During the drug and alcohol evaluation where they ask you about your lifestyle, wouldn’t this be in conflict with your fifth amendment right not to be forced to incriminate yourself?

So I’m in Everett and when I got my dui I blew a 0.89 and they didn’t do the breath test until I got to the hospital I sat in a holding cell for hours than they put me in the jail and took my blood and breath test me but they didn’t do any of that on scene

I think you mean 0.089... anything over 0.4 is potentially fatal lol

We lived in WA for 26 years. Because I rarely drank alcohol I was never stopped by the police.
However I have my doubts that I would pass a field sobriety test, probably now because of my advanced age. It would be weird. I would probably flunk one or more field tests, but score zero on a blood or breath alcohol test, because I did not drink any.
I’m wondering if I would STILL get cited for failing the field tests? Would the officer say “I’m too old to drive because I failed a stand on one leg test.”
Even though my system was devoid of alcohol, pot or any other substance.
    Just curious.
Where I live now I am not permitted to refuse a field test. I NEVER drink even a drop when I drive. So I would always score negative. But I had a cataract surgery on one eye. I might have some nystagmus. I would probably also flunk that test.
I’m just wondering how SERIOUSLY they take those field tests?
