Hi guys as so many of you know i have a dispute with my bar, we are currently going through a legal battle to regain control of my bar. Unfortunately i can't really talk about it because of the strict defamation laws here but over the couple of weeks i've received abuse threats, and even people referring to death threats. I'm only a youtuber and a bar owner, Im no gangster or hood yet i've been receiving these threats, Actually the death threats i've heard before from a different source. Guys i try and tell you as much as can without getting myself into trouble.

It's funny how emotions can cost a fortune, he will be sleeping on the beach or the Pattaya flying club. I just wish he would stop begging for money. It's embarrassing.
Hi, I've been in Thailand 28 years'. There's a real reason so many bars fail. I'll Explain. To own a bar you have to register your bar company with the DBD (Department of Business Development) You'll have to register your bar company with 2 Thai Nationals. You'll own 40% Thai national 1 40%, Thai national 2 20%. You'll also have to apply for a non B Business visa, as it illegal to own and run a bar on a retirement visa. You'll also have to employ 4 Thai staff on contract of salary 10,000 per month to support your work permit that you apply for after your business visa. you'll also have to pay social security every month about 700 bath, the amount escapes me, to your 4 Thai staff. And also when you rent a business unit you'll have to pay business tax to the landowner. In your situation, the best thing you can do is make up with your partner, enjoy life in Thailand without complaining too much. You seem like a nice guy, I hope everything works out for you my friend .

Walk away from this or your going to be a whole heap of trouble
Keep an eye on the legal expenses. The lawyers could be milking you while achieving nothing so you get screwed twice. Have an endgame plan and a threshold where enough bs is enough. Keep a bug out bag handy so that you can skip town at short notice with your passport, ticket money, spending money, the shirt on your back, and your life intact. Unlike in your country of origin, the law in the rest of the world doesn't necessarily work on the basis of plain simple logic. There are many other factors involved. Best of luck.
Correct, he should take the loss and move on. Indeed the legal fight will go nowhere if the lease was not in his name. The only winners will be the lawyers who gladly will take the rest of his money.

You never had possession of the bar ! No work permit not your name on the business just your cash input. Your are not a bar owner, i walk past THE bar regular its usually empty
The owner of the bar is the person who owns the building. My understanding is that his (at that time) significant other was going to sign a lease and he gave her the money. So legally that means she got a great gift and signed the lease with that money under her name. Then when things went south she had the lease in her name and he had nothing. If that is the truth no lawyer will be able to undo that and they will simply siphon more money out of his pocket.
Like he said though, no one knows the full story. Have to wait and see...better than anything on that shit netflix 😂

The moment you said, "I could open up a really good profitable bar and something that could make me a good income. I had five people employed." proves you know nothing about Thai laws and legitimate business practices. You then go on to say, "I don't need a work permit because I don't do any work. I own the place." Say goodbye to your money and the bar, before you are kicked out and blacklisted from Thailand.

Agreed @jim6315. This guy is screwed and doesn't even realize it. The world doesn't work like it does in Australia, the UK, or America, everywhere. He's gonna go broke trying to get money back, and then get deported w nothing. All these expats going to Pattaya/Jontien (moving into a red light district) and then getting screwed over because they're gullible and make stupid decisions trying to litigate are ruining Thailand. They're gonna make it harder on anyone else who wants to retire there because of people like this.

No doubt she got a 'good deal' for the renovations from her 'cousin/brother/dad. You could have renovated a hotel or Gogo bar for that money.

You can learn a lot from your story. First of all, it`s possible to open a nice bar if you have the money, drive and discipline. But, NEVER try to save money on getting your papers right to protect your ownership. Use a lawyer.

I don't understand the basis for your reclaiming anything. It sounds like you invested into a property that you had no formal ownership of.
Some bros were never "investing" in a bar for cash in return. They didn't need the cash. They were investing in the $ex trafficking industry. They didn't want a cash return. They wanted a $ex return. I'm not saying that's the case here but it may be, even without his knowledge. His "partner" could be a mamasan without him knowing it. This is happening all over Thai/Philippines and bro here needs to WAKE UP!

Greg you are thinking about Family (defacto) law in Australia. The law of splitting assets after the defacto relationship breaks down doesn't apply in Thailand.
Thai family law only applies with a marriage certificate.
Thai business law? What's that? Technically you are in the category of giving gifts 🎁 to your teelak.
Have you ever heard of paying sinsod ($,gifts) to marry in Thailand?
This also applies to Mia noi or minor wife (defacto relationship).
In the eyes of Thai society " she take care of you and you give her Gifts (sinsod)in return "

Greg mate you mentioned lawyers had previous cases same as you, may be a good idea to ask some of their successful clients of bar disputes to get in touch as they may have some good advice.

Does Thailand recognise equitable legal principles? You don’t have a partnership agreement; you’re not entitled to own a business on your visa; you’re relying on Thai law to get your money back? The first question is, on what basis are you entitled to get your money back? The second question is, does Thai law allow you to get your money back?
Greg's only real chance to get his money back is to not contest the "bar' but to contest the "funding" of the bar. That is, he can argue that he has a "verbal" loan agreement with the legal bar owner. In Thai law loan agreements can be either verbal or written. This case is not entirely hopeless for Greg. The legal owner of the bar needs to repay the loan to Greg. Good luck Greg. Stay strong.

Locals in any country always have the ‘home ground’ advantage. It’s boring and a hassle but a foreigner needs to get the best legal advice first if you are going to invest money outside your own country .

It’s unfortunate it’s come to this. Would love to know why things went south with your partner. Seemed like you had a great thing going. In order for the bar to succeed, i think both parties need to somehow put the differences aside and reconcile. Good luck with the case at any rate.

I have made a couple of suggestions that might not be ethical, but you are not dealing with ethical people. I once said to a motorcycle renter whose motorcycle kept on stopping to either give me back my deposit and money for the extra days or I will leave this motorcycle out in the jungle and fly out.

Hey mate, sorry to hear about your situation, my friend in phuket went through the same thing, he's American thou, good news is you might be ok cause he got a letter from the owner of the bar that he leased 51% went to his Thai girl friend the owner wrote that he the American paid the full amount for the lease and the judge said yes she owns 51% of what she put in which is nothing so she had to leave with nothing and the American kept his bar and the owner (Thai) knows that the American will pay rent every month on time but the Thai lady will argue, haggle not pay on time so catch up with the owner and you should be sweet.....

Hey Palmy, all respect to you mate but this morning I spoke to an Aussie I know who has been living in Bangkok for a long time and who has now watched your videos. Have a good think about this legal process you're going down. You very well could be throwing good money after bad. After reading your GoFundMe it seems to me you've made some critical mistakes here, handing over money without your name on anything. I'm hearing that lawyers in Thailand like to string along farang's however the judicial system over there is weighted to Thai people. I suspect your best course of action is to fix the relationship with your ex GF somehow.

If you’re on a retirement visa you can’t get an income from a bar and it’s in the exs name
Do a deal with landlord. Dont pay rent by due date then landlord takes over than you get it back via landlord deal.

So which Thai owned this business with you? A foreigner cannot own 100% of a Thai business, unless he obtains an Alien Business Operator Permit is acquired. It is virtually impossible to acquire one of these, so this business in reality was not all yours.

He's in a developing country with no money or income. He gave that girl the bar when she handed over the money and signed the lease. He has no contract whatsoever with her, they aren't even married. He needs to get real and go home for a few year to earn money.

He claims to have the right legal ppl there addressing the situation, at the end of the day I hope they given him advice on his potential success.
