    We owned a magnificent 1000 acre farm in Australia in the 60s and 70s. We farmed it for many years while people asked to camp and explore. Eventually we opened it up to the public with a small fee going to upkeep and toilets. Stock horses used for horse rides. It was fabulas! Win win.🤠🐎

      @@helenaville5939 Dad's army was a comedy TV show all through the 70's and getting pretty tired and worn out by the end. Here is a guy who could only have been in his early 20's when it was airing. but that is trying to carry through it's comedy right into the 21st century ! He finally got his 15 minutes of fame after all these years 🙂 And all about a rock. LOL.

      He has helped. They would never have met up in person to discuss the issue if it wasn't for Bob. The idea was to get Jim to understand that trespassing is breaking the law and for him to experience how tough farming is, which has likely made him think twice before acting against the opposition. For Mary, it was to get her to not have a grudge on Jim and the other trespassers, and basically to butter her up with the idea of doing something good for the community by using her land to raise money for charities. Landowners like to have a good reputation so it's likely she will hold more future charity events, which means access to Vixen Tor.

    Something similar happened here in Mexico in the 90’s. We where backpackers and we discovered a little town in which we rented a room to spend the night and ultimately making friends with the family, they showed us a little secret of their own, a beautiful, almost like paradise natural water fountain, clean, full of little colorful fishes, so peaceful. We went back a couple of times more until one day the family told us that a politician had “bought” the place and fence it all around, he started charging a ridiculous expensive fee just to keep the town out and build a luxury resort. People were furious and tried to enter illegally, police had been called and used force to keep out the people. The town was very sad, kids, grandparents, there was no way to cheer them up, memories past and future were gone. The place is called “Las estacas” and is in cuautla Morelos.

    Here in Perth, We have a big 4000 acre park next to the city which has botanical gardens, water fall, a big tower which overlooks the park & city. Rock formations, play areas & barbicues ponds with big statues & war veterans plaques under every tree. When I was little it was one of my favourite places. I can't get imagine if the government privatised it!!

    Why not get all visitors to sign a legal notice that they enter this area of land at their own risk? And the owner accepts no responsibility for any accidents while on the land!

      The negotiator (who keeps praising his own skills) never even thought of putting that very obvious point to her. Privately she told him that was her main reason for banning the visitors to the site. Privately the tour leader said they understood that they walk/visit at their own risk. And yet the brilliant negotiator never thought to get this in writing between the two parties. He's pretty useless if you ask me.

    How the hell is land like this allowed to be sold privately absolutely mental it should obviously be public access, it’s our country social and historical landmarks shouldn’t be for sale.

      Pretty sure they just lost the Dartmoor court case she was relying on to be able to stop public access. I don't know why anyone supports these land hoggers anyway. It should be like Scotland, right to roam and wild camp. Now we've got American and Chinese billionaires buying up massive areas of our land, including the local post office and shops like just happened near me, and closing them down. Banning locals from the water and lamd we've always used and only allowing their elites

      It was probably sold because the tor would cost them money to maintain and they didn't want the headache of being sued by people falling off it or being hurt. It costs money to keep historical landmarks in good order and it just isn't in the public coffers. They pass it on for other people to deal with and this is the result.

      It's possible that the land had always been owned but previous owners didn't mind.
      Insurance I can totally understand but simple appropriate signs can help, enter at own risk, climb at own risk ... We hold no liability etc

    Iv seen signs on my travels stating “we will not be held liable to any injuries loss or damage’s whilst visiting this land” but I don’t know if the insurance company has that type of policy

    national parks should NEVER be sold to private companies or individuals unless they continue to give it public access. She paid 30k for it and thinks it's worth 150k plus 400k every 10 years for access. She is playing a con game at the publics expense

      How is that a con game? She bought land for sale. There were no restrictions on it. How could she have know the value of ALL UK property would rise like it did? People want everything for free. They took it up with the legal system and lost. The park service is the problem not her.

    When I became a landowner for the first time, I looked out on it and realised the animals don't know I own it, weather doesn't know, and it became clear the concept of landownership is unnatural and a total human construction. We must reconsider ownership as rights of use and people should have a route to access and owners should not seek profit off such access. If it were my land i would see that day extended to once a month and get the council to cover public liability insurance for those days.

    There is a large land area that was donated to the county by the late family. There are private areas that are shown on their website, and maps. In bold, landowners have the right to press chargers for trespassing. The county could not afford the land that is privately own, and sometimes land is up for sale. It is a nice place to fish, hike, visit the house (not a museum, but is open rentals). It is easy to see where the private lands are, as there are signs warning that you are entering private land. Not sure if there was a problem awhile ago.

    Talk about being caught between a rock and a hard place. Liability for personal injury on private property. The Park authorities should have purchased the Vixen Tor parcel of land and administered its access. I wonder who received payment for this land?
    Jim still remained very immature with his statements, "I haven't been trespassing, there's been no need at the present time" and "this is not going to stop me trespassing, is it?"
    Any updates since 2006?

    Don't need to any further than the first three minutes. She bought and owns the land, Insurance won't cover injuries to the public on the land. Any uncorrupt judge anywhere in the world will side with her. It's her land to do with as she please, within the law of course.

      Not so fast. Public land should never have been sold privately. If she had not bought the land, she would never have been liable. She is the one being unreasonable. There is a great difference between the letter and the spirit of the law.

If there were then that would mean you don't own anything you bought, and anybody could go on your property and in your house as they please. Any land is for sale be it private ownership, commercial, religious or government. The land in this post was for sale, any of these people wanting access to it could have bought it, but they didn't. It was not a secret sale, she bough it fair and square. If people wanted access to it they should have done their research, come up with a reasonable plan according to by-laws, set up insurance and whatever else it needed, then approached the owner. First time someone came on my property claiming right to access, i would go in their backyard with some friends and have a BBQ when they were not home. Free access to land is free access to land. But alas, things are different when the shoe is on the other foot.

      As a dweller across the pond, I have heard a lot about the rights of the public to cross over and use certain land. These lands have had public access rights since at least the late nineteenth century. It’s an English right passed down generation after generation. It seems always to be the rich land “owners” who want to end those rights! I think that’s totally wrong. It’s like the peasants not being allowed to hunt and feed their families from the king’s, lord’s, or rich guy’s forest. Not that bad, of course, but the same principle. There definitely needs to be some give and take here - including from the protestor (who doth protest too much).

    Permissive access with a clearly displayed disclaimer informing visitors that they do so at their own risk would sort the landowners liability i think!. It is a local landmark so in an ideal world the public should have access to the tor during daylight hours.
    I agree with the landowners principle's as there is no public right of way and it would be unwise for any landowner to allow a president to be set ,that devalues the land.
    with public access come usage limitations like not putting a big vicious bull out there. I would build a fence around the tor and a fenced in footpath to it. It would cost a few grand and the problem would be solved.

      It's not just injury an lawsuit for it, it's also the trash, and fires, and scaring/hurting/stealing livestock. Everyone is playing pretend as if public parks maintained daily/weekly aren't disgusting because of "visitors respecting". FFS you can't leave your dog in front of a convenience store for litteral 2min before some AH drags their child "pet the dog!"
      They bought it for livestock, not charity so AH have somewhere to throw beer cans.

    I was born in Plymouth, which makes me a Devonian and over many years of a lifetime. I have spent time walking Dartmoor. I know live in North Devon and visit Exeter because I have a right to Rome, the hills, the valleys and the medals of our great countryside of the Southwest, I think shame that open country Dartmoor is being blocked out of public access. I can’t see any problem as long as people are dear to the rules of keeping dogs on Leeds walking the given footpath walking the edge of fields if crops and livestock are in the field I can’t see a problem with that Because it’s all open country farmland, I think if the person that owns this vixen tour is worried about people claiming if they break their leg that should be made public with the notice at the start of the walk across the lounge that no compensation would be acceptable by walking on the lounge would make any Insurance no non-available and then people can make their own mind up if they want to walk on land that will not pay out Insurance but I think it’s the question of I’ve got it and you haven’t and that’s what it’s all about. We as English citizens should be allowed to Rome Peacefully across given footpaths set out by the highway code set out by British Heritage set out by the ordinance survey>

    In Scotland we have the right to roam EVERYWHERE, except MOD land. A Scottish farmer couldn't do this.
    Only time problems could occur is if we damage the area, which we tend not to do.
    No such thing as private land that I can't access in Scotland.

      There is "Private Land" in Scotland. My land is Private Land! That simply means I bought it, I legally own it and my name is on the title deeds. Should anyone wish to walk through my land, providing they cause no damage, they are legally entitled to do so. The natural beauty of Scotland is open to everyone! I am Scottish, live in a farmhouse on my own land ; miles from any neighbour in one of the most beautiful areas of Scotland. I fully support the Right To Roam in Scotland. What I do not support is the ugly attitude of people like Jim.... a man who seems to enjoy being confrontational. All I can say is There But For The Grace Of God that I don't have to put up with him..... That man has a big problem ,,, and it's called HIMSELF.

    the vixen tor should be owned and run by uk heritage owners and not by greedy private owners ,this is a famous beauty area ,and national trust should be involved here ,so that it can be looked after and public access permitted with admission charge to help protection of the land ,but rock climbing not allowed .

    I'd be embarrassed if my mother was so uncaring.
    This guy should have gone into more options as far as cordoning off a little space or a dirt road for limited access, as well as alleviating her legal concerns with waivers. Easy solutions that weren't mentioned, which makes me think it's more about the fight, or the TV show.

      We had the only pool in our neighborhood, and all the kids wanted to play in it. We were happy to have them over, but there came a time when some children were not minding the safety rules, even though we had adult supervision every time. The idea of losing our home to some parents, whose kids did something stupid on our property and decided to sue us, finally had us back off of our generosity. The reality is people -who own property get sued all the time, even when you have signs posted that they do so at their own risk. I hope you can see her perspective a little better. She has her family's interest at heart. I also see the other side. I hope there were follow up negotations.

    If the problem is insurance what about a 'climb on the tor at your own risk' Also as a farm i would be concerned about people and the stock, both from the stock attacking people who don't know how to interact with stock and dogs attacking sheep causing abortion and injury With no public right of way there is no right of access

      Pretty sure they just lost the Dartmoor court case she was relying on to be able to stop public access. I don't know why anyone supports these land hoggers anyway. It should be like Scotland, right to roam and wild camp. Now we've got American and Chinese billionaires buying up massive areas of our land, including the local post office and shops like just happened near me, and closing them down

    'Custodians of the countryside'.. Is that pile still doing the rounds? 'Custodian' as in how knights and lords, victorious in battle, would demand the children of the vanquished would go live with them? Just in case? It's a hostage situation. Particularly, when it comes to ancient sites and monuments, the farmer/landowner group has a less than stellar profile when it comes to robbing out ancient sites to build/augment/repair field boundaries.
    So, it's three minutes in. I should really watch the rest of this. I just wanted to point out that 'custodians of the countryside' old chestnut. Also, I think it would be fantastic if a body language expert could observe her delivery of it. .... 'Cause I spotted something. I mean - perhaps, she faltered because she knows how trite and flawed the claim is. Perhaps, she faltered because she was trying to remember the precise wording of that comment her demographic keeps using. I don't think she feels it.

    I wouldn't say he's a law breaker it's not a huge deal but it is a civil law no damage done and standing behind the wall just looking at it will just not work and Jim is right if he stopped going on the Tor many other people will go on it. And I agree if you fall it's not the landowner it's on you, climb at your own risk ( I would of put up a sign saying that if I were them ) And no one should own something that is so dam beautiful. And if I was the Landowner I would 100% shear it to anyone who wish to visit it. and I have heard on this video that twice they did say if they did open it back to the public they would have to go somewhere elsewhere. So I would say "FREE VIXEN TOR?"

    Look I own part of my lake now it’s gorgeous but it’s mine I don’t want anyone disturbing it or polluting it and I’ve even had people go walk through my yard and set on the dock I built like it’s a park it’s annoying people coming and asking if I can fish plus she is correct if something were to happened to somebody like they drowned swimming or their kid fell in I could be liable

    I understand why the public would be upset but i cant stand the shameless attempts to play the victim. Calling the climbers sitting ducks as if that wasn't a conscious decision they made and a position only they chose to put themselves in. If someone starts climbing the side of your house and you cut the rope, that's really on them for trying to climb up someones house. Whether they like it or not, they are all fully aware that they're climbing private property, and actively trespassing when they do - just because they call it a protest doesn't magically remove them of all responsibility.
    I don't actually agree with the landowners decision at all, but how can you expect them to trust the public to use it if this is how they behave when they're asked not to? Its not a stretch to imagine that someone willing to climb without permission, confront the landowners and act like they have been forced to trespass on someone elses property - is exactly the kind of person who would try to sue should they hurt themselves one day. The way they behaved just reinforces the landowners concern of getting sued and blamed should something go wrong, because apparently these people cant accept any responsibility for their own actions.
    In an ideal world the landowner would have no real reason to refuse access, but we don't live in an ideal world and unfortunately all community activities now leave someone liable to being sued into bankruptcy. People can't afford to offer a service anymore, and the land was likely being sold specifically so that the government and local council would no longer have that liability hanging over themselves. So blame the government for selling the land, and the legal system for creating a huge vulnerability when it comes to these public spaces and the idiots who refuse to accept responsibility for their own safety when attending them.. But you can't blame the average person who just gets caught in the middle and has no other choice but protect themselves from this mess.
    Its the same reason why most communities across the UK no longer have anything at all, because the people who used to organize them did so voluntarily - but are now subject to huge lawsuits just for trying to do something nice for people. They all gave up and now you can only have these things if a business is able to charge you so much that they can afford the risk of being sued. Forcing what used to be humble activities ran by and for the community, to become privatized businesses charging £50 a head.

    I think there should be a new law where no one should own any Tor on Dartmoor. They are places where all visitors who have come down for their holiday's and go to these beautiful sites, and to climb on. Vixen Tor is not the only one near by there is Little Vixen Tor (Swallever Rocks) and another Tor called Rouge Tor + another Tor that is called Bel Tor. And I think that the Farmers on Dartmoor are not very fair on letting us visit their Tors. (Sheering is Caring) How much more does the Farmers want on the Moor? do they want every scrap of land? just for their self's and not sheer with anybody else in Public. And Vixen Tor is just like very other Tors on Dartmoor and I feel that it is invisible to the Landowner in other words not seeing what we see. No one should own a Tor on Dartmoor they all belong to the English Heritage so I they should just open Vixen Tor back up to the Public and not to be private ever again. So I say Vixen Tor is all to enjoy.

    I still don't see the problem here, the place was offered anyone wanting to buy it, why couldn't the walkers buy it if it was so important to them? As long as it's a place put on the market, it's not a public one, end of the story. Asking her for permission was ok, but it seems that none of them tried to understand her insurance problem either. Just find another place to go on a walk instead of harassing and trespassing.

    I think that the liability issue could easily be solved and i feel the attitude of the landowners is rather selfish. Those of us who are blessed with the assets to purchase beautiful things should, in my opinion, be willing to share it now and then...maybe once a month. An aunt doesn't own her nieces or nephews and a parents rights are absolute but it would be nice to let family members who loves the child, those that have shared a bond, to see them sometimes regardless of things like divorce etc. It is the right thing to do. This ladies attitude is also difficult. She isn't doing anything illegal but she is awfully rude and without sympathy.

    It is her land. She has had legal advice that she could be liable for any injuries that the public incur. She also stated that she needs that land to farm to make her business viable. Not sure I would want strangers who don’t know how a farm is run, wandering around my property. I thought a compromise could be opening it one day a week or a month, and having people be aware of a disclaimer. I also googled this and it is still her land with no public access. Interestingly there is a guy called James (Jim?) who has a bordering property up to the Tor who is running a farm stay called Vixon Tor Farm!

      When you have animals grazing that same plot of land the problem is more than people getting themselves injured. Their animals need to be a priority. Even well meaning people hiking/climbing forget to close gates, drop trash, or fed "treats" animals that sicken/kill them. I would never give open access to a pasture my livestock are in.

    Unfortunately Bobs starting offer was far too low , he should have plumbed for at least 1 weekend per month for 6 months of the year to be agreed by both parties and negotiated if necessary down from there ...............a one off is next to nothing other than a future building block, perhaps even trade for some unpaid lambing farm work for access ...........that would have been more of a result ...............land owners are just custodians and they should be prosecuted if like these land owners who desecrated a national historical monument with tar oil and paint and barbed wire

    In America someone would have been shot and the shooter acquitted. Idk the law there, but if you post No Trespassing signs and someone trespasses and gets hurt, youre not liable. It does sound like she's a karen killjoy more than anything else..but you dont have the right to say "Screw property rights, Im going to go where I want".     The government should undertake a massive project and move the historic rocks to a publicly accessible area then charge back the cost to the residents that blocked previous access and then also charge them with agregioius anti social behaviour. The charges should be enough to bankrupt those people for costing the citizens and government, also the man that was previously trespassing should be charged 50 dollars
