    what is the difference between the execution of sale deed and registration of sale deed ? Because in my case the buyer is saying lets do the registration and later on his bank will issue him home loan and after registration within 1 month he will complete the payment

    Suppose, the date In the sale deed is Nov, numerically mentioned as Nov only but albhebetically mentioned as october. Is that any problem??? How we can rectify this problem.??

    Registration of sale deed is not compulsory. There are court judgements.

If i bought property by housing loan and after this i applied for permanent disconnection of electricity for the same premises than i got to know that electricity bill of big amount is due on the same, because of this i could not able to apply for new electricity connection. In this moment am i able to be compensated by the seller for this . please help me.

My query is that I have a joint residential house with my wife- now estranged and we have decided that she will relinquish her joint ownership rights in my favour subsequent to a family Settlement Deed signed by us in a civil court. Can I go for a relinquishment/ Release deed? or a Gift deed is better. I am paying her a consideration amount which includes Alimony/ this transfer of her share in house and every other issue.Will she have to pay Long term capital gains? Thanks

    I have allotment letter and book against a plot transferred to me from my father. I want to sale the same. As per practice invogue in selling of plots in this town, the buyer is requiring to handover him either original allotment letter or original book of plot on payment of Beyana / Advance by him to me and the same will be written in the Sale Deed. Otherwise no one is buying. What I should do ?

    Yet I have a question. I purchased a new flat in a newly constructed building in Mumbai last year. On sale of all the flats the builder completed the formation of co-operative housing society. Now we have insisted to get the Conveyance deed done on society name. However the builder has give a Draft Sales Deed of the property for us to review where seller is the builder and buyer is the society. Is it a right procedure???

    real estate brokers ask for document charges which are approx 12k to 20k. how to check whether the broker has done his duty for which he has chrged the doc chrges?

      You can ask for a copy of all documents. Owner will not mind giving you a copy. A genuine Real Estate broker should also not mind.

      They must be having some proof of sale. If they don't have any proof, then nothing much can be done.

    Hello, My builder is asking less price of flat in sale deed (17 lacks) while the registration amount is 30 lacks. He is saying this for less tax on sales deed. Is this legal? should I pay tax tax for 17 lacks or 30 lacks. Please replay asap. thanks.

    Hi Sir, I recently bought a flat in pune, they have taken stamp duty and registration when giving "agreement to sale" to me.They told that this agreement to sell will be registered in sub-registrar office and an index-2 from will be generated after franking is done. Also they told that the sale deed will be done once at time of possession AND THAT I DONT NEED TO PAY STAMP DUTY AND REGISTRATION AGAIN at sale deed time. I saw your this videos and am confused now. you dont talk about index-2 i.e registration of agreement to sale. please help!!

    is conveyance deed issued only at the first phase? what iam trying to say is, there is 3 parties A B C. i am the C party. i bought the property of B a couple of years back and when i checked my documents for a conveyence deed i found a conveyence deed signed only between A and B. is that normal or a conveyence deed is also issued for the transction between B AND C?

    Sir ji Sale deed copy & registration copy are two different documents? Mean in sale deed copy only registrar will stamp & sign then will take one of original copy for record or we have to make different registration copy to do the registry of the property?
    2) And if it is a different documents then do we need to ask from the seller to give us both the copies or final agreement copy is enough?
    3) And if it is a different document then sale deed document will be a stamp document signed by owner & seller without any stamp & signed by government authorities?
    4) Its compulsion for seller to handover the old original agreement copy once new sale deed will be signed from both the parties?

      Hi Mushahid
      Sale Deed and Registry copy are one and the same thing. Once your sale deed is registered, you have to collect all original documents from the seller. Seller can have copies for his reference.

      That's a good question. Date of Possession can definitely happen before Sale Deed in many cases for eg. in some cases people occupy property just on GPA (General Power of Attorney) and can get Sale Deed executed later or in some cases possession can be handed over on the basis of Agreement to Sell and before executing Sale Deed.

      Thanx for the prompt reply. Actually I have sold my residential property in Mumbai. I had received half amount of consideration before 25th of this month. On 25th, I had vacated the flat so that buyer can do necessary changes. Remaining half payment is recd now. We havent executed any agreement for sale. We are directly going to register sale deed on 3rd of Oct. The buyer in his draft agreement has mentioned date of possession as 25th. Do you forsee any problem with date of possession as 25th

    what are the charges to be paid by the seller of a flat when selling a flat?

      Seller generally doesn't pay any transaction fee, unless it is negotiated before hand & written in Agreement to Sell. Buyer pays for Stamp Duty & Registration charges. Seller only has to clear all Bills and Dues before offering possession. Also, seller may have to pay the broker, if he has engaged any. Hope it helps.

      No, generally buyer pays for stamp duty and registration charges. However, if you have already signed the agreement to sell and agreed to the terms, you can't back off. Hope it helps.

      Don't understand that. I have also​ sold property in delhi. Why would TDS be deducted and who will deduct? TDS is deducted when you offer some services to an individual or to a company. Please ask your broker to explain. Perhaps I missed something.

    Hello sirji,
    I sold my flat for 16 lacs
    I got token mony 7 lac rest payment they will give after sale deed registration.
    Can i take a security cheque for balance payment and add a clause in deed by saying if the balance payment is not received within 1 month, registration will get cancelled.
    Pls let me know if the above is correct

    Mukal Sir I already paid to builder my flat amount around 96% and he makes SATHE KHAT I didn’t have any ideas about those documents this sathe khat I prepared at November 2017 , he gave me possession in 2019 without completion of sale deed, I just go to my area Gram Panchayat office to pay my home tax then he told me your builder not yet submitted completion letter N wat u bring the documents “sathe khat”which is not legally applicable to make Ghar Patti Yearly Home Tax i ask builder Y u did this thing and y u didn’t share any information with me, my self i ask builder many times in 2018/19 give my payment break up N clear all things now he is asking me u have samll amount that u pay me than we will make U r sale deed I want to know to make sale deed full payment need to done or we can pay after he make sales deed please please please advise me sir
