Editorial With Sujit Nair | Supreme Court On Chandigarh Mayor Polls, “This is murder of democracy”

- In this editorial segment, Mr. Sujit Nair discusses Chief Justice of India DY Chandrachud's comments on the Chandigarh Mayor Polls. The Supreme Court expressed concern over the conduct of the Presiding Officer during the elections, stating that it was evident that the ballot papers were defaced. CJI Chandrachud strongly criticized the behavior, calling it a mockery and murder of democracy, and suggested that the individual responsible should face prosecution.
The Chief Justice, along with Justices JB Pardiwala and Manoj Misra, heard a petition filed by AAP Councillor Kuldeep Kumar, the defeated Mayor candidate, challenging the Punjab and Haryana High Court's decision not to stay the immediate election. The Supreme Court issued a notice on Kumar's petition and deferred the Chandigarh Municipal Corporation meeting scheduled for February 7.
The Court ordered the sequestration of the entire record of the Mayor election, directing it to be kept with the Punjab & Haryana High Court Registrar General. It also mandated the preservation of ballots and videography. The Deputy Commissioner of Chandigarh was instructed to hand over the records to the HC Registrar General by 5 PM on the same day.
Senior Advocate Dr. Abhishek Manu Singhvi, representing the petitioner, alleged that a BJP candidate, serving as the Presiding Officer, intentionally defaced eight ballot papers of Congress-AAP councillors, rendering their votes invalid. Solicitor General of India Tushar Mehta argued that the video presented a one-sided view and urged the Court to consider the entire records before making a comprehensive decision.
Expressing dissatisfaction with the High Court's approach, CJI Chandrachud criticized the failure to issue an appropriate interim order.

If this is the case, there are reasons for doubting EVMs . For general election EVMs should be avoided and ballot papers should be used.

This goon has crossed all levels of dignity. For the BJP it is not the first time nor will it be the last time. In fact this will continue more vigorously. Now The supreme court has come down so heavily on this issue. But in the end whats the use ? In what way will this Presiding Officer be punished and what will be his response ? I just wonder what must be running in the mind of this Officer ? He must be imagining that he will be now be rewarded with a Governors post or what ??? What a tragedy for this Indian democracy. The present CJI is a great disappointment for the top judiciary. Apart from these very few cases he majorly favors the ruling party and under the pressure of the executive power. I thought he would be a great CJI, but turns out to be a pretty ordinary usual judge. He allots majority cases related to the ruling power to those judges who were already worked under Modi's government in Gujarat (as law secretory). Manish sisodia is just a accused, yet not proved but he denied bail for him but the convicted rapist Baba Ram Raheem is getting bail for months!!! what kind of stupid judiciary we have in this country? are we running kangaroo courts?

A very valid point about the current CJI's flip-flop on observations vs justice which has become the standard norm.
Verdicts in Pegasus - where the CJI feigned in helplessness about non-cooperation by Govt , - Article 370, PMLA, appointment of election commissioner, arbitrary extension of tenure of the director of ED, reservations for EBs. Hindenberg etc., the Court always favoured only the Executive proferring strange logic and bizarre arguments.
The CJI has also put on hold indefinitely judgement in the electoral bond sale and reasons are not far to seek.

Why the election of Mayor of Chandigarh IS NOT YET SET ASIDE . After commenting that the presiding officer committed murder of democracy , who else can restore democracy exept the Supreme Court . And that should be done without any delay . Are all the records been submitted to the Registrar of the High Court as ordered by the Supreme Court . Considering the the horrible harm , any further action taken .
