not own property or a business in China, I only really know about income tax, as that is the one that relates directly to me.

      Real estate has taxes but varies in different markets. And also have trading taxes etc. depending on the local demands

      Real estate taxes (ie capital gains tax, stamp duty etc) are typically paid by the buyer and the seller keeps the whole agreed price for the property. There are monthly management or strata fees that the owner needs to pay whilst owning the property, but otherwise I’m not aware of other ongoing government duties.
      For commercial taxes, there are various ones to my knowledge. Corporations tax, import/export tariffs, luxury good tariffs come to minds. At the moment, I don’t think there are capital gains or dividend taxes for stock trading, but I could be wrong on this one.
      China’s tax system is no less complicated than other countries and you can do a degree on it 😂

    Infact l think 30 days is TOO short to re-think this serious decision.
    Maybe l come from a traditional family who value marriage as a family bond far more than another.

      I think this is designed specifically for people who have come to an amicable decision to get a divorce - so it is just an added buffer period to make sure both parties are sure that a divorce is what they really want

      A family is the Unit of society and its bond ensures the bonding of a society.
      A nation should spend time encouraging people to think about what a family means to a nation and society.
      Having divorces throughout a nation will only ensure that children grow up with a loose bond with the family and thus the society.
      Everybody knows that living with another for 50/60 years is tough....but isn't challenges supposed to strengthen the person...rather than choosing the easy road out. Isn't that what marriage is supposed to be!???
      This mindset is necessary rather than going into it with a mindset that if it goes badly one has a ready formula to get out.
      Of course there will be marriages that are not meant to be. This is different.
      For most other cases.
      ..divorce should not be encouraged.

    That's just the paperwork. Your lucky if you can clear up in 3 years in Australia if assets are involved. I stayed legally married for protection from other women until my ex paid for it :-) After all she got $300K. The actual physical part took 2 minutes to walk in grab her tooth brush and leave a "flash divorce". I got her dinner as well that night. Don't dwell on it move on and enjoy life.

    You have to be separated at least A year before you can apply for divorce in Australia, much slower than China. 😂 😂
