    It amazes me how the judge has to explain how the law works to a bunch of lawyers who clearly don't know what their doing or they're just playing stupid. Their ignorance and lack of respect for the law astounds me.

      I see the judge and Nikolas Cruz getting together following this hearing. She obviously coddles him and has opinions about how his defense is performing. When she talks you can tell she hopes Cruz is listening and impressed. Cruz should get 20 years for his part in the Parkland shooting, but I see this judge leaning to a more lenient outcome.

      You have to remember this isn't a guilty/non-guilty case. This is a plea-sentencing case. It is these lawyer's job to literally throw anything and everything that sticks to prevent their client from dying due to providing juror doubt. This is what they have to do. Give them some credit.

      @@beckydoesit9331 the jury is the one that will convict him of life or death, not the judge. He’s have a jury trial, but he already plead guilty. His defense is fighting for the death penalty to be off the table, the judge is just invoking the punishment.

      They do know. But as lawyers, they need to try every trick in the book, even playing naive. The burden to proof culpability falls on the government. And that is a tough burden.

      Well, does a swastika on the defendants backpack really have anything to do with the reason why they're sitting in this courtroom? 🤔
      The defense is doing exactly what they're job is. The states job is to get a conviction. The defense's job is to do everything they can to lessen the states case against their client. There is only ONE person sitting in that courtroom who the defense is working for... thats the defendant.

      @Boston Gal I'm aware of the fact the families don't have to be there, and totally understand why many aren't there. But fot the ones who do choose to be there, it has to be hell. And I'm sure a lot of the families not there are listening to this bs at home. I'm not sure what I'd do if I were in their place, but I do know for sure I'd be keeping up with what's going on!

      Nicholas will be sentenced to life in a Mental Institution in beautiful Vermont, he is a victim here and those kids needed to be sacrificed to finally bring to light Nic’s torment and anguish….he will outlive the parents so they too can find tranquility…

      @Boston Gal How can they not be there with what they have invested in this - it is about their child and having what little control they have left since their child's death. It is being their child's voice to make sure this person is punished. It is about trying to understand the unimaginable. It is about trying to forgive someone sick so that they can attempt to live with their pain as they have daily reminders that their child is dead. They don't want to be there listening to all this but how can they not?

      @@lindajames978 A death penalty sentence would automatically trigger the appeals process. I was referring to appeals based on incorrect instructions or rulings by the judge. I wasn’t clear in my statement though so nobody would know what I meant 🙃

      My only problem with the judge is that they didnt get an ugly old dude. Its kind of unfair that he gets to leave jail and see a gorgeous woman. They should put a screen blocking his view of the judge with a picture of balls on it or something

    People have to understand. This is Elaine Bredehoft levels of incompetence. The defense wants to admit a journal as evidence, but doesn’t want to say what to exclude until it’s convenient for them to go through it.
    This is rules of evidence 101. It’s truly unbelievable.

    It is extremely funny to me how in another video the defense lawyer stated that they promised the jury they would be completely honest with them, and here they are trying to suppress something Nikolas was very passionately drawing. If your intention is to be completely open and transparent with the jury, show them the swastika. Show them what your client thinks of people who are different from him. Being open and honest doesn't just mean showing endless evidence of his troubled childhood.

    I like that she is trying not to let this drag out . The defense wants to drag this out for so many stupid things . Whatever nick did , whatever he was drawing , whatever he has said , whatever racist comments he has made should most definitely be a part of this case . I find it sick that they don’t care about the N word being mentioned but they want the swastikas covered so the jury doesn’t see them . He drew this on almost everything and it most certainly should be allowed to be shown to this jury. This is who he is and how he thinks and acts . Unbelievable.

      The only thing I could think of is that the witness being cross examined felt threatened by the swaztikas because she identified with the Jewish population maybe? That may be why they want to redact those parts, but like the judge said, that’s not how it works.

      These lawyers have to do what they are doing to be competent. They have to preserve the record. It is a death penalty case, so please keep in mind that these are a special caliber of death certified attorneys. I sympathize with these defense attorneys, it must be extremely hard to defend this defendant. As a lawyer, I think the judge is going an okay job. Not sure she has the experience to oversee a capital case, and it shows.

She is trying hard, but her inexperience does shine throughout this trial. Sometimes i feel embarrassed for her because I know she's trying but fumbling, especially in the beginning of the trial, regarding procedures.

      America has generally similar or same kind of legal methods and laws as in my country and I love learning about how things work and the amount of power the individual states have is really interesting to me.

      Trash Instagram model Judge with a long history of incompetence. She has essentially destroyed any possibility that Cruz will ever get the death penalty. Mark my words, even if Cruz is given the death penalty after this hearing, he will likely never even get killed by the state. This case will just get thrown through appellate court until Cruz dies of old age in prison.

      I think most of us have had enough of the defense, this is a joke to prolong the inevitable! If it was up to me, he should be put to death as he clearly shows no remorse for his crime nor has he shown any empathy for the victims or their grieving families. He is a total loser that will only go on killing if given half the chance. I do not buy his sob story either as he made a conscious choice to KILL as many children and teachers as possible when he was 18/19 years old? At that age you KNOW right from wrong! Enough already, get on with the sentencing!!!

Lawyer says we should bring it into evidence & then decide if it’s actually evidence the jury will see next week. That’s not how this works! They look disorganized & it’s embarrassing.       The defense is NOT trying to prove his innocence. They're trying to argue life in prison vs the death penalty. Could you sentence someone to death? End someones life like Nikolas Cruz did? I was for the DP until i thought about being on a jury and essentially playing god. I couldn't say - he deserves to be killed. Everyone in the US is entitled to a trial. It doesn't mean the public defenders think someone like this is innocent.

The defense for the last 4 years has been buying themselves time and the judge has had it. they think they have so much time, they’re sitting talking to the judge like they are not in a court room and talking to one another when the state is speaking to the judge.       I see the judge and Nikolas Cruz getting together following this hearing. She obviously coddles him and has opinions about how his defense is performing. When she talks you can tell she hopes Cruz is listening and impressed. Cruz should get 20 years for his part in the Parkland shooting, but I see this judge leaning to a more lenient outcome.

      This is how trials actually work. It’s not like in the movies. I’m in law school right now. They are basically arguing about admitting certain evidence because the defense is arguing that certain parts of the paper will unfairly prejudice or result in inappropriately emotional responses from the jury and that the prejudice is outweighed by the probative value. The court is saying that the probative value is not outweighed. These kinds of arguments happen in every trial.

      I felt like the preschool arguments were bs and a waste of time. There are so many other cases where you could’ve argued insanity or a developmental disability. But to go back to his first 3 years of life? Waste of time, no one cares if he punched little Timmy when he was two, only the events directly leading to his crimes. I feel his team is going too far back for the evidence or arguments to even stand. As a preschool teacher I wouldn’t remember 20+ years back clearly and accurately.

      Because when it is a Death Penalty Penalty phase trial the court has to be absolutely certain they won’t make rulings that provide the Defense with Appellate issues… it’s much better to do it right this time instead of after he’s be sentenced to Death and can delay it for years by submitting a multitude of appeals based on rulings, or ineffective assistance of counsel.

      this could be avoided if the state agreed to lock him up for life. the state wants to kill him (I don't disagree), so the defendant gets enormous leeway in defending himself. after he is sentenced to death, there will be at least a decade of appeals before he is actually killed.

      Clearly the state of Florida was too rich for him. He was lucky to have had been adopted by that family imo. It’s as if this is a huge social experiment. In Florida retirees move there because they’ve paid into the system as well (they can do whatever they want in a. Court room for that reason). That state itself had income tax laws for specific reasons we all tend to collectively not want them. Anyway did you know serving life is actually LIFE there for crimes? No getting out in 10-15 etc etc . There’s a reason this is happening and hope to god there is no mistrial for what he did

      Really? Because it's court. Trials typically last awhile. They said from the start it would last about 16 weeks. We're about 5 or 6 weeks in so far. Let me remind you the full scope of this trial- there are 17 deceased victims, over a dozen more that were injured and survived, and hundreds and hundreds of witnesses that are all getting called to the stand. And thousands of pieces of evidence, and tons of video and audio to go through from that day. This is a huge case so yes, it's going to drag out. They have to thoroughly go through everything and present it all to the jury.

      My guess is that they'll end up putting him in Protective Custody. It is the state's obligation that the sentence is carried out exactly as ordered, not to cut him loose in Gen. Pop. to be killed by other prisoners.

    This Hearing to determine Punishment is one where I feel, the outcome is a foregone conclusion. The one who entered a Guilty Plea will never again be free to walk among the free. He should never know any Freedom what so ever. Ultimately he will die in confinement. His time in confinement will be one of constant fear, put him in General Population. Fair and Just Punishment is not possible in this case because I feel this killer was in fact aware of what he was doing, aware of how to enter and depart the scene of his Crime undetected, he was in control of his mental facilities, he knew what he was doing was beyond wrong, and did it anyway. He must be treated as the Killer he is and not a mentally defective person.

      @David Wang nah, I believe human life has intrinsical value and should be respected since fecundation until its natural death. My idealization of what should be done could end up being quite unpractical.

      @David Wang I'm not pro rehabilitation>punishment, but my (very) impractical idea of what would be more ethical is inmates being in able to work while in jail to pay off the costs of it and the rest of the money being saved until they get out.

      It's a trial for sentencing. It's supposed to be fair to the defendant. No way to change this. All the evidence has to be considered.

The courts were backlogged to begin with, both sides were allowed ample time to build their respective strategy’s …. and besides this is yet “ another “ school shootings…. there will be more, obviously we’ve seen this….At this point in the trial the kids are irrelevant the focus is on Nic’s mental status pre & post….

      I mean, the parents have to work. The trial is going to last through October and maybe even go into November. Most, if not all, of them probably don't have the luxury to take that much time off work. It seems most of the parents are showing up intermittently.

All of south Florida seen his social media video bragging about planning the shooting for that day. We’ve all seen the videos. We all know the victims or know someone who did. The victims and survivors also got some great footage that I hope was played in court. They even have to openly admit he’s guilty now but trying to say “it’s not his fault”. These lawyers are brave. They’re going to be finished in south Florida! Time to move!

    This kid was born so twisted that even if he was institutionalized at a young age on up he still would of been homicidal cuz we all know he's not suicidal.....my heart just bleeds for the victims parents have so much to deal with besides their loss of children this has got to be torture it's so long of a trial I have never seen nor remember another 1 like this 1 ❤🙏

      this is one of the main reasons why we should not bully anyone in schools, he might have done something really terrible but people can be literally blamable for their actions towards him, if they only did not bully him and don't poke him even if he is neurologically different, this massacre would have never been happened and those love ones of the families lost would had been still alive today...

      @@MTC008 life is hard wear a helmet.... we all get bullied I get ya feel he got it worse than most but he had a foster family who had cared about him and a brother n sister and that's more that most kids get in foster care he also had a support team in place thru his schools as well although bullying is never acceptable it can't be used to walk in a school to shoot and kill ppl who had nothing to do with him he was pissed at others but sacrificed these kids for the ones who really did pick on him.     Not saying that he is innocent on any way but the way this judge is always arguing on the side of the prosecution should be concerning to those intelligent enough to understand the gravity. When you consider that the prosecution and judge often share the same offices in most municipalities, it is highlighted by this judges obvious bias.

      @ijm1261 another scathing point regarding this mess. Most judges have prosecutorial experience which creates even more bias than what I illustrate. If you got the short end of the stick in a similar situation, you would feel cheated.

      You are confused I think. This is not a trial to find guilty or not guilty. He already confessed to the crimes and the judge has already accepted the plea. The public defenders are appointed to this case. This is a sentencing trial. The state wants the death penalty and the defense wants life no parole. Everybody in Florida knows he did it, even his lawyers, the guilty part is over with, now they need to convince a jury whether he lives or dies. Asking for a mistrial doesn't set him free but it will start the whole process over.
      Both teams have done a good job
