    Excellent presentation on the ground that this makes complex matters translated into easy to understand the whole gamut of issues on the other hand it is also very important to learn that what kind of arguments and counter arguments are necessary to reach out the goal of achieving good credit into the account of exam. results.     What I want to know and maybe you can help, is how do you how exactly which legislation applies to a matter??
    How does one break it down to a particular legislation?

    Marcus, 2 weeks to the exam, just watched your all videos on EU Law, came out with a First!! You're a genius. Brilliant. Ironically, the lecturers who I paid over £9,000 for a full academic year, didn't get me to understand EU Law as much as you did in just 2 weeks! Do you do any LLM Modules at all, or LPC? It would be massively helpful!

    This is a great video! in my lectures we discussed situations were national laws effected ways products could be used in a MS. In the case of Åklagaren a rule stated that jet skis could only be used on navigable waterway or waters in respect of which the local authority has issued rules permitting their use. is such a case a quantitative restriction? how would i go about answering a problem question with this sort of issue x

    The rule of reason is considered as a mandatory requirement under derogations. But if cassis created mutual recognition as rule #2, its not a derogation correct?

    Hi Marcus, Just started some revision of European Law and trying to get some to stick, so no better a place than with your lectures. I find they are a much more sympathetic approach to learning than sticking your nose in a 3lb book. I have found that good law books are generally judged by weight!! Thanks again.     Hi Marcus, I have followed your episodes very carefully, unfortunately, I have not enjoyed the knowledge associated with them as I have moved on to different modules. They have become slicker and still have the nice informality which I always found an easy way to take in learning. My next two modules, after these my last module, are Company Law and Employee Law, I don't know if anything is coming my way!!! Regards and thanks for everything.

    Hi Marcus. In writing an essay on the variations of the Courts use of the proportionality test in view of breaches to art. 34. I haven't mentioned anything on Keck but now wondering whether it is worth referring to, ie in view of it being an extension of the prop. test? Or does that not make sense?

      I think that would make a lot of sense. Dassonville was so wide it made the whole concept of proportionality pointless. Keck is another way of applying proportionality especially if you examine the facts of the case. Interestingly behind the scenes there was some political pressure to apply proportionality too!

    Is a requirement of inspection on foreign goods with foreign importers having to pay for that inspection but nothin required of domestic goods dealt with under article 34?

    Hi, can you please help me with this - In France, national law requires that beer can only be sold with Trappist label if it is produced in monasteries (which is the case here) and has an alcohol percentage of at least 13% (but in Belgium beer it is 10% or more). France has one monastery producing beer, and the beer has an alcohol percentage of 13%.

      +mhw.konings I know what you mean it is really quite vague. I always think about it as anything to do with the way in which products are sold, e.g. advertisements etc.

      I just found an example that someone used. They said that "no advertising beer" would constitute a CSA, because it would affect both domestic beers and imported ones. It can not be an MEQR either, because imported beers may still be sold without having to make any changes to the product itself, but they could be put at a disadvantage because domestic beers are already known and not being able to advertise their own beers would make it harder to penetrate the market. Does that sound right?

      Anything where its not direct quota or ban is indistinctly--only allowed when genuine reason
