#railway policy of Leave encashment policy RBE161/2008 RBE104/2009 RBE- No linkage of leave.#RBE67/2011Non-practicing Allowance (NPA) shall be taken into account for calculating encashment of LAP while availing Privilege Pass/PTO
#Encashment of Leave on Average Pay along with Railway Pass while in service: #A Railway Servant shall be permitted to encash leave on average pay upto 10 days at the time of availing of Railway passes while in service, subject to the conditions that i) leave on average pay of at least an equivalent duration is also availed of simultaneously; ii) a balance of at least 30 days of #LAP should be available to his credit after taking into account the period of encashment as well as leave availed of; iii) the total leave so encashed during the entire career shall not exceed 60 days in the aggregate subject to the condition that successive encashment cannot be made before a minimum period of two years has elapsed; iv) cash equivalent shall be calculated as Pay+GP+DA x Max 10 days/30 and no HRA or Transport.

In terms of this office letter of even number dated 08.10.2008, both LAP and LHAP are to be considered for encashment at the time of retirement, subject to the overall limit of 300 days. These instructions are not applicable in the case of permanent absorption of railway employees in PSUs/Autonomous Bodies. In other words, the existing provision of forfeiture of LHAP standing at the credit of such Railway servants on absorption in PSUs/Autonomous bodies shall continue to be in force-RBE 130/2009
#RBE 204/2009The benefit of encashment of leave for both earned leave and half pay leave subject to overall limit of 300 days shall be effective from 01.01.2006 instead of 01.09.2008. The benefit will be admissible in respect of past cases on receipt of applications to that effect from the pensioners concerned by the Administrative Ministry concerned. ii) In respect of retirees who have already received encashment of earned leave of maximum limit of 300 days together with encashment of HPL standing at their credit on the date of retirement, such cases need not be reopened. However, such cases in which there was a shortfall in reaching the maximum limit of 300 days can be reopened. iii) Calculation of cash equivalent in respect of HPL at credit shall be made mutatis mutandis in the manner given in this Dept OM of even no. dated 25.09.2008.

Sir, agar employee ne leave encashment 9th December 2022 ko diya hai aur uske account me 300+10 LAP hai aur sanction 20 January 2023 ko hota hai ab uske account me 300+15 LAP hai to uska leave debit kab karenge please bataiye.

yes taking leave is compulsory. you can take LAP or CL anything

@@devirps Respected Sir, a letter has already sent to competent authority along with all requisite documents on 13.06.2023, competent authority referred to RBE ESTT No. 21/2017 and said the Complainant not eligible for leave encashment. I had given my resignation due to family reason not a technical resignations. Plz guided me, What I do.

@@devirps Hello sir , I am a railway employee in MB division and have applied for spouse ground transfer to Lko Nr . My division has granted Noc 1 month before but Lko is not accepting it. Official of Lko division is saying that since in my cadre direct recruitment have stopped in 2020 so vacancy can be filled only through promotion and LDCE quota. Sir I have a child and I have no leaves left in my account . My last option is to quit my job if not transferred at my husband's place. Kindly tell me what to do next.

Sir, in mutual transfer order issued by personel branch.one person relieved and joined. another person resign his job before relieving, this reason personnel branch what do next step? Can personnel branch cancel mutual transfer order? What is the rule. (It is inter department mutual transfer in same division both empolyees are level▪︎1)

Sir, May I encash my leave for 05 days or lesser days. Our establishment section does't allow it. If it possible to encash lesser than 10 days kindly quote the Railway Board Order No. it should be helpful for us.

@@devirps 🙏🏻 sir. why to take pass/pto and for what is that 1 day leave for. If i have 100 lap in ac can i avail encashment. National holiday, Rh, casual holiday wala point clear nai hua, 11days toh lap ac se deduct hone. 10days duration (from & to) date to be counted excluding holidays?
