The cops are meant to be trained professionals so just as you don't judge every dog dangerous because it barks at a postman you don't judge a person shouting at an uninvited threatening intrusion.       Qualified Immunity does not protect police if they are in the wrong. It ONLY protects police if they are acting within the law and if they are acting in good faith.
      This means if a cop acts within his scope of duty, within the law, and with good faith the cop has immunity from lawsuits for damages unless the plaintiff shows that the official violated "clearly established statutory or constitutional rights.
      It does not mean the cop can do whatever he wants and get away with it. Like most think.

      Not totally accurate. If there is no warrant the police are able to proceed onto/into someones property if there is an immediate concern for life or if a crime is in progress. That being said, this was unconstitutional and sickening.

      They don't need a warrent to enter your open property. Been dealing with this for 2 years now.
      Executed my livestock guardian dog because they were near my coups and doggo was doing what it was trained to do. Then had the gull to try and charge me for assault on an officer....while they were in my fields...at 4 am. Without a warrent.

      I get what drove my family over in America to join the military and defend their freedoms, but... what are they even defending now? And what was all that blood and tears and sacrifice for, if this is what they give you in return?
      (Not to mention your VA medical system, but that's another whole discussion.)
      It sickens me though, and frankly... I respect the hell out of OLDER US military veterans. I'll leave it at that.
      Edit: It's like the old saying goes: the most important thing you can ask any soldier in any war is "What are you fighting for?"
      I don't know if the current troops would even be able to answer confidently and believe their own answer fully.

That's the way it is, and I'm always surprised at comments like yours: the reason that these cops get away with this time after time, and keep doing it even after costing a city millions, is that YOU are paying the settlement to YOU, the victim. Get it? No, it isn't fair, is it?
      Instead of that nice new highway everyone was looking forward to, or repairs to the city, or a new school, we pay the victim of the same cop whose salary we pay. The settlement money comes out of the taxes we pay. Did you REALLY think victims of police violence or death would be suing the cop, or the Police Dept.?

      If a cop had said, "I'm going to knock your head off," we'd hear about it all day, but when this old old man says it, we get crickets...
      The Cop is just a human following rules. If someone had just said they going to knock your head off, would you turn your back on them? I wouldn't. Cops are trained to pay attention to threats, as they should. If you don't like the system, i would advise criticizing the system, instead of the individual cops, just like if you don't like a war going on, you should criticize the leaders/generals, not just the soldiers.

You gotta have some kind of understanding here. Also, comparing nazis to everyday cops? You're stretching there... I don't agree with the cop's actions, but at the same time, i know he is in a difficult position. If he listened to every person who told him to just leave and ignored it when someone said they will knock his head off, he wouldn't make a good cop, and might also not survive long. Having said that, I do think he probably went too far, and I even think he should be disciplined, but lets not go and hate cops. They are just humans, just like soldiers are also humans.

      The police officer did not have a search warrant. The officer must leave the property when the citizen told him to leave his property. There was no immediate emergency which would give the officer probably cause to remain on the property.
      The officer should have left the property and come back with a legal search warrant.

    The veteran foolishly believed he lived in a free country with constitutional protections. But seriously, every cop should be bonded, and every use of force reviewed by an insurance adjuster. No bond means you cannot work. If your camera is turned off you lose your bond. A insurance agent will weed out bad cops faster than internal affairs. Also a bad cop can’t just go down the road and get another police job.

    If this was an arrest, what was the charge? I did not hear him tell the citizen he was under arrest. If he caused him to have a heart attack, he may have influcted permanent damage, and is totally liable for damages. Just because you somehow got a badge, does not give you the right to violate others' rights and harm them. Both city and county should also be liable, if he was deputized to operate within the county.
