Rapes in India are about power. Abhaya was targeted and definitely about power. It all comes down to the systemic corruption which is why criminals are emboldened to commit heinous crimes without fear.

Wonderful discussion.... It seems negative impulse in terms of society, education (big picture), and law and order problem.... So many loopholes in there areas can easily prove 'not guilty' untill and unless the guilty sign in a paper that 'Iam guilty'... Diversity in societal structure in India creates major hindrance in creating strict laws and order ...

It was refreshing to see a conversation different from the usual narrative around hanging the rapist and instead considering the issue resolved. So firstly I appreciate the effort on your part to talk about the actual issues behind these acts.
Although the discussion touched a lot of important points, I feel that there were some more issues that could have been looked into. Would like to share some of them over here.
Firstly, we need to understand that morality is a subjective concept, not an objective one. For example, something simple like showing one’s face may be perfectly normal for many of us, but there are regions in the world where it’s a grave offense. We may call them primitive, but they can call us uncultured as well, based on their rulebook. So whenever we try to understand the actions of a criminal, we have to set our ideas of morality aside.
As far as I understand, the primary reason for rape comes from a place of disregard for human identity. This disregard stems from how they perceive the society around them and how their experiences have been. For example, in general, we have a special regard for places of worship like temples or mosques. But other places are pretty much ordinary for us. Public places are especially used very irresponsibly by many of us. Similarly, a person may develop such an attitude for other human beings based on his or her conditioning.
Coming to the act of rape, there’s something important that needs to be probed into before rape is discussed. It’s about sexual identities or roles. These are a major part of sexual arousal among human beings. Ideas like dominance, or submission. These traits are very deeply rooted within the human psyche. For example, I am a submissive male and imagining myself as a dominant person is very repulsive for me. Similarly, for a person who is of dominant identity and driven purely by lust, it may be unimaginable to seek consent in an act of sex, because it could be seen as off putting or repulsive. This is because it would require him to shed his dominant identity. So this person tries to affirm his authority by trying to control the other person, powered by a sexual arousal. This degree of arousal elevates, when the person in front is denied any free will or consent completely, and is completely objectified. This could be the sexual thought process behind an act of rape, from what I can understand.
For this to happen in a social context, the previous point I discussed (disregard) is crucial. A person will only indulge in rape when he/she has disregard for the other human being. At the same time, a person with regard for human life, howsoever dominant, would refrain from acts like rape, even when driven by lust.
So as a society it is critical that we work on a system that makes us see another human being and the idea of this human being’s consent as sacred and something that needs to be negotiated at every point. It needs to start right from childhood and adults need to lead by example, by asking a child consent for small things, or training them to do so. Parenting needs to be taken extremely seriously and the government needs to arrange mandatory training camps for parents. Also, human sexuality needs to be discussed more openly so that the different variations are more clear, and can be addressed accordingly. For example, if identities are discussed openly, a person with dominant identity can be traced easily and we as society can make sure that he does not have easy access to children or women. Apart from this, this person can be counseled and ways can be thought of so that his/her concerns are also addressed in a way that does not harm the society. For all of this, as I said in the start, the idea of morality needs to be set aside, and effort needs to be made to understand the real problems that lead to such crimes.

Bloody hell because our law makers and people on parliament are themselves criminals
So all our court verdicts go in favour of criminals to save people in power .

Also, if an accused recounts his consent for a test after consenting in court - surely you would return him/her to court not just try to convince them??? That’s surely bizarre.

@Mahima-n1q if we punish such people, all those same countries will send their human rights NGOs to lecture us and call us an autocratic country where criminals are executed. If a man rapes a woman in America, he'll be immediately punished according to the severity of the crime. Try it in India and the public will blame you only. The political opposition parties will say that you are targeting a particular community. They'll say minorities are in danger in India.
Tell me clearly, tomorrow if our PM Modi orders that the rapists of Abhaya case and all other gangsters, rapists, should be arrested without warrant, and once the law is convinced that he is guilty, he'll be hanged. Won't you mock PM Modi and call him a dictator ? Won't you complain that human rights and democratic principles are in danger ? If yes then you are part of the problem.
Tomorrow if you learn that a man convicted of rape or murder has been encountered by UP police from point blank range, won't you mock the democracy ? Will you appreciate it ? The day we appreciate such illegal autocratic activities of the government, our women will be free and honoured. We have to choose between democracy and gender equality because of this society.
