On Sept. 22, 2023, Watts, at 22 weeks into her pregnancy, told Warren Police detective Nick Carney that she, “felt the baby come out and there was a big splash,” while using the restroom that morning. Warren Assistant Prosecutor Lewis Guarnieri said the police investigation found that Watts miscarried the baby while using the restroom and tried to plunge and flush the remains down the toilet, where it got stuck in the pipes. Hours after being admitted to the hospital, Warren police removed the toilet from Watts’ home and took it to the Trumbull County Coroner’s Office, who then had to chisel away at the pipes to remove the fetal remains, according to Guarnieri. During an early November court hearing, the court heard from forensic pathologist Dr. George Sterbenz, whose testimony concluded that Watts’ water had broken early and the fetus was “nonviable,” because the baby was too young to be delivered. Sterbenz testified that no injuries had been committed to the fetus, further stating that the fetus had died naturally before passing through the birth canal. At 21 weeks, Watts’ attorney, Traci Timko, said her client went to her physician who told Watts that her pregnancy, “could not survive, and she would miscarry,” which she wrote on the GoFundMe page. “When the bleeding and the pain from the impending miscarriage got severe, she did the same thing that many women who miscarry at home do. Brittany went into her bathroom, miscarried into her toilet and flushed.” A nurse from St. Joseph Warren Hospital called 911 after Watts came there suffering “life-threatening hemorrhaging,” later leading to police investigating and charging Watts, who had no previous criminal history, with a felony offense. Guarnieri argued in favor of having the case move forward in court, saying that the state did not have to prove fetal viability, citing a portion of Ohio Revised Code that reads, “no person, except as authorized by law, shall treat a human corpse in a way that would outrage reasonable community sensibilities.” Warren Municipal Court Judge Terry Ivanchak agreed, determining there was probable cause for the case to be bound over to the grand jury. The judge stated during the hearing, “There are better scholars than I am to determine the exact legal status of this fetus, corpse, body, birthing tissue, whatever it is.” Timko previously said that no law requires a mother suffering from a miscarriage of a nonviable fetus to bury or cremate the remains. “Women miscarry into toilets everyday. If the state of Ohio expects these women to fish those remains from the toilet and deliver them to a hospital, funeral home or crematorium, the laws need changed,” Timko said, adding that “we aren’t there yet.” She further stated, “Regardless of politics or religion, this matter hinges on the law. It is a travesty that Brittany (Watts) was charged and we will continue to fight.” Her client’s fate now rests in the hands of a grand jury that will determine whether to indict Watts on felony charges, which would take case to the next step of being presented to a Trumbull County Common Pleas court judge. Over the past few months, Watts has seen one of most private, intimate moments of her life become the center of a national debate over the criminalization of pregnancy, but also has been met with thousands of people showing support. “The outpouring of love and support has been humbling, healing and empowering. Thank you to each and every person that reached out. There are no words to convey my gratitude or express how much it means to me,” Watts said. The story reached the eyes of civil rights attorney Ben Crump, who retweeted Watts’ story to his more than 600,000 followers on the social media platform X and it received more than 40 millions views, with people voicing their outrage. Many women also shared similar stories of having miscarried into a toilet, wondering out loud on the social media platform whether they too could’ve been prosecuted for their miscarriage. “The global response to Brittany’s situation has been extraordinary, marked by an overwhelming influx of emails from women who have experienced similar circumstances. These women, who have endured the heartache of miscarriages leading to outcomes akin to Brittany’s, have found a resonance in her story,” Timko said. Watts’ attorney shared some of the stories from women who have identified with Watts. A New York woman told Timko via text message that at 12 weeks, she had gone to a Syracuse hospital with her miscarried baby wrapped in toilet paper. When a nurse refused to handle the remains, the woman said she also tried flushing them down the toilet, an experience she told Timko has left her suffering from PTSD. In another text message, a Warren County woman told the attorney that in 2021, she miscarried at between 12 and 14 weeks. Having bled out over a toilet, she felt her baby pass through and grieved it, she told the attorney, “I had no idea how to proceed and proceeded with disposal through the toilet and then was rushed to the hospital for an emergency D&C to stem the bleeding,” she wrote. “The establishment of a GoFundMe campaign will enable Brittany to leverage her story as a powerful tool for advocacy. This initiative aims to foster legal reforms and enhance educational efforts, with the ultimate goal of ensuring that women in the future are spared from enduring similar experiences,” Timko said.

As a mother of 4, I personally could never terminate a pregnancy. I was told to with my first child by a doctor when I was pregnant with her because she was diagnosed with hypoplastic left heart syndrome. Grateful to say she’s 18 years old today. HOWEVER- I would never ever ever ever ever ever EVER judge a person in this woman’s position!!! How dare they block her!!! The layers of TRAUMA are horrifying to think about! Heartbreaking!
My story. I’m a former CCU nurse . Before I discovered I was pregnant I discovered I had cardiac problems . Both my OB (a missionary) and my cardiac doctors strongly suggested to abort. My baby was safe. I was told I could deliver, but I would probably die soon afterwards and leave my newborn and other 2 boys without a mother. Obviously I survived, but now dealing with major cardiac problems. I strongly believe I had the right along with my doctors to make an informed decision. Medicine isn’t 100% accurate, but usually 95% accurate
Back in the dark ages before Roe, doctors routinely advised patients not to talk about being pregnant during the first trimester, particularly if problems seemed possible. Now we know why.
It’s ridiculous that they keep passing these anti-abortion laws. Especially when it should be allowed in this case. This women is literally having complications and the baby will not survive. It’s like republicans would rather you pass away instead of having an abortion to save your life.
Nope, I am voiting red.. And the men and women of Texas pro abortion, they are free to move to a blue state, vote blue and pay lots of taxes. Leave Texas alone.
The case of Kate Cox is EXACTLY what we were concerned about when this law in Texas (and other states) passed. And what did the pro-lifers say to us then. They said “miscarriage care is not the same as abortion. No one will be denied life saving care.. they are the exceptions.” Then explain why women are suing in Texas and need to go before a judge to get life saving medical care for their pregnancies..?
@@StaceyBeryl No. interesting you ask because under Roe there was a limit to abortion. Viability. Now these poor women don’t even have a choice when their lives are on the line.
@@Chelseyandfam Wrong. There are states that were doing abortions up to delivery for ANY REASON. This woman's life is not on the line. She was pregnant with a child who had Trisomy 18. I love when people say they are pro life, but don't realize that sometimes you need to make that medical choice to save the woman, or knowing you are having a child who will pass in hours or days after birth. And I do not see people trying to adopt children that parents cannot take care of who cannot abort or make that choice.
I’m hoping it’s freedom, because there’s some people who frequent this TH-cam channel that would love government and religion to intertwine and that’s a huge no.
Alyssa still wants "some limitations" But the problem with that is you are _still_ involving the government in what is a medical issue. You are asking politicians to make medical decisions which is ludicrous. You can't make blanket rules and laws because women are not machines - every woman, her body and her pregnancy will be different. Leave these matters in the hands of medical professionals!
3:40 Yvette ended the argument there. I’m Canadian and in the 70s the Liberal government legalized all abortion but made a very clear point to legalize it as a HEALTH procedure not as a moral question that needed to be answered. And that’s why the anti-choice parties here have continually failed to repeal or adjust the law.
The reason is those people believe it’s murder. If you want to be pro life and not allow abortion, you need proper policy showing the life of the mother is safeguarded, which this Texas case is proving it clearly isnt
Just because one believes something, however devoutly, it does not follow that one has the right to impose that belief on others We are not a theocracy.
I hold certain conservative values, and a Christian, though I honestly can't remember a time when the republican party itself actually did anything "beneficial" for mainstream society, let alone for women. They've ran on the same platforms since the 1950's but don't have any actual NEW ideas or proposals.
As a man, this is so heartbreaking. I would never want to endanger the life of a partner, I would want to have a healthy pregnancy and ultimately I would make that her decision.
_Roe v. Wade_ ruled that state criminal abortion laws that except from criminality only a life-saving procedure on the mother's behalf without regard to the stage of her pregnancy and other interests involved violate the Due Process Clause of the Fourteenth Amendment, which protects against state action the right to privacy, including a woman's qualified right to terminate her pregnancy.
Can we just agree as an audience that we know that Sunny is Catholic and does not personally support abortion but she understands that it’s not her place to impose her belief onto other people, and she doesn’t have to bring it up every time? I appreciate that it’s a reminder of how we can coexist on this topic, but my goodness this repetition has taken up a lot of airtime over the years.
The ruling calls into question whether the decision could deter women in similar situations from seeking a court-authorized abortion. Cox’s lawsuit is believed to be one of the first attempts in the country by a person seeking a court-ordered abortion since the Supreme Court overturned Roe v. Wade last year, according to the New York Times. While the center did not disclose more details of Cox’s plans, she had received “offers to help her access abortion elsewhere, from Kansas to Colorado to Canada,” its statement said.
On Thursday, a state district court judge sided with Cox and granted a temporary restraining order against the state so she could legally have an abortion under the state’s “medical emergency” exception. Texas has a near-complete abortion ban with narrow exceptions. Texas Attorney General Ken Paxton, a Republican, quickly threatened criminal prosecution against doctors or hospitals who would help facilitate the abortion, saying they could face charges even after the 14-day temporary restraining order. CNN has reached out to Paxton’s office for comment. Late Friday night, the state’s high court temporarily blocked Cox from obtaining an abortion while it reviewed the case. In its ruling late Monday, the Texas Supreme Court - comprised of nine Republicans - called on the state’s medical board to provide more guidance on the “medical emergency” exception at the heart of Cox’s case.
The same legal group representing Cox - the Center for Reproductive Rights - is also representing a group of women and physicians before the Texas Supreme Court in the lawsuit seeking clarity. The state argues the law is adequate. Cox has been to the emergency room four times in the last month due to symptoms like severe cramping, diarrhea, leaking of fluid and elevated vital signs, her attorney said. And because she’s already delivered two children via C-section, her physicians have warned she is at high risk for complications, including possible uterine rupture in future pregnancies. This pregnancy would need to be delivered via another C-section, which Cox fears could jeopardize her health and future fertility, her attorneys said. Additionally, the fetus has trisomy 18, a fatal genetic condition sometimes called Edwards syndrome that can cause heart defects and other organ abnormalities. In at least 95% of cases, the fetus doesn’t survive full-term and the pregnancy ends in miscarriage or stillbirth, according to the Cleveland Clinic.
As his office has done in the broader case on this issue before the state Supreme Court, Paxton’s attorneys also argued “a fatal fetal condition does not meet the medical exception,” adding the exception applies only to the mother’s condition. Paxton’s office also said none of the physicians who have treated Cox in the Dallas-Fort Worth area have recommended an abortion.
Dr. Damla Karsan, a Houston-based physician - and a plaintiff in the other case - is cited in legal filings as having reviewed Cox’s medical records, recommended the abortion and agreed to provide the medical care.

You need to go back and study theology befores saying such a stupid statement. My church doesn´t allow abortion under any circumstance. If the mother´s life is in danger she can get the health care she needs to get healthy. But they do not include abortion. There is somenting called the "act of double effect". It means that because of the care, lets say she has cancer and she gets quimio, and because of the quimio she has a miscarriage, she did not had an abortion, the baby died because of an unwanted consequence of the quimio. But you can´t do directly an abortion, even to save a life.

A year ago I asked a lot of questions about HOW the states were going to enforce all of these laws. I brought up valid points and basically got no answers at the time. I’m getting those answers today. One of my questions was how do these states with very restrictive laws or outright bans intend on stopping women from getting abortions and especially if medically necessary? I didn’t get very many answers because anyone with common sense knows it’s impossible to do so without violating women’s constitutional rights. I guess states like Texas plan on doing exactly that which means this whole mess is going to wind up right back where it started….the Supreme Court. The state of Texas has no right to ask this woman to forfeit her personal health and especially considering that her doctor has said the child is non viable. The state is completely out of line in my opinion because their not doctors and have no right to ask this woman to risk her health. As for the young woman who is being charged criminally for having a miscarriage I truly hope that case winds up in front of the Supreme Court as well. I ain’t no lawyer but this is WAY out of bounds and needs to be addressed in a legally strong way. Millions of women have miscarriages and there is no way to know when or where it happens. AND every woman needs to remember these legal messes and in the 2024 election vote accordingly.

Brittany went into her bathroom, miscarried into her toilet and flushed.”
A nurse from St. Joseph Warren Hospital called 911 after Watts came there suffering “life-threatening hemorrhaging,” later leading to police investigating and charging Watts, who had no previous criminal history, with a felony offense. Guarnieri argued in favor of having the case move forward in court, saying that the state did not have to prove fetal viability, citing a portion of Ohio Revised Code that reads, “no person, except as authorized by law, shall treat a human corpse in a way that would outrage reasonable community sensibilities.”
Warren Municipal Court Judge Terry Ivanchak agreed, determining there was probable cause for the case to be bound over to the grand jury.

Let's make it easy-peasy: VOTE BLUE! The GOP needs to get out of women's bodies!!!!!
No. If women in Texas want abortion, they can move out to a blue state, pay a lot of taxes to fund illegal inmigrants and all the woke agenda. We are going to keep TX red.
Imagine going through the pain of losing a baby through a miscarriage and having to go to jail on top of that! It's beyond inhumane. VOTE BLUE! 💙
It is inhumane, but voting blue (or red) won't protect us. Dems promised to codify Roe and haven't for decades. Vote third party.

Forcing a human being to carry out an unwanted pregnancy is beyond inhumane. What is going on in the US? Why are people putting up with this??
I’m sorry, you act like pregnancy is a virus you “catch” and is brought upon you without you having a say…

There is one thing to be against abortion, but to go after a person that might lose her baby and also her life, and potentially lose the chance of being a mother forever? What aspect of this sounds pro-life to anyone, can I ask?? He's just being spiteful and, being the Attorney general of a state, he should know better. It's blatant abuse of power.

Well said Whoppi as always 👏
Get out of my uterus...
Why would any woman in Texas choose to start a pregnancy when she now knows that she will not be medically protected should problems arise?
These "judges" overruling these decisions need to have their faces, addresses and family members plastered all over the media. We need to see them.

It is political MURDER of women!
Women and yes Men of Texas, next year is an election -- PLEASE VOTE THESE JUDGES and Representatives OUT! Many are up for re-election.
Nope, I am voiting red.. And the men and women of Texas pro abortion, they are free to move to a blue state, vote blue and pay lots of taxes. Leave Texas alone.
So agree with the ladies…
The case of Kate Cox is EXACTLY what we were concerned about when this law in Texas (and other states) passed. And what did the pro-lifers say to us then. They said “miscarriage care is not the same as abortion. No one will be denied life saving care.. they are the exceptions.” Then explain why women are suing in Texas and need to go before a judge to get life saving medical care for their pregnancies..?
And then a politician files an appeal with the state supreme court to overturn a lower court's decision granting life-saving medical care.
So do you believe in abortion for any reason at any stage of gestation?
@@StaceyBeryl No. interesting you ask because under Roe there was a limit to abortion. Viability. Now these poor women don’t even have a choice when their lives are on the line.
@@Chelseyandfam Wrong. There are states that were doing abortions up to delivery for ANY REASON. This woman's life is not on the line. She was pregnant with a child who had Trisomy 18. She could have delivered the child with no complications to the mother, none. What's next? Aborting children who are autistic? Dyslectic? Wrong color hair, eyes or gender?
But the sad thing about all of this some of these women who disagree with this law will still go and vote for these idiots
The one star on the Texan flag represents its rating for sensitivity and common sense.
Well God forbid, if she dies because of the pregnancy, her family needs to sue the state for wrongful death and negligence on her behalf.
The government needs to investigate the governor of Texas!!! Stop putting women's lives in danger😢😢

Why are we going backwards in life? I would be damned if they refused me about my body and if it is prolife, prolife for the mom.
I love when people say they are pro life, but don't realize that sometimes you need to make that medical choice to save the woman, or knowing you are having a child who will pass in hours or days after birth. And I do not see people trying to adopt children that parents cannot take care of who cannot abort or make that choice.
So sadden by the last in Ohio. I can’t believe she’s facing jail time over a miscarriage

I’m hoping it’s freedom, because there’s some people who frequent this TH-cam channel that would love government and religion to intertwine and that’s a huge no.
Honestly, where in the Bible does it explicitly say you cannot have an abortion ever?
Alyssa still wants "some limitations" But the problem with that is you are _still_ involving the government in what is a medical issue. You are asking politicians to make medical decisions which is ludicrous. You can't make blanket rules and laws because women are not machines - every woman, her body and her pregnancy will be different. Leave these matters in the hands of medical professionals!
Almost every country, that are far more left leaning have restrictions and those restrictions are made from science
I notice in Alyssa's list of benefits she did not say free health care.
They also believe that if she endangers her life by following the Texas Supreme Court's orders to not terminate the pregnancy then it's "God's will".
Dear Pro-Lifers: How many unwanted children have you adopted?
Are these Republicans going to support these children? No. So let's keep this decision in the hands of the adult women. 😢
So glad people finally see the republicans true colors. This ain’t no gods land
Amen, Sarah.
Go through having suffered an ectopic pregnancy…..needed to end the pregnancy to save my life.
Roe vs wade was about privacy. It was never about abortion.

Oh, the same thing also goes for Whoopi paying taxes.
Someone please start a conversation about 'ejaculation'. Are all of these anti-abortion people pro ejaculation? Also make the Anti-Abortion folks explain what an 'Ectopic' pregnancy is.

Sunny is incorrect - even the Catholic Church recognizes abortion when mothers life is in danger.
@@andrear7181 if mother’s life is in danger, and they have to remove the uterus with the baby, hence terminating the life of the baby but saving the mother’s life, it is found ethically acceptable by the church. So there are exceptions even in the Catholic Church!
@@agnesostrow yes, but the abortion is consequence of the procedure of removing the uterus, that is the "act of double effect". But what the women in Texas wanted was an abortion directly, not as a side effect of another treatment that could cause abortion.
The Catholic Church doesn´t authorize any act that has the direct consequence of the abortion of the baby.
