What is the definition of salary here? Basic salary + DA or Monthly Gross salary including all allowances
The tax exemption on leave encashment of non-government salaried employees (in respect of the period of earned leave at his credit at the time of his retirement, whether on superannuation or otherwise) was earlier upto a limit of Rs.3 lakh only under section 10(10AA)(ii) of the Income-tax Act,1961(the Act).
In pursuance to the proposal in the Budget Speech, 2023, by the hon’ble FM, the Central Government has notified the increased limit for tax exemption on leave encashment on retirement or otherwise of non-government salaried employees to Rs. 25 lakh w.e.f. 01.04.2023.

Those who retired on 2022 2023 financial year. Do they will get 25 lac leave encashment limit.
Or only who retired after 1st April 2023 only they are egligible.
They will file return for assessment year 2024 2025.

Leave Encashment Received During Service: When an employee receives leave encashment while still employed, the entire amount is considered taxable and forms part of their 'Income from Salary.' However, employees can claim tax benefits under Section 89 of the Income Tax Act. To avail of this relief, they need to fill out Form 10E and submit it online through the income tax portal. How it is covered in section 89?
