The Americans with Disabilities Act (ADA)
The ADA is a comprehensive civil rights law for persons with disabilities. Title II of the ADA prohibits discrimination on the basis of disability in all programs, services, and activities provided or made available by public entities (state and local governments and special purpose districts). This includes housing when the housing is provided or made available by a public entity regardless of whether the entity receives federal financial assistance. For example, housing covered by Title II of the ADA includes housing operated by public housing agencies that meet the ADA’s definition of “public entity,” and housing operated by States or units of local government, such as housing on a State university campus.
Title III of the ADA prohibits private entities that own, lease (to and from), and operate places of public accommodation from discriminating on the basis of disability and requires places of public accommodation and commercial facilities to be designed, constructed, and altered in compliance with established accessibility standards. Public accommodations at housing developments include any public areas that are open to the general public, such as a rental office. Public accommodations would also include, for example, shelters and social service establishments.

Who Is a Person with a Disability?
Federal nondiscrimination laws define a person with a disability to include any (1) individual with a physical or mental impairment that substantially limits one or more major life activities; (2) individual with a record of such impairment; or (3) individual who is regarded as having such an impairment.
In general, a physical or mental impairment includes, but is not limited to, examples of conditions such as orthopedic, visual, speech and hearing impairments, cerebral palsy, autism, epilepsy, muscular dystrophy, multiple sclerosis, cancer, heart disease, diabetes, Human Immunodeficiency Virus , developmental disabilities, mental illness, drug addiction, and alcoholism.
Some impairments are readily observable, while others may be invisible. Observable impairments may include, but are not limited to, blindness or low vision, deafness or being hard of hearing, mobility limitations, and other types of impairments with observable symptoms or effects, such as intellectual impairments (including some types of autism), neurological impairments (e.g., stroke, Parkinson’s disease, cerebral palsy, epilepsy, or brain injury), mental illness, or other diseases or conditions that affect major life activities or human functions.
The term “major life activities” includes those activities that are important to daily life. Major life activities include, for example, walking, speaking, hearing, seeing, breathing, working, learning, performing manual tasks, and caring for oneself. There are other major life activities that are not on this list. Major life activities also include the operation of major human activities, such as the functions of the immune system, special sense organs and skin, normal cell growth, and digestive, genitourinary, bladder, neurological, brain, respiratory, circulatory, cardiovascular, endocrine, hemic, lymphatic, musculoskeletal, and reproductive systems.
Under regulations implementing the ADA Amendments Act of 2008 some types of impairments will, in virtually all cases, be found to impose a substantial limitation on a major life activity resulting in a determination of a disability. Such impairments are “predictably assessed” as disabilities by the very nature of the impairment as substantially limiting a major life activity or major bodily function. Examples include deafness, blindness, intellectual disabilities, partially or completely missing limbs or mobility impairments requiring the use of a wheelchair, autism, cancer, cerebral palsy, diabetes, epilepsy, muscular dystrophy, multiple sclerosis, Human Immunodeficiency Virus, infection, major depressive disorder, bipolar disorder, post-traumatic stress disorder, traumatic brain injury, obsessive compulsive disorder, and schizophrenia. This does not mean that other conditions are not disabilities. It simply means that in virtually all cases these conditions will be covered as disabilities.

Hey, I will try to keep this short. Try.. 2010 I had brain tumor/cancer. I got disability they kept denying me but when they gave it to me they gave me insur and sent a 8000 dollar check for all the time I waited I had to try to get it again they sent a 6000 check then I tried again they denied it and I got tired of waiting and tried to work b/c I was depressed had no money to do things I was living with my mom. I worked against drs orders and I got a job for almost a month and they “let me go” I couldn’t cut it I tried but I wasn’t exactly able to hold information so I got another job worked two years it was a lot on me but I was happy to be doing everything my drs said I wouldn’t do. I got another job and it was a lot on me but I didn’t believe in disability to have cancer brain tumor hydrocephalus they denied me. But I started getting sick headaches dizzy spells. Left that job got another still having issues doing the job but I got to work I felt like and I started having multiple seizures at home work in my sleep. So dr said I can not work wrote a letter to my job and that was the last time I worked last year. Filed for disability again I really had no choice. I had a stroke feb 4th which is the day I went to sign papers for disability to start left there straight to hospital. My speech is bad I been in speech therapy I had a feeding tube peg in my stomach had it removed 3weeks ago. Speech still bad. I like miss step sometimes get dizzy can’t walk straight but I’m trying to get a place because they don’t pay me much so I need it. I asked the ppl at the disability place for help and they said they didn’t know I’d have to find that out so I don’t know where to start how it works I’m lost and today I ran across your vid so I’m trying my luck. Any suggestions? Thanks for your time.
If its housing your looking for calling 211 or 311 to get a housing interview with a local COC.If this is about disability check from Social security you would have speak with lawyer.Im unclear on what you need.

You actually would do well with both a COC and HUD ,I think aCOC would produce housing my faster at 30-45 days but you will need to all the right things and ace there assessment test .
@@Section8Consulting Thank you a lot I will look into it. Dr has said I’m unable to work indefinitely but I’m always fight to work and take care of myself. I just tried once and I’m back in it again and I’m not trying to kill myself just so I’m not on disability although I hate it. Thank you so much you gave me direction.

Waiting list just opened last October, hasn’t been open in yrs. I signed up, it still says up to 6 yrs waiting. I’m disabled homeless, can’t even find a camper or trailer I can afford that’s livable and a safe place to put one. Ever since the wildfires, housing here in northern ca is horrible 😔. I’m miserable, Xmas is just another day. Appreciate your info 😊

This video is a GOD SEND. I wish I had found your channel MONTHS ago, but let me just say, I'm so incredibly grateful to have found it now !!! I'm about to do a deep dive of your other videos and website, and try to soak up as much of this information as I possibly can, but I just wanted to let you know in case you see this, that I feel insanely (no pun intended. promise) empowered just with the information in this video alone. I finally feel like I found exactly the resources and information that I have been in desperate search of for over 6 MONTHS OF HELL dealing with these psychopaths!!!! They refuse to answer my questions, refuse to acknowledge my concerns, and have treated like a damn criminal and hysterical woman, and have made me jump through batshit crazy flaming spiked hoops and obstacles acting as if our ability to qualify for housing were entirely conditional based on how they judged my "performance". I'm a young single mother suffering from PTSD, and doing everything I can to provide the best life I can manage for my severely autistic child, who requires round the clock care, -they think because I am all alone, my parents are dead, I have no one, no friends, no advocates, no allies, that I can be manipulated and antagonized without check or consequences, but we have RIGHTS. I'm not even an addict, I'm just completely without support or any help, and they EXPLOIT that, these are people who have a professional and ethical obligation, and are FRIGGIN PAID to aid extremely vulnerable and disadvantaged people, who use their position of power and authority to psychologically torture and abuse the least deserving individuals, the ones they literally allege to serve and provide assistance to. It's SICKENING.

Good Evening, really have been enjoying your videos (Although, for the past two years I've had nothing but problems finding housing of any sort!) I'm almost 65 and therefore qualify as a disabled (electric wheelchair) senior, I'm on SSDI, diagnosis of severe PTSD, Parkinson's disease and Peripheral Neuropathy; also, Sleep Apnea! I have two support felines (both of whom are documented by my physician). To date, I've been turned down for more housing that you can throw into the fire. If you truly are as great as your video's clearly state, I'd happily accept any and all advice you might be able to provide! Thanks for your informative videos! Keep up the great work!

I have documentation for me and my kids but every landlord had denied me because of an eviction on my record. My landlord went to sue me for unpaid rent and i took my landlord to court because they wouldn't let me out of my lease because they would do repairs of my unit when i moved in my apartment wasn't remoled at all because when the landlord told me that my key was going to be in the mailbox after 5 it was becoming cold and i told my cousin to see if he can found the heat thermostat so i can turn it on and she didn't even tell me that there wasn't going to be baseboard heat. So when i moved in there wasn't any heat and i had more roaches

Why are section 8 wait lists so long??? I haven't even re-applied yet since the last time i applied they took YEARS to call me with an opening and by that time.... They couldn't get ahold of me and the case was closed!!! It's a joke.

I think the thing about certain ages may have come from certain rules for other benefits like disabled adult child similar ones that are for SSD and SSDI. There are so many different rules in those programs it is hard to know them all. They are the sort of things I would have to lookup myself since they sometimes even change or there may be a new one.
It took me 15 of 24 years before know most of it, but yes.

6 years ago, i filled out an application for section 8 for myself. I am legally blind, and Diabetic. So, when my time came, i was denied because they wanted my adult kids information. My kids didn't want to give their information up. Cause they not going to be living with me in a 1 bedroom. The section 8 was for me. So, why they wanted their info? Just to be nosey?

NY. State i'm disabled and applied for lease housing and are currently 105 on the waiting list that was almost 2 years ago i was told that they are doing it by a lottery after being one of the first to apply when they opened the list.
That sounds like typical housing authority scam.
This is in behalf of my 77 yr old disabled sister with severe health problems as well as PTSD from being minutes away from the scene of her youngest son who committed suicide by standing in front of a train because he was so depressed over the car accident that killed his sister one yr earlier. Now she is soon to be evicted because the owner is selling her house. She gets SSA but has no place to go and won't pay for a hotel room. Is there anything she can do to get one of the vouchers you talked about?

Tax credit apartment complexes say you have to earn 11,000 or up to qualify! What person on Ssi gets that? No one! Its discrimination, why give these people tax breaks if they dont help the people who need it? Its just above what they get. Just enough to weed the Disabled out! Its disgusting. If they make enough monthly to pay the rent then that should be sufficient!

Several housing developments in Rockland & Orange county NY ... Theyre low income tax credit yet require a minimum of 11,000 dollars though most want more annually to get in. Very unfair...

First of all thank you for the info quick question if I work but I have a a problem where I pee myself constantly because a doctor cut me but there's a 2-year statute of limitation then I cannot Sue so I'm out of there in that department so I have to wear diapers until the rest of my life but I'm only 45 I want to have a second chance so I'm going to go get another surgery and see if it works but if it doesn't work how can I get housing if they think that I cannot do for myself but I can do for myself it's just hard I don't want to make a mistake of asking for disability before I get my home I want to still work I'm still young but if this doesn't work then I'm going to have to apply for disability and housing and I think it's so overwhelming

My name came up for a 2 bedroom. It's subsidized apartment building but the apartment manager is making me jump thru hoops Im on disability. She asked for proof i have custody of my own child for 16 years wanted a court order cuz she said the estrAnged father could walk in and claim same thing. So i found a court order from 2016 and brought it to her THEN SHE said she needed MORE PROOF cuz I could be trying to sneak him in. WTF!!!!! So I brought her my last 2 tax returns. She has ALL THE OTHER PROOF SHE NEEDS AND I WONDER IF IM BEING DISCRIMINATED against cuz of my daughters father ( who btw in 16 yrs only met her when she was born)

Hi im in this west park apartments with PHA for 6 yrs they are knocking the high rise down I have 2 children with developmental disabilities taking meds . 1 child on Ssi. I have a voucher it ends may 28th 2022 I have no credit and no luck finding a home , being denied cause credit score. Also looking for great school districts will not accept voucher can you help?. I have autism and hud has been the worst thing to deal with. Got a section 8 voucher and never got to use it in time. facing homelessness again due to harassment and discrimination and unsafe building along with inappropriate housing with huds public housing.

Those of us who are unable to handle or navigate housing issues are getting hurt esp when we dont have services or supports. I am unable to find housing or fill apps out without supports. I dont have friends or family either. I have specific needs for housing to work and none met. HUD doesnt take or return calls, My health continues to worsen due to the extreme loads of stress yet dumped. I have subbed as you explain the hud laws alot better than i can figure out.

If you are documented disabilied and the county you applied for section 8. You are under 55 and the only accessible housing is for 55 older. What should you do?
Unless your in wheelchair or require nursing they can not restrict ADA housing to specific age group.
Tell them you are disabled and tell them your age, they will let you know what to do

Hello I live in south Florida. I have a disabled child who is full care. She was diagnosed with hydrocephalus and CP as well as visually impaired, epileptic. I’ve been trying to get info for many years about this but unfortunately, Florida do not make it easy it and easy access to this info. My daughter is now 15years old. I’ve always had to struggle financially cause I am not able to have a full time job due to her condition. I’m very interested in this program. How do I find out if we qualify here in Florida?

I am 46 and 100% physically and mentally disabled. I DO receive 100% SSI as my sole income. My wife of 19 years (22 years total) and I have mutually decided to separate. I have a unique situation but not sure how or if it would help me. I am on ssi and have a dependent infant child, I co parent with her father who is also in ssi and plans to live with us. I am expecting a family inheritance of around 50k and my family has discussed helping me to purchase a mobile home on land. The issue is we live in Washington state and the cost of living has gone up so high that there’s no way we could find a property in our price range 100-250k max. Are there programs that allow co-signers or that could help me? I honestly have no clue where to start.

They took me off list stating I was contacted in October 2019 and January 2020 with no response so I had to be removed from list. My address had not changed nor my phone number. So I don’t understand how did they contact me I have same email address, where I’m staying with family is the same and my phone number is the same. How can I plead my case when I never received any contact from them. I had an application for just myself because I have Primary Progressive Multiple Sclerosis, and other health issues. That is a perfect example of qualifying disability for HUD.As mentioned in other videos the standard for disability is much low with HUD than Social Security Administration /Disability .

Hi Cyber Mixologist, I still can’t get into my account. They stated someone should reach out to me soon. I be been on the list since I carried my 1st child in 1985. And I applied again 2 years ago than again last year. Delaware County I had to complete a new application and I am 3200 on one list and 9700 on another list. Pa makes it so confusing and frustrating so you give up. Thanks to you I have the strength to keep fighting. PHA also has this club who you know going on. I personally knew people who had two housing places one in North Philly and an apartment in west Philly. To me that’s a problem for those who really need it and her Social Security number should have given a red flag.Philadelphia’s housing is so corrupt. I also knew many who sublet their section 8 houses and the landlords knew it. It’s corrupt around the whole system. Generations of families are living from grandparents, children, to grandchildren and so on it’s truly ridiculous. While Vets, seniors and disabled are hanging on by a thread. I applaud and appreciate all your help and I’m praying for you as well because I have learned more from you than any agency in Philadelphia. HUD now has the HMIS database and when they start connecting all states and cities a lot people will be charged with fraud and get free housing and meals in the Federal Prison System along with lifetime ban from state and federal housing.The game is almost over .I give it another 12- 24 months before it all connected and the Felonies starts flying.Once there arrested all there shit will be in the street and 1000s of apartments will be free to rent.

You should get him registered through an agency to get paid to take care of you. Medicare should pay for respite care.
But with housing you'd have to make sure you're very clear with them that you're technically homeless.
