      I met a guy who got called in because he was behind in his child support payments. Seems his old lady was hiding out with the kids so he didn't even know where they were, but he was still harassed as a "deadbeat dad". He dug in his heels. No kids, no dough. They let him go.

      @@johnhardin2269 tell you what.,...in Germany as a man/Father you MUST pay...even if you do not see your child!!! So unfair. Most judges in family courts are women...so you can guess the outcome..right. Again: as a male in germany you are FUCKED after a divorce. There are even man that hide away just to avoid paying the high amounts of child alimony. While most women get state suport,Child support AND alimony..making MORE money then you with a paid job!!! How fair is that?? And most women do NOT work...for sure with kids under 12 yo.

    Actually, when you divorce in China both parties gets what were originally theirs before marriage and split anything bought during marriage.
    It looks like husband gets all because all the things belongs to the husband before marriage.
    Most Chinese women wont even consider a man for marriage if you dont have a house a car and a high paying job.
    Even then the women and her family tends to preasure the man into adding her name into every asset and property he owns.

    the marriage law in China does not favor man or woman, it's mainly for portieres, whoever paid the house before married will get the house, if the other person contribute part of the house will get some compensation. If they both paid the house and two names was written on the paper, then they will split the house. it's simple as that.

    It is not the husband takes all, it is the property owner get all. It can be the husband or wife or both.

    It is very common in China for a couple to get a notary that determines their property and wealth before marriage, therefor if they get divorced, each side will only get the predetermined percentage of the property and wealth. It is fair that the side contributes more to the family would get a bigger portion after divorce.

    Misleading title, husband take what belong to his own family( including anything from his parents and before marriage) and the same for wife. Anything own by the couple themselves during the marriage will split to half.

If that isn't good enough look for someone willing to sign a prenup (stating what's mine is mine and what's yours is yours)? Don't use divorce statistics to avoid marriage as there are ways to protect yourself.
      There are people such as my mother, she divorced from her first husband (my older sister's dad) who was a total piece of shit to her. She could've taken literally everything from him hell his mother even encouraged her to take everything from him, she could have made it where he had no custody of my sister. My mom took nothing from him, she was not paid child support properly yet she never reported it, and she let him have weekends with my sister.
      So don't go believing all women would take your stuff if you get divorced plus you shouldn't even look towards divorce as that in itself will affect your psyche and possibly lead to divorce. HOPE YOU'RE HAPPY HONESTLY, BUT NEVER LIVE AS IF SHITS SET IN STONE.

      That POS's mother was the best grandmother I could've asked for, as my mother's mother I hate her and wish for her death. She considered me her own, she introduced me to anime and wherever we saw each other she'd have an even # of Pokemon card we'd open our packs and we'd trade cards. She didn't do the anime and Pokemon for me, she did all of that before she new I liked it. I wish she was stil l around but sadly she passed before anime streaming sites were a thing.

    You guys seem to make it that its totally one sided in favor of men. From your own videos and other sources, it is hard for men without much resources to even get a wife in China and Chinese women feel entitled to be taken care of. Need to buy that apartment if you want to get married! If the men have to put in almost all the effort into gathering the resources, it makes sense to get them back when when the marriage fails.
    The society may change the rules, but will have to trade off something else to keep it worthy. For example women need to bring more resources into the marriage to being with. In the end if the system become too one sided, it will become an unattractive institution (marriage in this case) and result in less people favoring that form of institution. This is one of the main reasons, marriage has become less attractive to young men in the west.

      Right, women in China are also to blame. But it is just silly to say, it is the men's fault, it is the women's fault. It is, in fact, the whole patriarchal culture in China that is to blame. It is the culture and I think that no one in China really benefits from such backwardness. China is way more patriarchal than many western countries. China's gender roles are still very traditional. The man is the provider, the woman is the one who needs to being taken care of. Being divorced is shameful and so forth.

      unfortunately,the truth is, unlike western house wives,most Chinese wives still gotta work hard to provide for their families ,especially for those in big cities .how is that traditional and patriarchal ? Apparently,women don't have to work 2000 years ago in China.

      That is probably because the Chinese wives in those families do not have enough money as one salary is not enough. You also miss one crucial point, in China, the grandmothers and grandfathers usually take care of the children, hence, the wife can work. In the west, most people do not have that luxury and is forced to stay at home as they most take care of the children and so forth. The gender roles are still very very traditional in China and the culture HEAVILY favors MEN. Look among the leaders of China, like all are men. People want a boy and not a girl. Girls are discriminated in the workplaces in China. It is not comparable. Thus, it is not strange that there are many very very smart and able women in China who become entrepreneurs because being an entrepreneur they do not have to put up with such nonsense and low glass ceilings.

      I‘m sorry but you got the whole thing upside down.Indeed,more and more grandparents in China are helping young couples raising their kids,but it's not the reason of the fact that women work in China but the the result.20,or 30 years ago,when the pace in China is not so fast ,wives could manage to take care of their career and kids at the same time like my mum did.If you don't live in a big city in China like Shanghai which costs the wife too much to focus only on the family,you can raise your kids properly with less support from your patents or your parents-in-law.It's not like a tradition,it's a product of the modernization and feminism,and most important, love from the elders in families.

      I believe they were talking solely about divorce and on the property aquired after marriage, simply because in Europe and in the West the property aquired after marriage is what is split up.
      Another thing - if there are women who don't feel entitled to be taken care of and all that jazz - would they be taken into a working enviroment with open arms? Would they not be looked down upon as business women? I feel like that is also a factor.
      But I don't really know, it's just what I've heard that women aren't taken seriously in the workforce. So how would they bring more resources into the marriage? I'd imagine they'd think "to hell with that, he better be rich if all I'll ever be is his wife".

    As a westerner in China you should really go for divorced women and/or who are around 30. Seem to be way better "deals" than paying a dowry for young women, who are mostly also less independent and self sufficient.

    I'm an American but I think China has a better take on the family court system. I'm scared of marriage because I don't want a woman to get tired of me and leave me, take half my money and run off with my kids, and now I'm forced to pay monthly payments to the woman who ran off while she's with some other guy because she got tired of me. It's the reality of the situation when you're married in America your wife has the upper hand over you. I think realistically it should be somewhere in the middle but where it stands right now as a man its set up so that by no fault of your own marriage in America can ruin you.

    its who ever paid for the house, keeps it after the divorce
    not some anti woman law, rather a gender neutral law
    just happens to be, rich women usually don't get married
    so it seems that alot of (poorer) women are suffering due to this law
    problem is not with the law rather with female nature
    if poor women stop trying to land a rich man and marry some poor man
    then in divorce there will be no house to fight over, cause there wasn't one to begin with

    Taiwan is similar custody wise. Thing over here is that the woman typically moves in with her husband's family. Her mother in law will raise the kids and the wife often goes back to work. In the case of divorce, the children stay with the dad (because his parents are doing the parenting) but the wife is entitled to 50% of assets accumulated during the course of the marriage. There is no concept of one party being the guilty one - even in the case of a proven affair! In rare cases, wives do get granted custody when there are no grandparents and the husband is an unemployed loser...

    Interesting topic, I've had the displeasure of being divorced in China. My ex-wife was also previously married prior to our meeting, we had a daughter and after that things started to go down hill. I was really surprised how cheap divorce is here in China, for the divorce book only was about 8rmb.
    The hardest part about it was that we have a child together and they live in Zengcheng (part of Guangzhou) and I live and work in Dongguan. I do not get to see my daughter as often as I like.

    actually the law doesn't specifically say men will get the house because of being a male. The law states WHOEVER paid for the house will be get the house after the divorce.

    1 Government officials
    2 Rich Chinese men
    3 Rich Chinese women
    4 Middle class Chinese men
    5 Middle class Chinese women
    6 Chinese poor/beggars
    7 Foreign women
    8 Foreign men
    9 Black and Indian women (Chinese are biased against dark skin too)
    10 Black and Indian men
    11 Japanese
    At least we rank above Japanese!

    Even a lot of western jurisdictions now only divide the assets accumulated after the marriage evenly. It is grossly unfair to evenly divide assets earned before marriage, specially assets transferred from the parents. That is just stupid, and more and more western countries are recognizing that.

    Sorry I am making a comment based on only 2:43 of the video. Actually China had a lot of cases against men, and obviously with the balance much much biased towards the women, with the women taking the children as well as the possessions, leaving the men with nothing but tears. And those desperate men, not only one case but in multiple of them, were so frustrated and hopeless that they resorted to violence, killing in some cases even the judges and themselves. If one is so desperate to kill himself and the judge after the verdict, you more or less realize how unfair the verdict is to that person that he/she would sacrifice his own life to call for justice. Those fiery martyrs were obviously loving fathers because they not only lost their wealth or a portion of it but the custody of their own kids, which is a very important thing by Chinese tradition. This has stirred up attention from society, the government to review the situation whereby some evil women marry men only to plunder the possessions. I think the government made some changes to legislation in order to care about men more. There is no absolutely fairness on this planet. But if you see that the balance is tilted, you shift back to normal. Amn't I right ?

    In hong kong, the right to be the guardian of the children are decided by the child's decision and the capability of the financial fundings
    All other things should be divided equally and if couldn't be divided, priority to the opposite who proposed the divorce

    "always favor the woman" is not accurate. It's far more likely to be the case though. It's especially less-likely to be the case if a woman had a high paying job, and they have no kids, or kids were raised by the father

    The law protects both, man and woman. it states that any property you own before you marry will remain in full with you if you divorce. This means that if a woman has the title of the house before marriage, she also is protected. Yes, statistically the parents buy the buy a house and thereby often the man will have in most cases the tittle. But the law itself is neutral.

    I had heard a story about a Swedish woman who married a Chinese man. They had a son together, but then they got divorced, and the father's family took overwhelming custody of the kid, and now she is denied any contact. Because he was young, the child has essentially been pressured into accepting his auntie as his surrogate mother by his grandmother.

    Well.... the marriage and dating market is remarkable efficient relative to western countries and kids don't grow up in dysfunctional single-mother households which are demonstrated to have a causal relationship to increased crime, depression and other mental illnesses, poverty, lower educational attainment, incarceration, or early preganancy, even holding income constant. Westerners are trapped in the naive idealism of gender egalitarianism, Chinese are pragmatic and know what's best for a well functioning society. Sorry if that's harsh or offensive, but the opposite extreme, rampant (often frivolous) divorce is a FAR worse alternative for children. Intact unions are essential for preventing social decay and degeneracy. Chinese need to be VERY careful when reforming divorce courts such that they don't reach anywhere near that opposite extreme.

      I mean, it's not that the Chinese system is really fair, optimal, or the best way of doing things, just that it's still objectively better than the Canadian/American systems.

I was reading The Economist and it mentioned that rural dwellers are required to have a special permit to live and work in the cities. Can you explain how this works if it exists and what rights do these rural people have. Thanks again.

      rural people can live and work in any city as they like. but they might not have health cover as they had back home. some big city have restriction on buying properties and cars. that's all.

To have a successful marriage and avoid those divorce courts requires numerous qualities one of which is the art of being able to forgive and accept forgiveness. To all you men keep in mind that women are very good multipliers. Give your wife a $100 for food and she will find a way to multiply that and make it worth $110. Give your wife the right substance and she will multiply it and give you a child. Show your wife a little love and affection and she will multiply it back to you ten fold in many ways. So when communicating with your wife always keep in mind the law of multiplication and you will not only be successful in marriage but in all of life.

    Love every single one of the drone shots! I am quite surprised (but not completely) that in a divorce in China the man will typically take all the assets. The woman is shamed and isolated, that seems a bit unfair especially with the man getting the assets. It's as if everything is taken from the women even the children. So I guess the upshot given what the woman has to lose it is incumbent upon her to try her very best to make the marriage work and actually work on pleasing the man so that the marriage does not dissolve. Interesting topic and as always another awesome Vlog guys! Thanks!

      Exactly, it's great motivation to make the woman do all she can to make the marriage work, rather than filing for divorce because "she's not happy". FYI: Roughly three quarters of all women in the west who file for divorce give that as the reason.

    Not ture. Wife can takes all too.That depends on many things.In most cases, each side gets half of the common property.In some cases,someone(male or female) may felt sorry for the husband(or wife),so they don`t take any penny.Or in some case,one side disdain to take the other side`s any penny.

      I doubt the woman gets everything. if she is a mom then yes because of the children. That is not equality but more about how the law think they protect the kids. (I disagree that mothers are better parents, but this depends 100% on the situation of the family anyway)

    I too am married for 46 years, live in Florida, USA. Country Music, love it or hate it....has a song about everything. There is one about divorce sung by a guy with lyrics " she got the gold mine, I got the shaft" . gotta love it. Awesome guys, get the tach fixed and now the speedo is out too.

    Those statistics you mention at 2:25~ seem kinda off, you're missing some parameters there. Divorce rate in america is about 40-50% overall. Maybe im missing something, disregard this if that's the case.

      I know some wealthy Thai guys who are refusing to marry Thai woman specifically because upon a divorce all property/assets will be split 50/50 regardless of who puts in what. As far as falang marriage there, it could very well be different as falang can't own land.

    A dowry is when the wife's family gives a gift to the husband, not the other way around. What you are referring to (where the man pays wife's family) is a bride price. In the US the wife's parents normally pay for the wedding (which can be hugely expensive), which is a kind of dowry. Though as others have noted, the husband almost always gets hosed if things go south.

    As a notarial law student, I find this quite an interesting topic... but I kind of felt that the title was a little bit misleading. If I'm correct, it just comes down to the idea that property which is owned by one of the parties before that party enters into marriage remains his/her property and, if the marriage ends, neither the property nor the value of that property has to be shared with the other spouse, whereas if something is acquired after the marriage, that thing (or at least the value of it) has to be shared equally? That in the essence isn't that much different from other matrimonial law systems in many western countries... but I kind of understand what you're getting at in this video: because men kind of have to own a house before they can marry, they'll always get the house at the end of the marriage, and so the woman is never able to be entitled to half of (the value of) the house.

      Why would a woman need child support when it's the man who gets the children in a divorce? Unless it's because most women have the mentality of children to begin with and need to be taken care of as children anyway.

    The title is fake and very biased.
    The new marriage law in 2011 strengthened the idea of "property before marriage", which means if you can prove that you paid all money for a property(house especially) before marriage, then you don't have to divide this property 50/50 when divorce, this works on both man and woman. However, if you paid the property by money after marriage, even if it just use your salary, you have to divide it.
    The law is to protect people from marriage trick. You can argue that this is fair or not fair, but the title is just biased, unfair, and, to my perspective, pathetic.

    I can speak to why divorce law in China has to be that way. Like you said. It actually does not favor the men. Instead, it actually make it fair for both sides. Why? Because Chinese culture and tradition expect men to pay for everything. Even if the wife works and make money, the men has to pay for everything including her car and day to day spending. In addition, for a man to be considered marriage material, he has to have at least a 2-bedroom separate from his parents. Meaning, he has to to have a place ready for his wife to live in together just with him. If the woman is from a higher class family, the man is also expected to give a very big dowry. And if the woman does not work, he is expected to give most of his salary to the wife. So, it will be very unfair if the woman gets half of everything during divorce. Because that means she will get more then 70% of everything. It will be even worse if the she is the one who single handedly break up the marriage.

    The vast majority of divorce cases over custody actually never reached family court in America, most of the time the ex-couple agree that the women gets custody and fathers ask for custody at such a low rate too

    I'm confused. If people are getting divorced on purpose to trick the state, than all that statistics you mentioned are meaningless.
    Also, if laws used to protect women, then you can't say that the society is chauvinistic.
    You should analyse how much women initiated divorces were before and after the 2011 "man takes all" law.

    In China, by law the asset is to be divided evenly between the husband and wife in the case of divorce if one goes to court. But the husbands often hide their assets from the wives (it's fairly easy to do this in China), and so the wives often get less.

    I love all the China supporters come out and comment how divorce is fair in China when this wasn't even the topic and the guys explicitly avoided it. The fact remains, it's extremely biased in the western nations in favor of women, so by default, China has a much more fair divorce proceeding. Therefore, all of the complaints made are silly, but it is great to help the channel out by commenting all the same.

    actually U made another mistake, according to the new marriage law, if the wife hold the house before marriage, husband is not be able to take away. But to some extent, you are right in that the female is some what disadvantage in divorce, especially when talking to the kids.

    80% women file for divorce when their husbands have already moved out and moved on with their lives. Until the beginning of the 20th circa fathers were favored as to child custody. The mom's generally are the primary care givers, so they're favored in custody. Of course there's joint custody. If the dad is doing a number of the tasks in taking care of his kids, then he's favored in the custody. The divorce laws favor from state to state. In CA it's 50-50 as far as the settlement. Many people write up pre-nups. My wife and I weren't able to do so. So made an agreement and had it notarized. We can only divorce for biblical reasons: adultery, abuse and abandonment. Then we must go through marital counseling for one year. If the legitimate reasons are fulfilled and we can't reconcile then we will divorce.
