U are discussing how whole village can be property of Waqf??? Just ask those villagers to show the papers of their property they won't be able to.. Because the don't have it or have fake ones. And i can tell u because I myself is fighting a legal case from last 7 years for my land which was in very remote area and now it has more than 93 houses illegally built and land was sold to them by land mafyas. You Must Note That Waqf properties are private properties (before being Waqf), legally acquired and then dedicated as Waqf by the Waqif (the legal owner) for the cause of Allah. For sacredness, religious significance, and charitable application of these properties as specified in shariya. My Own Grandfather in 2021... Gave 2 acres of land in Waqf. It was in his will. How come some random acquire it???

3. वक्फ अधिनियम में कठोर प्रावधान है, जिसमें वक्फ बोर्ड जमीन रखने वाले/निवासी व्यक्ति को बिना किसी सूचना के किसी भी संपत्ति पर कब्जा कर सकता है, जो कि तिरुचेंदुरई में हुआ है। पीड़ित व्यक्ति के लिए एकमात्र सहारा वक्फ ट्रिब्यूनल का दरवाजा खटखटाना है।
4. वक्फ न्यायाधिकरण, अधिनियम की धारा 83 के अनुसार, शरिया कानून द्वारा शासित है। किसी गैर-मुस्लिम को मुक्ति पाने के लिए इस्लामी कानून द्वारा शासित न्यायाधिकरण के पास जाने के लिए कैसे मजबूर किया जा सकता है?
5. धारा 85, और भी बदतर है. ऐसे विवादों पर सिविल न्यायालयों का कोई अधिकार क्षेत्र नहीं है! यह ध्यान रखना उचित है कि किसी अन्य अल्पसंख्यक (सिख, जैन, पारसी..) को ऐसी पूर्ण शक्तियाँ नहीं दी गई हैं!
6. वक्फ अधिनियम सीमाओं के क़ानून के अधीन नहीं है, जो 1963 के सीमा अधिनियम का उल्लंघन करता है। इसलिए एक दिन, कोई भी वक्फ बोर्ड किसी भी संपत्ति पर दावा कर सकता है।
7. यह हमें हमारे अंतिम बिंदु पर लाता है। यह अधिनियम वक्फ बोर्ड को किसी भी संपत्ति पर दावा करने की पूर्ण शक्ति प्रदान करता है। यही कारण है कि आज, पूरे देश में वक्फ संपत्तियों का क्षेत्रफल लगभग 6 लाख एकड़ होने का अनुमान है; और तीसरा सबसे बड़ा ज़मीन मालिक! यह और कुछ नहीं बल्कि देश के संसाधनों का गुप्त कब्ज़ा है, जो दुर्भाग्य से हमारे अपने कानूनों द्वारा संरक्षित है!
माननीय प्रधानमंत्री श्री नरेंद्र मोदी जी ने हाल ही में कहा कि हमें औपनिवेशिक मानसिकता से छुटकारा पाना होगा। यह औपनिवेशिक मानसिकता केवल अंग्रेजों तक ही सीमित नहीं है। जब तक यह मुगलकालीन अधिनियम अस्तित्व में रहेगा, हम औपनिवेशिक मानसिकता से छुटकारा नहीं पा सकेंगे। यह बात निम्नलिखित दो उदाहरणों से स्पष्ट है -

And i can tell u because I myself is fighting a legal case from last 7 years for my land which was in very remote area and now it has more than 93 houses illegally built and land was sold to them by land mafyas.

You Must Note That Waqf properties are private properties (before being Waqf), legally acquired and then dedicated as Waqf by the Waqif (the legal owner) for the cause of Allah. For sacredness, religious significance, and charitable application of these properties as specified in shariya.
My Own Grandfather in 2021... Gave 2 acres of land in Waqf. It was in his will.
