      I believe the could've arrested him if he had an arrest warrant. a bench warrant is different in that they can't go looking for you or stop you without probable cause. they probably didn't like him and wanted to pick him up so he would have to spend time in a cell till they could schedule a new court date. I'm guessing it was a Friday so he would have to wait till Monday. they have all kinds of b.s. tricks they use. that why my answer is I don't answer questions. they aren't your friends and their only goal is to fish and arrest someone. your not obligated to help them with anything, especially since anything you say can and will be held against you in a court of law.

    If the cops really had a warrant, they would have kicked the door in and arrested him. The fact that they didn't leads me to believe there wasn't a warrant. Speaking from experience.

      It's just a basic bench warrant, has to be a felony warrant for them to start kicking in doors, if you got a failure to appear on a misdemeanor they would probably let you slide and pick you up later

      If I have a warrant for you, even if it's a misdemeanor, I'm going to give you once chance to come out, then I'm kicking in your door and coming in with my gun drawn. You had your chance, now you sit in jail until the judge wants to see you. Either things are different in that state or they didn't have a warrant. All I need is a warrant from a judge, no matter if anyone has been notified, and I can seize (arrest) you. These cops were being really nice, trying to help this guy out, but he's a knucklehead.

      Police aren't required to carry paper copies of arrest warrants. Do you expect an officer that randomly encounters a wanted person to have a physical copy of that particular wanted person's warrant?

      It is a Bench Warrant, or Attachment, not a Arrest Warrant for a criminal offense. They cannot enter the home to remove him. They are not supposed to be actively seeking to enforce the Attachment. The man can just the same contact the Judge and explain himself, the misunderstanding, ect and the Judge can recall the attachment. That is all it is, the Judge wants to know why he didn't appear. Law Enforcement, are supposed to bring him in, IF they have contact with him. NOT tracking him down like a criminal.

      @Areu Kiddingme lmfao, how about learning the difference between an arrest warrant and a warrant that lets police enter your home.
      Those are very separate warrants. One grants them lawful entry into your home the other grants them arresting powers if you cross their paths. They can't just show up at your home with a supposed arrest warrant and take you into custody.
      That would violate the castle doctrine. I would suggest you learn your rights before telling people about theirs.
      Unless you yourself are in law enforcement and in that case.

      They might. Police generally don't want to force their way in unless they have to. But after five minutes or so, they'd stop talking and just kick the door in. The fact that they never just came in and arrested him, even AFTER several minutes of discussion, shows what they have was a summons, not a warrant.

    Anyone that’s ever dealt with the court system knows full well, the judge isn’t sitting there waiting on someone with a warrant to get brought in, especially if the warrant is several weeks or months old. Typical lying cops.

      You have never delt with the NYS court system and bail reform laws. These are catch and release warrants. The judge couldn't put the guy in jail even if they wanted to. The judge doesn't want to get woke up in the middle of the night just to waive there finger at someone and asking them to pretty please come to court on the next date.

Well why didn't you just bring the warrant in the 1st place. No one with an FTA just walks in sees the judge n walks out AND gets a ride home from the same cop that brought u in!       Not just a warrant in hand.... but I saw a video where police claimed they had a warrant to arrest some migrant guy, but the guy driving the car was a lawyer and asked if it was signed by a judge. The cop said it wasn't. The lawyer replied that it's not a legal warrant if the judge didn't sign it.

      You guys don't understand NYS's new bail reform laws. These are catch and release warrants. The judge can't put the guy in jail even if they want to. Besides force used in an arrest must be reasonable and necessary. Smashing down a door for a catch and release bench warrant is certainly unreasonable.

      Yes and no, usually YES you are right. Bench Warrants though are generally being handed out like candy from judges anymore and they tell Sheriffs NOT to use force because legally they can only hand them out when people sign acknowledgement of a court date and time. Since they can't get that most of the time (people ignoring mail or knocks on door), they will issue them anyways and Sheriffs will "GET YOU TO COMPLY" usually like this Sheriff was trying to do.
      If this guy stepped outside the house, they would have NOT have let him back inside and would have told him he had no choice but to go. His COMPLIANCE would have been giving up at that point and they would have blocked him from getting back into the house as they had 2 back up officers ready to go. They would have surrounded him and then if he would have tried to push past them, assault on an officer for touching that officer! This would have been a stand off until he backed down.
      These are the tactics they use when the courts want their child support money and they don't have the legal power to force you into their court room.

      It all depends on what the warrant is for. A traffic warrant where you forgot a court date for a speeding offense, they probably won't kick the door.
      A bench warrant for a failure to appear for a felony DUI, they'll kick the door.
      An arrest warrant for a misdemeanor shoplifting offense. Might not kick the door.
      A warrant for Home Invasion and Sexual Assault case...yeah that door is getting kicked.

      They can't enter a home with just an arrest warrant. To enter the home they need a search warrant specifying who or what is to be seized UNLESS they are in "hot pursuit" of a suspect.

So basically, if you know you didn't sign any paperwork, then there is either no Bench Warrant or the Bench Warrant is not legal and either way you are in the right.

      In order for a warrant to be lawful, it must be SIGNED BY A JUDGE and TIMELY FILED. If those two things don't exist, the warrant doesn't exist, no matter what they say. It may be "in their system", but if they can't CERTIFY a properly written warrant, IT WAS NEVER ISSUED.

      Works that way for search warrants, doesn't work that way for arrest warrants. They do not need a physical copy of the arrest warrant in their hands. It can be communicated via computer or over the radio...as long as the proper confirmation process has been followed.

    I went to court for slapping someone for harrassing my wife at the time . My court date was at 10am and at the court they kept on pushing my case back and back .     My wife had a very similar experience with the way that the American justice system operates, she had a traffic ticket and she was not able to make it to the court on the day that she was supposed to be there, and it wasn't because she was being anarchic or she was avoiding being held accountable, she had no way of being able to get there because of the fact that she lived very far from the county where she was given the ticket and she had no way to get there and she tried to get the court clerk to give her a new date so she could arrange transportation to get there, but they wouldn't do anything to help her and she was given warrant after warrant for not being in court on the date that she was given, and that led to her being arrested many times for the same traffic ticket and the police acted like she was on America's most wanted list and the police would come at her with their guns out and with multiple officers who were the most disrespectful and ignorant scumbags that I have ever seen especially when it was about a fucking traffic ticket!!!

      Same here.. was 15 minutes past set time for court.. denied entry and told a warrant will be issued by end of day..30 days later 6 pbso showed up guns drawn at all 3 doors at home.. said if don't open door will bust door down..went in for booking, was back home in 4 hours..in the end traffic ticket was thrown out...all about money and numbers..to stain ones record for life..

      You do know you can call ahead days later and sit to be seen by the judge right? She didn’t have to go to jail. Just show up when she could. The judge would cancel the warrant after being seen. I missed by a day one time because I completely forgot. And called and walked in. I just had to wait for my license to be suspended then immediately get it taken off once it showed up in the system.

      I had a similar experience, although not repetitious:
      I got a speeding ticket October 1986. No court date on ticket.
      I called the Muni Court for the court date.
      The lady said July 17, 1987.
      I said "JULY??"
      She said July 17th.
      I said "Sure, okay, I'll just plan my whole YEAR around it!"
      Turned out it was for JANUARY 17th (a couple months after the ticket date)
      I was at home when the cops came to haul me in on a bench warrant that had been issued for my arrest.
      So overnight in the gray-bar hotel.
      I explained to the Judge that - when I called for my court date, I was told July 17th. And repeated my quip about planning my whole year around "the event".
      He said, "in light of this gross misunderstanding, I am quashing the ticket."
      He threw it out - it was a "38 in a 35 zone" ticket - and said it was too ridiculous to expect that it would be 6 or more months according to all rules of the court at that time.
      I said "I didn't expect it would be scheduled 6+ months out, either, and that maybe the lady at the Court office was planning HER summer vacation when I called for my court date.
      He was very nice about it.
      It never showed up on my driving abstract either.

    My opinion, one of the biggest mistakes the courts ever made was ruling that police can lie. The way I understand it, they are allowed to lie when interrogating a suspect, i.e. an individual who has been arrested and is in custody.
    When it carries over into day-to-day interactions with citizens, it drives a huge wedgs between law enforcement and citizens.

    A friend of mine who had some scuffles with the law was in the county jail in New Mexico. He had an appearance date at the courthouse in the next county over while he was in the lockup. The jail he was in refused to provide transport and the court he was supposed to appear at in the next county over refused to provide transport. Mind you, he is in custody and can't just drive himself to the next county. End result? A bench warrant was issued for FTA which meant that when he was released in one county he was immediately re-arrested on the bench warrant.

      Everyone is a lawyer. Warrants DO NOT have to be served. Only summonses do. Nobody has to show anyone a warrant. It only has to legitamately exist at the time. Warrents are usually shown to people, but that is only a courtesy. It's not required to show it.

    I think I know why they wanted to take him. In my town, I once had a warrant for a city code violation. It was a mistake by the code enforcement officer. But they take you in so you have to post bail. It just so happens in my town that the bail amount is also the fine amount for the code violation. So getting your money back depends upon wether or not the magistrate convicts you of the code violation.
    They take the money from you up front. Unless you know the laws, and can prove they violated their own procedures they will take your money. That’s what this is about. $$$$$

    The county I live in operates like this. I know from personal experience. I had no clue I had been formally charged with anything, found out when 2 county cars show up at the house with a warrant. Luckily I wasn't home so I turned myself in and denied them arresting me at my house. 3 court dates and days of work missed, last time I was there they said they were looking into amending the charges. 15+ years later I have never heard anything back and they kept the bond money. FTP.

    It's simple, folks. If they have a warrant they won't chit chat or entertain any questions. They are busting down your door and dragging your ass out before you can say anything. If they are engaging in a back and forth, they do NOT have a warrant.

      It's not a search warrant. It's an arrest warrant. They can't go into someone's house unless invited. That's why you don't open the door.

    When do they knock on doors other than murder, drug dealing, rapists ect.
    This is really messed up.

      Yeah, that is because the bench warrant wasn't legal or there wasn't a real bench warrant. They used the term Bench Warrant to scare the guy into compliance because they need his compliance. The reason the bench warrant here is an issue is because legally you can't issue a bench warrant without signed acknowledgement you received the court date and time (or were physically in court when given the information verbally). Because from the guy's statements we know he didn't sign no acknowledgement of a court case, there couldn't be a legal bench warrant.
      So the tactic here was to make the guy believe there is one. They computer would make it LOOK like there is one even though there wasn't really. All warrants are on PAPER signed by a judge. They can't sign a warrant electronically unless there are some new laws that I am unaware of (googling never found any). So once they got him outside, they would have surrounded him so he couldn't get away without touching an officer even if it meant brushing up against them. Then, they would say that he assaulted an officer so they HAD to put him under arrest if he tried to get away. At this point, it is a stand off of either comply with going to the court house with us or stand here all day with the threat of a real arrest if you try to get away.
      This is how they FORCE you to comply without a legal warrant.

      That's just it. Congress never voted on QI. Judges just decided cops need it. Then the next thing you know judges have absolute immunity.

      Same game as "If you give us what we want, we can make a deal on how much time you serve, etc., etc.." No cop has the authority to make deals on sentencing. Where I live, a Crown prosecutor might be able to make a deal by dropping or amending charges, but even then, sentence or punishment is always up to a judge.

      Put a law at the federal level, a certain level of misconduct and a city or county is stripped of its ability to issue fines, hold court, or pay police. Automatically. Watch them start towing that line because the local governments are only after money, they lose the ability to monetize the local law enforcment or pay for its enforcement and it'll wither on the vine. They'll pull back on misconduct if it threatens the continued existence of their city or county job.

    Before we got to the halfway point I would have told them to leave my property, closed the door and ended the conversation. My next step would have been to call the court and clarified EXACTLY what was going on! If the officers lied I would have contacted a lawyer and started a lawsuit.

      This is what he SHOULD have done. If there as an issue, you could have handled with the courts directly by asking them when is a good time for you to come in (after the officers left and were long gone, taking a different route in then the obvious one so they can't pull you over).

      @@jasonpierce1980 It didn't do you wonders because no they cannot enter your home for a bench warrant. The only way they can enter your home is if they have an investigative warrant. A FTA warrant is minor as it gets. You should learn how to use Google so that you don't look dumb telling someone else to.

    what an eye opening video, i could never trust a cop. I remember one time chilling with my 5 year old we waved at some sherriff guys with black shades and they just mean mugged us the whole time and i thought, " dam... if my kid is searching for help i think they would be the last people he would ask"... today i cant eve trust one cop. he is 13 and i teach him to not speak to the police and ask for your parents because he is a minor.

      I don't know about elsewhere, but here in Florida most of the time if a cop is being a jerk it's a sherriff not a police officer.
      I wonder if all those old westerns have imprinted a certain mindset into the culture of sherriff departments over the years. Like the classic scene of the gunslinging law-man walking into the saloon like he owns the place and scanning everyone with suspicion. It seems like sherriffs view everyone as a potential enemy.
      Even police officers here talk about how sherriffs are too gung-ho about the job. Basically calling them paranoid and snake-like. Police will keep a cuff or 2 on their belt in case they need to make arrests, meanwhile some sherriffs walk around with up to 4 or 5 cuffs and a ton of zip-tie cuffs.
