This pivotal discussion stems from concerns raised by various High Courts regarding the lack of practical courtroom exposure among newly appointed judges.
The case, titled All India Judges Association & Ors. v. Union of India & Ors., marks a significant development in the Indian judicial landscape. A bench comprising Justices B.R. Gavai, A.G. Masih, and K.V. Chandran is presiding over the matter. Senior Advocate and Amicus Curiae Siddharth Bhatnagar presented compelling arguments supporting the reintroduction of the three-year practice rule.
Background
The debate on practical legal experience dates back to earlier rulings. In the All India Judges Association (1993) case, the Supreme Court emphasized that practical exposure is essential for judicial officers to grasp the nuances of the court system. The Constitution of India itself mandates legal practice as a prerequisite for higher judicial appointments under Articles 233(2), 217(2)(b), and 124(3)(b). However, in 2002, the Supreme Court, based on recommendations from the Justice K.J. Shetty Commission, removed the three-year practice requirement, replacing it with one to two years of training for new recruits.

Practical Exposure: Judicial officers need hands-on experience in court proceedings, which cannot be acquired solely through books or pre-service training.

Current Supreme Court Observations
Justice Gavai remarked that judicial service conditions have significantly improved, making the profession more attractive to lawyers with three years of practice. The amicus curiae highlighted differing opinions among High Courts:
Support for Practice Requirement: Punjab & Haryana and Uttarakhand High Courts favor the rule, with suggestions to count provisional Bar registration towards the practice period.
Alternative Views: Andhra Pradesh and Assam High Courts advocate for a reduced two-year practice requirement.
Opposition to Restoration: Sikkim and Chhattisgarh High Courts oppose reinstating the rule.
Despite varied views, most High Courts acknowledge that fresh law graduates lack sufficient practical experience, leading to inefficiencies.

One significant challenge is verifying whether candidates genuinely engage in substantive courtroom work. Examples were cited where candidates registered as advocates but lacked actual practice experience. Proposed solutions include:
Comprehensive Training Programs:
Two years of practical training.

Certification by presiding judges to confirm candidates’ substantive courtroom engagement.
Monitoring to prevent misuse of the practice period.

Law ka course already bahut lengthy hota h and alag se usme practice demand krna ye thoda jda ho jyega wo v 3 saal k liye tb tk toh candidates ka age 27-28 ho jyega..... hrr state ka toh regular vacancies v nhi aate h.....female candidates bahut kaam apply krege....its better ki law course me hi practice daal diya jye wo v bahut strictly way me just like medical field.. new and strict regulation lana chahiye law college q ki wo already 5 ya 3 saal ka hota h jo ki bahut important time phase hota h students k liye

I really think nhi hoga enforcement... Even SC isn't in it's favor I have heard all hearings. Unke question and all dekh ke bilkul nhi lagta it will...
