Companies very often make it impossible for shipboard personnel to do what they have to do to maintain a vessel. I know, I did it for over 30 years.
43 million cap? they must be insane. clean up alone will cost more than that. let alone negligence causing 6 peoples deaths...not to mention couple billion or so to rebuild that bridge..plus all the months or years of loss wages and income from the city damages..noway is 43 million going to cover all that
It's an international maritime agreement law. Don't expect TV media to know anything about it or go into detail.

@@carbonbomb4774 It _does_ recognize it, as the US has agreed to it, but there's so much legal stuff that US law will take priority. As for the "company," IIRC, this is actually the only ship the company owns. If the government tries to make the fines _too_ excessive, then the company _could_ potentially declare bankruptcy and pay next to nothing. Having stated that, with the ship following international maritime law, it has to have insurance and insurance will likely cover this (or a portion thereof) unless some willful neglect was discovered that would void the insurance.
With shipping, there are many entities involved that "could" be sued: the ship builder (was there a defect from the start?), the ship owner, the company renting the ship, and the crew aboard the ship, and that the people who chartered the ship (for the containers) would end up sharing costs for any fees.
It's nowhere near cut & dry as someone driving their car into a light post and destroying it.

It makes sense for the city to start pointing fingers when it was the ports diesel fuel that had been diluted with water. We need a thorough investigation.
According to NTSB, that wasn't the case. Fuel was tested Ok, however didn't hear anything as of yet to whether or not a "Steering Test" was completed before departure. That's a must on any Cargo carrying vessel.
What other ships had these same symptoms at the port? I'll wait.
Yes, of course, but clear warning signs were ignored. If the operator of the ship hadn’t ignored those, there would have been no catastrophe, and they could have sued the port authority for poor quality fuel. The ship’s operator remains primarily responsible.
Probable cause, based on information available at this time is load share problems between parallel generators. This can be caused by operator error, design error or a defective component. Sailing with a malfunctioning system is very poor judgement. The NTSB investigation will likely add detail to the power failure problem. It can be quite complicated.
Even besides the risk of collapsing a bridge... why would anybody be willing to try to cross the ocean in a ship that is known to keep loosing power?
Good point. It's called lack of conscientiousness. Or losing sight of the fact that keeping the ship properly maintained is essential to a profit making enterprise. Never mind that being stranded on the open ocean could be deadly.
Good question. Individuals should be held accountable for the actions they take as individuals, not 'the company' only.
In this case the people who made those decisions and those in positions of oversight and responsibility should be convicted as criminally negligent.

The infrastructure bill wouldn't have fixed this. Very few bridge designs even a modern one could have done it.

Bridge replacements in many states, as well as replacement lead water lines has used much of it.

It was only 9 years old. Inspected by the Coast Guard in Sept 2023.
I cannot say it wasn't maintained properly but greenlighting that ship as seaworthy is criminal. 6 lives lost, billions in damages...it would be insane to cap $45 million as adequate.
6 construction workers killed, were they working on the bridge ??, was something seriously wr9ng with the bridge ??
They were repaving the roadway on the bridge... normal maintenance, not a failed structure.
Of course higher construction supplies costs.

This was not an instance of _force majeure._ The owner of the vessel is responsible for proper maintenance and for training the crews on proper procedures when leaving port.
The primary cost should be borne by the ship owner and his insurers.
And what is the situation regarding the Navy yards and vessels tasked with national defense? How has this disaster affected our ability to defend the nation, and the east coast in particular?
Considering they hit trucking companies for close to a billion. They better run that bill up.
I worked on ships as an engineer for over 30 years. All companies treated maintenance the same way, do as little as possible to save money. And the maintenance issue is an issue all companies seem to misunderstand. The Camp Fire in California and the recent huge fire in Texas are also examples. Cutting corners on maintenance is common because money people don't understand maintenance, because when it is done right you can't see what it saves.
You will probably find fingerprints from Blackrock, Vanguard, State Street all over this just like Boeing.
You can bet that it is insurance carriers who are trying to dodge responsibility. In the world of scumbags, insurance companies are at the top of the heap.

That's was when it was almost new. It's still only 9 years old but I can't obtain any kind of info on maintenance or repairs. Last inspection I could find was last Sept 23 by the Coast Guard. (???)

Don' they have insurance? I can't register a car without adequate insurance. Payment should be made by the man "insurance company" they took the risk, wrote the policy, and collected the money for it. U.S. citizens should not pay a dime, we are suffering enough by their negligence.
Grace Ocean and Synergy Marine should cover all the Multi-Billion Dollar cost of bridge replacement, lose of life and other costs. Any Taxpayer money from
the governments should be used to repair Baltimore's other Infrastructure problems...and there are many.

Ships losing power is quite an often occurence, and is known by authorities. (see recent new york case of a ship also losing power near their bridge but was luckily in another position).
Adding the 1980 deadly crash, EACH AUTHORITY was MANDATORY to protect bridge pillars around the nations from ships hitting them.
The "weak sauce" dolphins in this case bridge, shows it was done just to put a checkmark on some papers and not done to ensure actual safety, and all the people in power in the last 40 years that ignored doing it right are to blame for everything.

*FYI:* The city is mostly grandstanding right now. Keep in mind the city will not admit that they could have helped prevent or mitigate this by providing better bridge protections over the last 50 years.
There are several entities that have the ability to be responsible when it comes to shipping: The builder of the ship. The owner of the ship. The company that rents the ship. The crew that is aboard the ship. AND the people who paid to have their cargo transported. It will take about a year before the NTSB determines what happens and the court procedures will happen after that (unless an agreement is made quickly). There are maritime laws (more than I know about) which is why the 43 mil was mentioned (that's a cap for one entity). It could be possible the owner isn't responsible and that the crew is _or_ the company the crew is contracted with _or both._ There are lots of things to be considered. The ship builder is probably the least likely to have any blame, unless they can prove this happens frequently enough with this type of container ship from this particular builder.
I still say it was on purpose to hurt our economy. Sure hurt so many who have had their hours of work reduced ot laid off because of this.

Sad thing with big business is that when the port reopens those prices won’t go back down. They raise price for any reason they can find and when that problem is fixed they don’t lower it back they keep it as is to get that money. They don’t care about any of us, it’s all about gettin that money

Seeing that the course it was on was not going to fit the narrative, controls were hacked, ship abruptly changes course, accelerates rapidly striking the support.
