Few Points against the implementation of 3 year practice requirement: 1. A lot of young law graduates are first generation lawyers and have neither the time nor the resources to enter into litigation. 2. Every year lakhs of students graduate with law degree and mostly three main career options are available for them to pursue: litigation, corporate and judiciary. Out of these, judiciary is believed to be the most secure job which not only ensures employment but also stability in one's life. Therefore, most students opt judiciary as their first and foremost option. Adding 3 year practice would surely add to the problem of unemployment that India is already grappling with. 3. 3 year practice is not going to ensure the efficiency of the judge. For that the training period of the judge shoulf be made more effective. 4. It is ridiculous to believe that a student who wants to establish his career in judiciary would be honest with his practice. Of course he would be busy preparing for his dream job. 5. All the apparent flaws in the lower judiciary is not only because of the alleged incompetent judges but also because of those lawyers who want to drag a case for years so as to ensure continuous flow of money. Besides, It's absurd to believe that an advocate has more knowledge. Such advocates are only handful. Suggestions: 1. Improve lower judiciary by giving it due recognition as ex CJI Chandrachud said, "Lower judiciary must not be looked down upon as subordinate" 2. Enhance the training period of the judges. Ensure no favouritism or nepotism comes into the picture. Of course you cannot expect a newly graduated person to start writing perfect judgments in a month or two. Everything comes with time and experience. Add a provision that a newly appointed judge will sit only with senior judges for first 3 initial years of his career. 2. Strict action should be taken against lawyers with fake degrees and against colleges who without recognition of the BCI is doing the job of a factory producing black coats with no knowledge of law, not even the ABC of law. Siddharth bhatnagar himself either don't know about the situation of First gen Lawyers or so dumb to understand their situation because if this 3 year rules will get implemented then it will be biased and injustice for first generation lawyers to whom most advocates think as their file holder. In Higher judiciary judgeship evolving around some strong judge's families and now these advocates wants to hold lower judiciary to evolve around some established advocate's families. If we Indians are silent it doesn't mean we aren't seeing what's going on in our judicial system, the matter is we want to maintain respect, sanctity and dignity of our Judicial system but it's not the duty of ours only but also of all Judges and established advocates too.
Internship in courts are necessary for those who want to become judge. Practice of one year is enough to get the idea how practical procedure are done.
Judiciary aspirants is way more talented thn a new advocate or advocates with 5 years of experience, it will give powers to senior advocates to exploit young Advocates...and if three years practice will mandate then students will not come to judiciary as after 7 nd 10 years that will any way become the judge and Advocate are earning good so no one want to be judged after 3 years of practice. As sir in video said their is a chance for removing this criteria, will be a good step as judiciary is not easy as vacancy is less nd competition is huge.
