    Great video ! I just want to point out that the conditions under the Van Gend en Loos 1963 decision (2:07) were actually decided by the Van Duyn 1974 decision

    directives can have horizontal effect as well, by using the court system (which is an extension of the state) This is the way that Corina can take action against the state. if corina were to use Benus LTD she would using the court as an emanation of the state is obliged to abide by EU Law. Create the family for horizontal direct effect between individuals. (Cases Von Colson). if an individual want to have vertical direct effect and enforce their rights against the state i need to define what a state is (provides a public service and is under the control of the state can be considered an emo nation of the state Forster and British Gas) Venus LTD can be seen as providing a public service as it administers beauty treatments to individuals, while not under the BTTS it is still subject to Blacktown Council (as seen by it being shut down) so it can be considered a public service

    question: when it gets to indirect effect and the state has to interpret the EU law with MS law, how come it ever goes to state liability then, doesnt it just get inrepreted?? what are the reasons that indirect wouldnt work??

    In a nutshell under the 1972 European Communities Act places EU laws over and above those made and implemented in the UK with with both direct and indirect effect. The vertical and horizontal influences of each party and each law, regulation or treaty are interwoven now and cannot be clearly separated. Perhaps this is why 17.4 million people voted to leave the EU and have national parliamentary sovereignty back to what it was before Heath took the UK into Europe on the 1st of January 1973.

      Altough i understand the fact that people want their sovereignty. It is perfectly defensible to say that the benefits of having an EU (free movement of people and goods, easier trading etc.) Should bring uniformity in legislation and therefore less sovereignty of the member states. In my opinion this is perfectly defensible.

    I would like to ask you what is the effect of indirect effect on criminal liability cases.I have read a paragraph in a book and it was talking about the case of Arcaro (1996) and also the case of Criminal Proceedings against luciano(2005) but i have not understand anything .

      Say there is a directive that says I cannot wear a baseball cap inside. The UK fails to implement it in time so it is not actually illegal. It would then be unfair to prosecute me for something that has not actually been made illegal yet. That is the point of Luciano Arcaro.

    I have recently struggled with this topic and it is what has come up for the exams, what is the approach if a member state passes a bill under which EU law would no longer have direct effect in the MS's legal system unless the MSParliament expressly provides for such direct effect on a case-by-case basis?
    I am very confused. Please help :'(
