    So far I have close to $2.5 million in injuries. Spent 54 days in the hospital. 2 broken vertebraes, Severe concussion, resectioned small intestines, resectioned large intestines, removed appendix, broken left foot, 7 inch pin in right hip, had to relearn how to walk, lost 45 pounds in hospital, memory loss, ptsd, depression, missed 8.5 months of work, a few broken teeth, etc.
    What should I expect from a trial case?
    We were only offered $90 K so far…
    My wife had 2 broken arms, and missed 10 months of work, had to be cut out of the car. My daughter had a broken sternum and almost failed 12th grade, suffers from severe depression.

    Hi there, awesome video. Question, more so for medical malpractice but also auto accidents, when you do win a jury verdict of a large number , is it almost guaranteed the defense will appeal the verdict ? My understanding is appeals can only be for if the judge made an error in his/her instructions, but then it seems like every large dollar jury verdict goes to appeal ? Is it just a given no matter what ? Thanks Again and have a great day!

      Appeals can happen for many different reasons. Defendants do appeal high verdicts but many cases settle after verdict as well

    Great information however what if the defendant is NYC trip and fall injury that includes surgeries. Is there a liability amount and do they ref to PJi….also how soon do they settle after 50h hearing?

    Hit head on in my semi by another semi. I was going 65 mph. Not sure how fast other semi was going but it seemed fast. I have concussion, herniated disk lower back, broken ribs, collapsed lung lower left lobe, serious lacerations and bruising to both legs,whiplash and spine is out of alignment. And he completely destroyed my semi and trailer. And I’m an owner operator.So it destroyed my business too. I’m loosing $1500 for every missed load. 5 loads per week. 20 loads a month. So do they math on how much money I’m loosing. Do I have a strong case? Man that caused crash died at scene. There were witnesses that stated he was all over road 5 miles before crash. Highway was closed basically all day. Major freeway between Vegas and Phoenix Deadly 2 lane road. They call that road blood alley. I’m very lucky to be alive.

    Hello sir, I have a question for you regarding a situation hypothetically extremely similar to what you just covered in the video some soft tissue with treatment but the policy limits are large at 1 million do you believe that $20,000 settlement is still in the scenario or is it a much larger settlement due to the policy limit?

      The settlement usually depends on the injury so yes if soft tissue around 20k is reasonable. To get more you usually would need more medical care to show why it’s worth more

    What about all these things you are talking about? Except my wife and I got smoked by a oil field semi tanker. We’ve got bulging discs in my l4-l5 and we’ve been attending chiropractic for 24 weeks, I own a million dollar a year business & when we got in that wreck it affected my business tremendously went from Jan-July 30th $85-90k a month to $45-$50k a month August-Present because of all my doctors, appointments, scans, pain management, chiropractic, and shots in my back. I wish I could add photos of my truck, I still have PTSD from driving.

      The trucker was 100% at fault, took a wide turn from the left lane with no blinker on, and the road he was trying to turn on said no oilfield traffic/big semis, because the truck route was a half mile before the “illegal shortcut” he was trying to take when he completely t boned my wife and I who were in the right lane going 55 down the highway when he turned into us.

    Hey, thank you for the information. What do you think of an older woman crossing the street that gets hit by a car. No broken bones however left with pain and limit of movement couldn't go back to work. The offered settlement seems like a joke. When there are no broken bones the individual gets offered peanuts. But what happens to the quality of life when one can't even work anymore. Shouldn't people be compensated fairly for that?

    Love the videos,so I was hit by a commercial truck class 6 and Iam at the point of Microdiscectomy referral from surgeon.There is 100 % liability on truck driver that ran a red light an t- boned me at work in my truck,they have a million dollar policy.Now this is why it’s tricky,I have had prior injury before but has got a lot worse as fare as multiple disc’s are herniated now.the prior injury I only had one,plus this time I have had injections in my neck.I see a psychiatrist for ptsd next week.This crash happened in California in a more liberal district as well.I guess Iam wondering how my prior injury affect this case an would u go for the million and settle somewhere in the middle?Or any thoughts would help.U guys are awesome thanks in advance.

    I was At a stop light and i guess the 18 wheeler missed his turn. So he started to reverse i tried backing up but couldn't since there was a car behind me so I honked and just waited for impact. I required back surgery got the surgery. Insurance has expected responsibility for accident. My lawyer has submitted just medical bills for me and my wife for the 90000. I have been out of work since accident and will mostly be disabled as I am receiving long term disability payments from my ex employer. I am in texas. What is the amount the insurance will settle for. Can my attorney ask for 500000. As I am disabled

      Yes I think your attorney should ask for the max. Don’t limit it to medical bills. You are also entitled to past and future pain and suffering plus loss of enjoyment of life compensation

    What do you think is fair semi blew stop sign smashed head on to car,brain injury,bulging disk,arthritis in the spine ,stiff neck for 2months with 5months of physical therapy and 9months of everyday headaches and still counting, looking at epidural injections to the neck

      I was the passenger/victim in a tbone collision...the.car that hit is is 100% at-fault (agreed by Progressive and Allstate, P=at-fault insurance and A=underinsured insurance).
      I was transported to ER, refered to Orthopedic to MRI back to Orthopedic doctor who read MRI results = sustained 2 tears in shoulder/rotator cuff surgery recommended and now preAuthorization for surgery by my Primary Health insurance.
      Allstate HAS stated they will pay Policy Max limits of 25k + 10k PIP...adjuster informs me the limit settlement is being tendered, BUT must wait for clearance from my Medicaid state "poor people" insurance to release any liens they have...
      UPDATE: No liens and Allstate DID PAY POLICY MAX 25K+PLUS PIP &10K
      Progressive says they are still reviewing current and past medical...(which genuinely is Zero preexisting conditions and truth about the torn rotator cuff, MRI shows to significant tares.)
      UPDATE: Progressive (primary insurer of the 100% at-fault driver) has countered my policy limits settlement offer with a $3,500 cash and (up to $15k for whatever they seem to be necessary medical treatment) and they refused to budge....I countered with the following (but they have refused my counter) which was $18.5 k, which is the amount they've already allotted ($3.5k PLUS 15k med =18.5k) ...all I requested was for the medical allotment to be released to me and I would sign off all liability of my injured torn shoulder and then I would be fully responsible for my injury/treatment/rehab from there on out....I thought that was a fair settlement offer since they already had that total penciled in, but they have refused that offer.
      (fyi: Progressive contacted Allstate unbeknownst to me within a week of the collision and THEY opened the underinsured claim with Allstate...and yes, Allstate has already paid policy limits as stated above, which is the exact same policy limits amount as Progressive, but nonetheless Progressive is sticking firm at their offer of $3.5k for me and up to $15k for "medically necessary" as deemed by them)
      so my question is, #1 does that sound all good so far?
      #2: what if I, On my own, with the full knowledge and responsibility, makes the decision to NOT have the surgery...Will that effects potential settlements...or will the insurance companies jump on it and settle immediately as there are currently Zero leins from my insurance.
      UPDATE: I have not had surgery yet, I was hoping that Progressive and I would have settled, but that's not the case...and my SHOULDER IS KILLING ME....but I don't know for certain if they will cover it for sure so I've been basically sitting on standby.
      Now, Progressive wants me to participate with their further investigation, take part in a crash reconstruction thing....but they honestly pissed me off by not being straight up with me, straight lied to me (I know I know I shouldn't be surprised) but I had been completely open and transparent throughout the entire claim, up until they lied to me...mind you they had literally 4 different claims adjusters/reps assigned since the claim was opened 9/2/23...and I did everything they asked, answered all their questions over and over ...this last /current adjuster said all was good and all they needed was my medical records and they would address my settlement offer of policy limits, the same as Allstate...and they received my CLEAN Med records/history....so I thought we were good to go with policy limits, the same as Allstate accepted and paid...but Progressive rep lied, because he received my CLEAN Records (up to the collision) but I didn't hear from him for a couple weeks...until an Investigator called me out of they blue at 7pm asking me AGAIN all of the same questions I already answered for the 1 rep, 2 rep, 3 rep, 4 rep AND NOW FOR THE 5TH TIME! plus he wants me to participate in a reconstruction of the collision!...I got pissed, I thought we were done, I thought it was clear cut, easy peasy, just like Allstate saw it.......BUT NOPE, they want me to go through more rigamurooo...and if I don't they are sticking to their offer of 3.5k....which is miles away from the policy limits.
      So that's where I'm at....any suggestions or advice would be SOOOO helpful. (i.e.) should I hire an attorney? Should I file a lawsuit myself? Should I participate in their ongoing investigation/reconstruction thing?
      (*I ABSOLUTELY BELIEVE my shoulder is worth more than $100k , so if someone does chime in stating I should just be greatful for what I already received from Allstate, I respectfully disagree, although I'm a greatful and appreciative person, I am, BUT my shoulder is DAMAGED, broken, TORN in multiple areas, bone literally torn from my shoulder muscles...the PAIN has been and still is constant, and the ONLY OPTION I have to fully heal my shoulder is Surgery and surgery only (muscle does NOT reattach to bone) so surgery is the ONLY option I have, PLUS it's one of the most Painful surgeries/rehab of all surgeries, in addition to the 6-12 month rehab/healing time it takes! So yeah, NOT FAIR, the person was Negligent, 100% At-fault...and thankfully they had insurance, so Insurance is there for reasons just like this! I'm NOT LOOKING FOR A PAYDAY, I've NEVER in my life have ever opened up an insurance claim and I would GLADLY GIVE BACK ALL OF THE MONEY if I had the choice for this to never had happened, but I can't and here we are....so I feel progressive needs to step up and honor this claim just as Allstate has done for their portion, period. My shoulder will never be the same regardless of treatment, never, so 75k, 100k, shoot a Million Dollars to me or anyone isn't truly fair compensation for torn up broken shoulder, ESPECIALLY for a 38 year old, active, athletic, outdoorsman, father of two young children, straight up, so yeah, 50k is ABSOLUTELY fair for Insurance companies to pay, pay to prevent their customer who has been paying their monthly premiums, to prevent her from being sued in a civil court of law (clearly I'm passionate about this, but it's how I feel and id challenge anyone to rebuttal if they feel I'm wrong...just saying;)
