बहुत बढ़िया, ऐसा एक कानून तो होना ही चाहिए जो सुप्रीम कोर्ट और हाई कोर्ट के जजों के खिलाफ कोई मामला बने तो उसकी जांच हो सके।
पेन्च् उच्च् न्यायलय् के जजो कि नियुक्ति मे है,इसी माम्ले मे पोलिस् जान्च् और् राजनिति आति है।सुप्रीम् कोर्त् के जज् उच्च् न्यायलय् के जज् से बनते है,उस्मे कोइ समस्या नही आती है।चेक् बलन्स् का सिधान्त् न्याय् पालिका पर् क्यो नहि लागु होता है।जज् क्यो निरन्कुश् है।
अब सरकार के पिट्ठू जो सरकार के पक्ष में फैसला देते है को जज बनाया जाता है।

अब कालेजियम सिस्टम की असलियत जनता समझ चुकीहै, इसलिए संस्था के मुखिया का दायित्व है कि कालेजियम सिस्टम को समाप्त करने हेतु राष्ट्रपति को लिखदे, अन्यथा दोनों सदनों से पारित प्रस्ताव को दृष्टिगत रखते हुए राष्ट्रपति इस सिस्टम को रद्द कर देंगे
कॉलेजियम पर चर्चा या बहस करने की आवश्यकता है क्योंकि आने वाले समय में जजों के व्यवहार, निष्पक्षता, और कानून सही परिप्रेक्ष्य में परिभाषित कर उसे लागू करने की क्षमता जज महोदय में होना अपेक्षित है । वर्तमान परिदृश्य में प्रमुख न्यायाधीश और न्यायाधीशों की पदस्थापना में भी भाई भतीजावाद होता दिखाई देता है । जिससे न्यायधीश भी किसी के दबाव में काम करने को मजबूर हो जाते हैं । न्याय व्यवस्था में में देरी यह भी न्यायालय के विशवाहर्ता पर प्रश्न चिन्ह लगाता है । जमानत में भी तुष्टीकरण की नीति अपनाई जाती है । किसान कानुन/ शाहीन बाग यहां भी न्यायालय का मूक दर्शक बने रहना भी चिंता का विषय ही है। न्यायालय यदि केन्द्र को कडा कदम उठाने के लिए भी बाध्य कर सकतीं थीं । जो नहीं किया गया है । यह कानून व्यवस्था को अस्थिरता फैलाने के लिये दोषी माना जा सकता है । सड़कों पर कानून बनाने या बदलने का प्रावधान संविधान संमत नहीं है ।

No Collegium is required. The Court should first finish off its pending cases and then if required argue with the the government. Elections are fought every five years and the Parliament has the right in this. Judges are appointed by the Supreme Court Judges and judges, according to the present method are only appointees and they should not have this power.
How can judges appoint judges , without disclosing the merits and criteria of appointment to public. It is just like a manager who is retiring from service , appoints the next manager , and the owner of the company has no right to appoint him.

दूबे साहब कालेजियम ब्यवस्था को समाप्त करने के लिए एक स्कूल ऑफ वोटर तैयार किया जाना चाहिए जिसके मेम्बर की निश्चित उम्र योग्यता और अनुभव निर्धारित की गई हो और उससे सीधा मतदान कराना चाहिए जो YES/NO मे हो । शायद यह ब्यवस्था "प्रत्यक्ष चुनाव " की श्रेणी मे आएगा ।

Appointment से ज्यादा termination कमीशन बनाया जाना जरूरी है ताकि भ्रष्ट जजों पर कार्यवाही की प्रक्रिया सरल हो, जिससे चाचा भतीजावाद स्वत: ही बन्द हो जाएगा। CJI (farewell) से अपने संगी जजों पर कुछ भी कार्यवाही नहीं होने वाला।
Appointment of clerical staff of the Courts i.e Junior Judicial Assistant, Judicial Assistant,Sr. Judicial Assistant etc. should be done through Staff Selection commission. This cadre may be merged with the ministerial staff of the respective governments. It will help them to get rid of stagnation one post. They'll also get a chance of promotion on higher posts in Govt. Departments.

मैं पहले भी आपसे प्रार्थना कर चुका हूं कि लोअर कोर्ट से लेकर सुप्रीम कोर्ट में स्टाफ की नियुक्ति भी पारदर्शी तरीके से नहीं की जाती है। ये सभी जजों के कृपा पात्र अथवा कृपा पात्रों के कृपा पात्र होते हैं। इनका वेतन भी केंद्र सरकार और राज्य सरकारों में समान पदों पर कार्यरत स्टाफ से काफी अधिक है। मेरा मत है कि कोर्ट के स्टाफ की भर्ती भी संघ लोक सेवा आयोग/राज्य सेवा आयोग/स्टाफ सेलेक्सन कमीशन आदि के माध्यम से होनी चाहिए। इनका स्थानांतरण किसी भी विभाग में किया जा सकता है ताकि इनको भी पदोन्नति मिल सके। ये सालों तक एक ही पद पर स्टैगनेंट रहते हैं।

2015 में इलाहाबाद हाईकोर्ट ने 139 ऐसे अभ्यर्थी की नियुक्ति कर दी जो मुख्य परीक्षा में जीरो और माइनस अंक पाए थे और इनको उस पद पर नियुक्ति कर दी गई जिसके काबिल थे ही नही। सारे तथ्य और प्रमाण उपलब्ध हैं। इस मामते में सुप्रीम कोर्ट ने भी हाई कोर्ट की गलत और मनमानी पर कोई कार्यवाही नहीं की और याचिका रद्द kar दी।
देसमे पहिली बार कुई सही समझदार उपराष्ट्रपति बने है अब देसमे कानून कु सही तरीका से लागू होने चाहिए कोर्ट ने जेतेने अपनी मन मानी चलाया अबतक ओ सब रुकने चाहिए
सीपीएम को भी न्याय व्यवस्था में सुधार के लिए सहयोग करने का अवसर मिला है।

It is true that Modi ji has not only reformed India but has given new heights to the country by bringing revolutionary changes. But there is still a need for a big reform and that is the reform of the judiciary. Impotent judicial system is responsible for all the problems common man has to go through at every step of life. In small cases, how do you get date after date and what problems do you have to go through, lawyers loot separately, the man gets old but the judges' decision does not come. Go to any government offices, work doesn't get done without bribe, otherwise you will be avoided by making excuses. If you file a case, the cases will go on for years and years nothing will happen. Everyone wants a bribe even MLA.
(1) Why not work on contract basis should be taken in the courts. All judges should be on contract only. Their eligibility should be continuously be tested through computer examination.wages should only be given after the announcement of correct decision.
(2) All judges should be faceless. All cases should be online and submitted randomly. So that the nexus of judges, lawyers and criminals can be broken.
(3) There should be a separate department for witnesses. Interrogation should be done by faceless judges and advocates if needed.
(4) To prove crime Use narco test, lie detector test and other scientific methods (artificial intelligence etc) and strict decisions should be given on the same day or in a few days. The old method of testimonies should be changed immediately. The witness prepared by the lawyers will never tell the truth. Lawyers cannot be competed in the art of proving truth as false and false as truth. The more they're expert in this, the greater the lawyer is considered. Anyway, who dares to testify even after seeing the crime in front, everyone loves his life. This method is totally unscientific.
(5) No lawyer heartily wants a quick decision, otherwise the pension received in the form of fees will stop.The clash of interest.
The huge fees paid to the lawyers should now be charged and deposited from criminals in the government treasury . In cases of fraud and intentional crimes, the entire property should be seized. Traitors should be hanged.
The country will also earn lakhs of crores per month. There should be a provision of quick punishment for wrong and negligently taken testimony and decision. The judge is free to do anything but for their fault no one can even speak, otherwise contempt of court. Make them faceless.Everything should be done online.and by video recording. (6)Lakhs of specialized judges can be prepared in thousands of areas like divorce, fight, land disputes, murder, bribery, fraud etc. by repeatedly taking computer tests to the students of Law and this system can be implemented in a few days only. They have to learn only few rules pertaining to that very area in which they will work . There is no dearth of talented people in India.
(7) After the decision received after years and years, the criminal goes to the next court. To curb this, if the culprit is again proved as culprit in the next court, then the punishment should be increased manifold. The game of criminals will end.They Will end the matter by compromising overnight.
(8) The role of lawyers should be minimised.
The hassle of huge salary and pension etc. to the judges is over. No hassle of providing security. The black money earned by judges and lawyers till date should be confiscated.
(9) Yes, some part of the internet spectrum will have to be given to the courts, but all the expenses can be recovered from the criminals.
(10) The public is fed up after being pushed in the courts. Judges only do the work of giving dates. Before the people are forced to take the decision of justice on the streets themselves, I request Modi ji to reform this system very soon. The last hope is only from you. History will be indebted to you.

There is no Article / Clause in the Constitution . Hon'ble Law Minister requesting Judges of the Hon'ble SC for disclosing the said Article / Clause , but the SC Judges trying to shut the mouths of everyone, who ask for it .
Now the Hon'ble SC will have to give the point wise rebuttal of the points raised by the Hon'ble Chairman of the Rajya Sabha in his Maiden Speech .

यह ठीक है कि मोदी जी ने भारत को सुधारा ही नहीं बल्कि क्रांतिकारी परिवर्तन लाकर देश को नई ऊंचाइयां दी हैं ।पर अभी भी बहुत बड़े सुधार की जरूरत है और वह है न्यायपालिका में सुधार । जीवन के हर कदम पर आम आदमी को जो परेशानीयों से गुजरना पड़ता है उसके लिए नपुंसक न्याय प्रणाली जिम्मेदार है। छोटे छोटे केसों में कैसे तारीख पर तारीख मिलती है और किन परेशानीयों से गुजरना पड़ता है वकील अलग लूटते हैं, आदमी बूढ़ा हो जाता है पर जजों का फैसला नहीं आता । किसी भी सरकारी कार्यालयों में चलें जायें बिना रिश्वत के काम नहीं होता , नहीं तो बहाने बनाकर टाल दिये जाओगे । केस करोगे तो सालों साल मुकदमे चलेंगे और कुछ नहीं होना। विधायक तक सब घूस चाहते हैं ।
(1)क्यों न कोर्टों में ठेके पर काम लिया जाय। सभी जज केवल contract पर होने चाहिए । इनकी योग्यता की परख लगातार कंम्पयूटर परीक्षा से होती रहनी चाहिए । केस हल करने की फीस, सही निर्णय होने के बाद दी जाये जो कि बहुत मुश्किल काम नहीं है अगर अपराध की सही जानकारी हो जाय । इसके लिए आधुनिक विज्ञानिक तरीकों का उपयोग करें।
(2)गवाहियों के लिए अलग विभाग हो।
(3) सभी न्यायधीश faceless हों। सभी केस आनलाइन हों तथा random submit किये जायें । ताकि जजों वकीलों अपराधीयों का गठजोड़ टूट सके ।
(4) अपराध प्रमाणित करने के लिए नारको टेस्ट ,लाई डिटेक्टर टेस्ट व दूसरे विज्ञानिक तरीकों (artificial intelligence) आदि का उपयोग करके उसी दिन या कुछ दिनों में सख्त फैसले दिए जायें । गवाहीयों का पुराना तरीका बदला जाय । वकीलों द्वारा तैयार किया गया गवाह कभी सच नहीं बतायेगा।सच को झूठ और झूठ को सच साबित करने की कला में वकीलों का मुकाबला नहीं हो सकता।जो इस में जितना ज्यादा माहिर उतना बड़ा वकील माना जाता है। वैसे भी सामने अपराध देख कर भी कौन गवाही देने की हिम्मत करता है, सबको अपनी जान प्यारी होती है।यह तरीका ही अवैज्ञानिक है।
(5)कोई वकील दिल से नहीं चाहता कि जल्दी फैसला हो, नहीं तो फीस के रूप में मिलने वाली पेंशन बंद हो जायेगी।clash of interest.
भारी भरकम वकीलों को दी जाने वाली फीस अब अपराधीयों से लेकर सरकारी खजाने में जमा की जाए । धोखाधड़ी और जानबूझ कर किये अपराधों में पूरी संपत्ति जब्त की जाए ।
लाखों करोड़ प्रति वर्ष की देश को आय भी होगी। ग़लत और लापरवाही से ली गई गवाही और फैसले के लिए भी त्वरित दंड का प्रावधान होना चाहिए ।जज कुछ भी करने के लिए स्वतंत्र है पर जिनकी मनमानी, लापरवाही व गलती के लिए कोई बोल भी नहीं सकता, नहीं तो contempt of court. इनको faceless कर दें ।सब कुछ online.और Viedeo recording से किया जाए।
(6)Law के स्टूडेंट्स को बार बार कंम्पयूटर टेस्ट ले कर अलग अलग क्षेत्रों में जैसे तलाक, लड़ाई झगड़ा , जमीनों के झगड़े, कत्ल, रिश्वत, धोखाधड़ी आदि हजारों क्षेत्रों में लाखों सपैसलाइज्ड जजों को तैयार किया जा सकता है और कुछ दिनों में इस सिस्टम को लागू किया जा सकता है । भारत में प्रतिभाशाली लोगों की कोई कमी नहीं है।
(7) सालों साल लगने के बाद अपराधी अगली कोर्ट में चला जाता है। इस पर लगाम लगाने के लिए अगर अगली कोर्ट में अपराधी सिद्ध होता है तो सजा कई गुना बढ़ा दी जाये । अपराधीयों का खेल खत्म होगा। रातों रात समझौता करके बात खत्म करेंगे।
(8)वकीलों का role कम से कम किया जाए।
जजों को भारी भरकम वेतन और पेंशन आदि का झझंट खत्म। सुरक्षा देने का कोई झझंट नहीं।आज तक जजों और वकीलों ने जो काला धन अर्जित किया है जब्त किया जाए।
(9)हां इंटरनेट स्पैक्ट्रम का कुछ हिस्सा कोर्टों को देना होगा,पर सब खर्चे अपराधियों से वसूले जा सकते हैं।
(10)कोर्टों में धक्के खा खा कर जनता परेशान हो चुकी है।जज तारीख देने का ही काम करते हैं । इससे पहले कि जनता सड़कों पर उतर कर न्याय का फैसला खुद ही करने पर मजबूर हो जाय मोदी जी से प्रार्थना है कि इस सिस्टम का सुधार अति शीघ्र कर दें । आखिरी उम्मीद सिर्फ आप से ही है । इतिहास आपका ऋणी रहेगा।

GOVERNMENT MUST MAKE IT MANDATORY FOR JUDGES OF ALL THE COURTS FROM SUPREME COURT TO SESSION COURTS OF THE COUNTRY TO DECLARE THEIR ASSETS ANNUALLY BY ALL SITTING JUDGES & CONTINUE TO DECLARE TILL FIVE YEARS AFTER THEIR RETIREMENT. SAME SHOULD ALSO BE APPLICABLE TO LAWYERS OF SUPREME & HIGH COURTS. WITHOUT THIS MUCH REQUIRED REFORMS IN JUDICIARY ARE INCOMPLETE.
A law should be make to take legal action against Political Leaders because many leaders are engage in corruption and crime.

इन सुप्रीम कोर्ट के जजों पर भी कुछ नियंत्रण होना चाहिए। ये अपनी व्हिम से फैसले देते है। जिन जजों पर करप्शन के चार्ज हो उन्हें तो सुप्रीम कोर्ट जाना चाहिए।
ये अपने को भगवान से भी बड़ा समझते है। कई बार किसी केस में अलग अलग स्टेज में हाई कोर्ट के 13 से 14 जज फैसला देते है। पर फिर भी ऐसा जज जिस पर खुद भ्रष्टाचार के चार्ज लगे हो वो सरकार का पक्ष लेने के चक्कर में अन्यायपूर्ण फैसला करता है।
