    In our case the concealed internal water pipe line from kitchen to toilet fixed by the builder at the time of construction is rusted now and due to this the water seeps through those rusted water pipe result in leakage on the down floor ceiling. This is a major expenditure estimated cost is 35 thousand. Who should bare the expenses. As per mutual talk the down flat owner is not prepared to share half the estimated cost. Or cost after actual repair. Pl reply stating the bye law. What to be done in such cases.

      In the limited capacity of my knowledge, In such cases many times Society intervenes to resolve the issues and some time also contribute some fund to resolve issues.
      Try to resolve the issue mutually. You can ask to contribute on mutual understanding basis but you can't force. This is my personal view. Thanks

    I am staying 2nd floor leckages from 3rd floor . Bathroom but he is not agree to repairs i am agree to contributing 50% & 50% but he not agree . & society saying we are not responsible . Internal leckage who is responsible. Complient to police station they are also saying same . Complient to kdms . Municipality. They are also saying Same things. Who is

      Greetings! Simply if source of leakage is from 4th floor then he has to get it repaired. If by any reason his financial condition is not good then below flat owner help him to resolve the issue by paying some part of expense from his pocket. Actually both have to resolve such issues mutually. Thanks

    My society dont repair terrace leakage they want to make me suffer. The president demand 1.50 lacs from me. This society comes under SRA which has been register in 2018 under Maharashtra Society act. Several time I requested them to come home and see but they didnt take cognizant of matter. They always avoid problem by saying meeting would be require to held which never takes places ever. I raise complaint to SRA office also but in vain. Pls guide what should I do?

      In the Capacity of my knowledge, I like to mention that Society should get repaired Terrace. It is their responsibility. Society should also get repaired the ceiling of top floor flat, if source of leakage is from terrace.
      Bhushan Jadhav Saheb, You can make complaint to Managing Committee and keep the acknowledgement with you and make complaint to local Corporation and as well as Dy. Registrar also. Give second as well third reminder. Dy. Registrar can hold hearing on this issue. and if he give his order in your favour than even you can make police complaint also.

    Sir, my shop is their in chs and my shop does not have water and toilets, but because of society toilets pipe and water pipe has gone through my shop wall has become spoiled from out side and inside and some green grass has came so, who should pay for my shop wall society or myself??????? And who should repair my shop wall from inside society or 50/50

      If any Society's common pipe line is passing through your shop or backside of your shop and due to it's leakage your wall is getting damage then Society will repair it from both side inside and outside.

      Actually Society will approach to the flat owner if the Source of leakage is from any flat and flat owner's responsibility to get it repaired. If flat owner is not ready then in emergency Society can get it repaired as common maintenance.

      Vaishali Chandane Madam, I like to suggest that you make complaint to Secretary about the same in writing and take the acknowledgement. Repeat the procedure in 15 days as 2nd reminder and later 3rd reminder, even if the Managing Committee not responding to your complaint then take a report from panel Structural Engineer about leakage from upper flat and make a written complaint to your local corporation. I also recommend you to resolve the issue by mutually discussion with upper flat owner, this is the best way.

I will say in the capacity of my knowledge that Society should repair external wall, it is their duty but for the internal walls of flats Society may give reasons. This is reality. I feel Society Management should maintain their building structure in such a way that members will not suffer with such leakage problems.

    There is leakage in kitchen ceiling from upper floor. Who should bear the cost as per the bye law. Upper flat owner or 50-50.
    If it is 50-50, he is not paying cost of my ceiling damage.
    My point is you pay for your flat repairing and I will be pay for ceiling or share cost of both repairing 50-50.
    Please suggest.

      Sir,
      If the matter has disputed, please appoint a Structural Engineer and take a report from him about the source of leakage then write a letter to the Society and give cc to the member staying on upper floor with the structural Engineer report and take an acknowledgement. If both are not ready to attend the complaint then you can complaint it to the Municipal Corporation they will serve notice to both.

      Sir,
      You can use any of the way for the submission of the letter, either personally or by speed post. If you send it by speed post please take care of acknowledgement receipt of Speed Post and take print of Delivery Report from the Indian Post Website which you can use as proof of delivery.
      If the leakage is from upper flat then upper flat owner should get repaired the fault available in his flat. Compensation to lower flat damages both owner decide it mutually some time Society also contribute to help the lower flat owner.

      Dear Rush Tatya, Terrace is a common area no one can use it for personal benefit. Managing Committee or General Body can allow any member for for some function or activity if their is approval of General Body for the same.

    Sir a pipe which connects our flat bathroom with the society main pipe is leaking. The pipe is external. Who is supposed to bear the cost?

    Sir mera flat top floor par hai... Meri ceiling par leakage ho raha... Society nahi karwa rahi... Bol rahe hai humko hi apne kharche par katwana padega.... Common terrace se pani hamari ceiling mai aa raha tho hum kyo apne kharche par kare... Abhi kya action le saktae hai hum.... Humne society fund mai bhi fund diya hai.... Society nahi katwa rahi...       Dear Sir/Madam,
      As per Bye-Laws no. 159 (9) Housing Society should take care of Terrace of the Society and because of terrace leakage if Top floor flats are suffering then it is responsibility of Society Management to cooperate with top floor owner and get done the repair work of terrace and as per Bye-Laws no. 159 (17) Society Management should get repaired the ceiling of top floor flat.

      As Per Bye-Laws no. 159 (9) Terrace of the building should be maintained by the Society and Bye-Laws no. 159 (17) says if Top floor flat having leakage issues from terrace then Society should take care and get repaired ceiling of top floor flats.
