    Hi, Thanks for information video, One Query - If Total property value is 60 Lacs, and their are 2 Buyers and 2 sellers, all equal proportions. Then there will be 4 26QB form, in each payment of tax will be 15,000, which is 1% of 15 Lacs. But what will be 'Property Value in all four 26 QB forms, will it be full value 60 Lacs OR proportional value 15 Lacs.

    Informative, just 1 query, as we need to deduct the tds before registration then what agreement date is to be fed as normally agrement date and registration date is same most of the times

    Are both parties liable to deduct / pay TDS on each other name .

    Very Detailed and Informative Video , Thanks !! One question, first 10% of total consideration is paid to seller as agreement amount and then 90% will be paid by bank loan on date of registry in sub-registrar office. Now for registry in sub-registrar, TDS deduction proof is also required. SO can total TDS be paid on total consideration amount, before registry date, even though bank will actually pay 90% to seller on date of registry only.

    Hi,
    I liked you video very much. You clearly mentioned all the steps required to do property transaction with NRI. You video was I think in all sense complete as I can related to it as I am in the process of purchasing property from NRI.
    I've one doubt regarding this If you can throw some light on this issue it will be great help for me.
    Following is my Query:
    I am purchasing a property from NRI which is jointly held by Husband and Wife. The buyer are me and my wife. Like you mentioned Seller has applied for lower tax certificate and Me and my wife has applied for TAN etc. That all formalities are done. I've paid him token amount around 1 lakh (already paid tax for this amount) and balance 50 are pending.
    Since the seller has produced the lower TDS certificate of 12%. Hence I will be deducting 6 lakh and will pay to Govt, and balance 50-6 = 44 will be paid to him by me.
    The seller is coming in few days to India and the sales proceeds will go to their joint NRO Account.
    My question is that how should I pay the balance amount of 4 Lakh assuming I am going for home loan for 40 lakh ? Means, should I make four cheques like:
    Me --> NRI Seller Husband (1 Lakh)
    Me --> NRI Seller Wife (1 Lakh)
    My Wife --> NRI Seller Husband (1 Lakh)
    My wife --> NRI Seller Wife (1 Lakh)
    OR
    Single cheque of 4 lakh will do If I issue in both NRI Sellers name.
    Please note that In both case I am planning to pay TDS using Four challans for all buyer seller combination .
    I know I asking a big question, but I will be very grateful to you If you could clarify my doubts.

    Hi Sir,
    Great explanation, I have few queries please cover my use case.
    I am buying property from Couple? Do I have to split the TDS between the owners? Also how much should I mention the property value in each of form 26Q forms?
    Also what should be the date values that are given in multiple places?
    I am going for agreement on 25rd/May. I am paid my part before 23rd and giving bank check on 25rd/May to sellers.
    Example: Property cost 90 Laks.
    Owner: X and Y.

    Hi,
    The 26QB form requires the following two values to input:
    1. Total Value of Consideration (Property Value)
    2. Amount paid/credited currently (B)
    and if i understand correctly, the first value should include tax/GST paid while the second shouldn't.
    Example: Property purchase @ 1cr with 10 installments of 10 lakhs each.
    1. Total Value of Consideration (Property Value) = 1 cr + 5% GST = 1,05,00,000
    2. Amount paid/credited currently (B) (aka Installment) = 10 lakhs.
    3. TDS @1% = 10,000
    Can you please clarify if this is correct ?

    Hi @AY, thanks for clear and crisp video. Please help me with answer of below query:
    1. Form 26qb need to be generated each time of transaction or is there a provision in portal to enter different transaction in case of bank loan at once ?
    2. Any portal to tell how much late fee I need to pay for TDS not being paid on timely fashion.
    3. Let's say all payment to seller has been done but registration pending. After 5 month I came to know about TDS payment, so I did. But how to recover money from seller, since he has now all credited to his account.

      Irrespective of whether he/she makes any capital gains a Tds of 20%+surcharges must be applied and deducted.

    Suppose, if I am paying 5K, then 2.5k will be paid by my wife and rest half by me or I can pay the full amount?

How much plenty or interest will be paid. As it is joint property than TDs will be paid 50 - 50 by both person. Cost of property is 70 lakh. Please suggest. Thank you sir

    i have purchased property from seller costing more than 50 lakhs. Currently i have paid him partial amount of total purchase value in 2 installments and yet to do complete payment. However property is still not registered in my name as it is an under construction property. So can you please clarify, if TDS need to be paid post registration or during time of registration

    Hi Sir, I have question. I am buyin property from Father and Son, father is resident Indian and Son is an NRI, now registry will be done by both of them. Being residential Indian Father doesn’t have to pay TDS but Son has to pay TDS anyway as he is an NRI. So in that case, how can you calculate LTCG. Can we decide LTCG in half and pay TDS ?

    This video seems informative. I have one doubt on date of purchase agreement input as so far i had paid a token money of 1 lac and exchanged a offer letter with owner. Home loan just got approved and for sale deed just paid a franking charges today. What date should i mention in date of purchase agreement

    What about TDS on under construction properties if value is > 50L. Agreement is generally done on 10-20% of value paid upfront and in that we dont pay TDS usually.
    In case of remaining amount taken from loan and payment is based on construction, how to claculate TDS. Should GST and taxes be considered in TDS calculation?

    Hello sir, thank you for the informative video, helped me a lot. Had a doubt though. @9:21 , you said TDS is deducted but not deposited, in which scenario does this happen. My understanding is, TDS will be deducted and deposited at the same time. If not, what one should do if it's not deposited but deducted at source?

      TDS is deducted when making payment. TDS is deposited after deduction.

    I had purchased residential land in feb2018 but TDS was not deducted from seller as because he was not agree to detect the same and further stated that i will pay the same on my own . It was also mentioned in the deed of registration.
    I had borrowed 50 lacks from HDFC Bank in which 01 lack amount was hold by the bank as TDS.
    Now, Banks authority informed me to submit TDS receipt as early as possible to released the hold amount as pointed out by auditor of the banks.
    Pleas, Gudie me how to short out the current issue(Payment of TDS)

    Thanks for the detailed information as it's very rare to find such level of information.
    Just 1 doubt do every one needs to register in trace with TAN or we can register as taxpayers and still generate the 16B form.

      A resident can deduct TDS with his PAN is the deductee (seller) is also a resident. However, if the seller is NRI, then buyer needs to obtain a TAN for deducting TDS. Procedure is entirely different is property is being purchased from a non resident.

    I have one query
    If we purchase a plot via bidding from government like DDA or HSVP in Haryana than what is procedure ?
    Property allotted at Rs 8000000(eighty lakes) and we submitted all payment in government that is 8000000 one year back.
    Now what we do?

    Is it applicable for property with a work order ? For example, if the total sale consideration is 80 lakhs, work order is generated for 40 lakhs and the sale deed is executed at 40 lakhs.

    I also have to show in my ITR as individual, the TDS deducted on purchase of house above 50 lakhs (since it shows in AIS /TIS/26AS.

    What is this date of agreement? Is this based on the registration of sale deed or sale agreement? If it is sale deed registration then this process follows after filing TDS under form 26 QB. If it is based on the sale agreement which we can also call intent to sell which is executed some time earlier could be months also then it is correct to mention this date in the form. Shall it be hassle free.
