That's unfortunate that your lawyers won't handle the prop damage aspect of the claim..... I always used to help with PD... You can make a claim for any lost wages you want if you can document it. Question is whether they'll really compensate you for it. But I wouldn't let it go. This sounds like a typical bs insurance situation.

The problem is I missed 3 weeks of work because I had to wait for uber to inspect my car and determine it was safe enough to drive. I average about $ 800 a week driving uber to me that's a significant lost. My lawyer is telling me that money should have been recouped as a part of my property damage. Hmm. Sounds like your state has different laws regarding lost wages than we do in IL. Because here that would not be part of the property damage claim. So I would go back to your attorney to clarify. However, working hours were in fact lost resulting in loss of project progression that will have to be made up by either extending the deadline of graduation/needing to work more hours to catch up?

What if your self employed and work part time so my money is mostly always cash I do lawn care part time just to make ends meet until my son starts school then I can start goin full time and start a small business?

Instructions to not lift over 10 pounds for six weeks based on just this amount of time and my wages per hour and with a minimum of 40 hours per week do you simply 0:15 multiply 20 by 8 hours per day five days per week for six weeks? All my savings are exhausted. Technically they owe me over $50,000. Considering all that's going on in the world and it could be any of the company's fault only ask for the 7 weeks that they've had my car in the shop which total is up to around $20,000. They only wanted to compensate me for $1,000 worth of work. Which if you see those two numbers you know that's a spit in the face. So with all that being said with no injury. What if I ran out of vacation and sick leave while out of work because of my car accident and therefore I had to quit my job of 6 years per Drs orders of only working 3hours a day due to post concussion syndrome. So to survive I took out my Retirement and just dealt with the 20% hit upfront and 10% hit during tax time since I was only 32 at the time. CAN I GET MY RETIREMENT BACK AS WELL AS MY LOST WAGES FOR HAVING TO QUIT AND BE OUT OF WORK FOR 7 MONTHS?!?!

Hello, you can attempt to recover your lost wages if they are reasonable amount. If you weren't at fault what I would do is document the wages from your employer that you lost in some sort of writing signed by a manager and get it in front of the insurance company.

@@mariusniambe850 Hi, I see. I've dealt with the Uber lost pay issue a couple times. Hard to recover. First, no, it's not illegal per se for them to deny the claim. They can deny the claim if they want to. Then, the issue falls back on you - meaning, what do you want to do. Your option at that point is to file a lawsuit against the driver of the vehicle. At that point, it is up to the judge to decide. I think you probably have a 50/50 shot at recovering those wages. How much we talking about?
@@mariusniambe850 Hi, well, you would have to gauge if it's worth it. You'd have to pay a couple hundred bucks to file and serve the defendant. Then you have to deal with going to court a couple times and having a small trial. If it's worth it to you, you could pursue. But it's not a give-in. Also, the insurance company might bend a little bit rather than having to deal with a lawsuit and might offer you something to dismiss it....

However, she has not received any amount yet and not able to visit attorney's office as it is closed due to pandemic. Morning, for Uber you are going to have to figure out how to download the info off the app to show what your average weekly wage was in the several weeks before and after the accident. That's the way we've dealt with that in the past. Unless there is a new way to access that information.

For ex: 300hr * $45 per hour = $13,500 (lost wages). My employer still paid my for those 300hr, even if I missed work due to accident injury but my work load remained the same... You will have to document your actual lost wages. If you were paid, then unlikely. However, if you had to use vacation time or any other benefits you can recover for those. But check your local laws. Could be different in your state.

I dont have medical payments but I do have uninsured motorist but they say I cant use it. but I wasnt at faut but because they have no info on the car that ran me off they say I cant use it

What about if you lost imcome due to an accident that your are not at fault but had no injury?
Hello, you can attempt to recover your lost wages if they are reasonable amount. If you weren't at fault what I would do is document the wages from your employer that you lost in some sort of writing signed by a manager and get it in front of the insurance company.
@@LawFull Thank you LawFull, I did submit all the documents but they refused to pay the Lost of income , I'm a Lyft driver and the car I drove at the time was a rental through lift that I pay every week, their reason to turn me down was based on the fact that I was in a rental.The accident prevented me for driving for 20 days due to an internal policy with Lyft in case of accident regardless of fault. Is it legal for the insurance company of the other driver to refuse to compensate my loss of income after admitting that he was at fault?
@@mariusniambe850 Hi, I see. I've dealt with the Uber lost pay issue a couple times. Hard to recover. First, no, it's not illegal per se for them to deny the claim. They can deny the claim if they want to. Then, the issue falls back on you - meaning, what do you want to do. Your option at that point is to file a lawsuit against the driver of the vehicle. At that point, it is up to the judge to decide. I think you probably have a 50/50 shot at recovering those wages. How much we talking about?

@@mariusniambe850 Hi, well, you would have to gauge if it's worth it. You'd have to pay a couple hundred bucks to file and serve the defendant. Then you have to deal with going to court a couple times and having a small trial. If it's worth it to you, you could pursue. But it's not a give-in. Also, the insurance company might bend a little bit rather than having to deal with a lawsuit and might offer you something to dismiss it....

Hello, my friend in NY was hit by a car and due to that injury, she is till unable to go to work (Since Dec. 2019). The case is with attorney and looks like the firm filed wage loss claim. However, she has not received any amount yet and not able to visit attorney's office as it is closed due to pandemic.
In this situation, can she file for unemployment? how much will she get (Accident happened in Sept, but she could not go to work by december). Your advice will be appreciated.

Morning, for Uber you are going to have to figure out how to download the info off the app to show what your average weekly wage was in the several weeks before and after the accident. That's the way we've dealt with that in the past. Unless there is a new way to access that information.

after a while it adds up to a certain amount of hour. For ex: 300hr * $45 per hour = $13,500 (lost wages).
My employer still paid my for those 300hr, even if I missed work due to accident injury but my work load remained the same...
Will I still be compensated for my 300hrs of missed work?

You will have to document your actual lost wages. If you were paid, then unlikely. However, if you had to use vacation time or any other benefits you can recover for those. But check your local laws. Could be different in your state.

Hi, sounds like you were seriously injured. Have you talked to your attorney about this? Depends on the laws in your state whether he can recover. But there is something called loss of consortium you could research and see if it applies where you are.
