Murder only applies if there is intent and premeditation. They wanted to arrest a mystery burgular, but the reasonable doubt is there. Negligent homicide will be easier to prove.
They had intention they took the gun with them to shoot. They had intent as seen by them following him while he was running. There’s possibly no premeditation.

Then you ask if it could be lowered to manslaughter via EED/Provocation. I don't think there are any good such defenses here. Then you ask if there are any affirmative defenses like self defense, etc. I don't think there are any good affirmative defenses.
2nd degree murder is 10-30 years. Usually, if the guidelines are 10-30 years I'd expect something like 12-18 years. Judges typically sentence on the lower end. However, I wouldn't be opposed to them throwing the book at them for a 30 year sentence. We need to send a message, as the criminal justice/legal system in america that vigilante justice will not be tolerated. If you think you see a suspect, you call police and give a location and that is the end of your involvement. You should never engage a suspect unless they pose a significant threat to you or a member of the public (like someone in the act of a shooting spree, or is in the process of beating someone up, not just someone you suspect could be dangerous). "Citizens arrest" is a fictional creation that should die a hard death in jail with these two idiots.

I take it you are referring to the Guyger case...actually Lee did not advise the family to forgive. The mom and sister were not aware his little brother was going to do that. Mrs. Jean and others were caught off guard. They have spoken openly about it, and his mom said she could never forgive.

We just need a good team around us. The team can be family or friends. Most of these killings of unarmed black people happen when they are alone or in environments without people they know.

Here are some questions that I would like answered to shed light on this incident.
1. Does the person in the surveillance footage of the burglary match Arbery?
2. Did the clothes the suspect was wearing in the servillance video matched what Arbery had on whilst jogging?
3. Did Gregory and Travis McMichael and also the person who recorded the shooting see this video to be able to identify Arbery on the street.
4. If they did not see the servillance footage of the burglary who relayed this information to them describing Arbery?
5. What hours did Arbery normally go jogging and what route did he usually take?
6. Does he normally wear a 3/4 pair of shorts off his waist whilst jogging?
7. If Arbery was jogging and unaware of being a suspect in a burglary why did he not stop jogging and enquire the reason he is being accosted?
8. Arbery was not cornered. He had open space to the right of the vehicle to flee. Why did he instead run around to the front of the parked vehicle and attack Travis?
9. If Arbery was being chased by the person who recorded the incident what did that person do or say to additionally make him feel threatned to react the way he did?
These are but a few unanswered questions and yes the McMichaels have attempted to changed the narrative thus loosing credibility. Arbery actions at the scene to me shows it was a result of provocation.

On closer examination of the video it clearly shows Travis is to the left almost on the soft shoulder of the road. Arbery runs to the extreme right of the parked vehicle in an attempt to get around it and thereby avoiding Travis. Someone shouts. Arbery reaches the front of the vehicle. Travis moves towards the front of the vehicle in Arbery's direction. The first shot is fired. Arbery then engages Travis and at that point a scuffle ensues in front of the vehicle. The rest is plain to see.

@@fknstr Travis was either in the vehicle or standing next to the open door of the vehicle. Arbery was running in the left lane close to the centre line. He first, for a split second, attempted to go pass on the left. Travis then stepped further to the left away from the vehicle to counter this move by Arbery. Arbery immediately changed direction to pass the vehicle on the right. Travis now moved from the middle of the left lane around to the front of the vehicle to confront Arbery as he came around the right of the vehicle. At this point the first shot was fired. You can observe the shadow of both men looking under the vehicle. We don't know what the intensions, in this split second, of both the men were. We don't know if this was a warning shot in the air. We don't know if it was aimed at Arbery. We don't know if Arbery went for the gun before it was fired. We don't know if Arbery went for the gun after it was fired. We can only speculate as the vehicle is now blocking the view of both men. What we do know is if two people going at each other one with a gun and the other without it is more probable the latter would be in defence mode. Using this reasoning then it is more likely Arbery was murdered attempting to defend himself.
If what is on the road was a hammer from the construction site and Arbery's finger prints are on it then yes he dropped it there. It also places him at the construction site but that is a different crime scene which involved burglary and not the one before us in this video. The citizens arrest should have been conducted there. Only officers of the appropriate legal authorities, using firearms, can lawfully pursue a crime suspect. Gregory McMichael was fully aware of this thus the reason for him placing a call to 911 to get officers onto the scene. Arbery tossing the hammer higlights to very important aspects of his state of mind:-
1. The obvious is he wanted to get rid of evidence and not be held for larceny, and
2. This was flight and not fight.
In running to the McMichaels he must have noticed they were carrying guns. If his intentions was to fight and being without a firearm he would have held on to the hammer in an attempt to even the odds. His state of mind is clear by his actions up to that point "I have to dodge them and get past them and I'm free". His conviction was resolute as well as absolute so mush so that even after the fatal shot he continued to run in the direction he intended to. He did not fall at the feet of Travis, his killer.
