Definitely a power play. Probably he was hoping to scare you into a 50% refund to avoid legal issues. He didn't have a leg to stand on since it was stated in the contract about the brands.

LOL that guy's a maroon. So many A/C units, mini-splits and water heaters are made by just a few companies and the distributor slaps on the appropriate label before shipping. My Takagi tankless is the exact same as AO Smith, and the place I got it from just stuck the Takagi labels (badly, they were all crooked) on the unit before it shipped. (Oddly, as the Takagi branded one it was about $100 cheaper too.) The Mitsubishi and American Standard are both made in the same plant with different labels.

      Sad is it not?
Our government help create these monopolies and now we have the illusion of choice. Nearly everything is made by the same handful of companies. There is I believe some 6 companies that make some 20-30 brands of Hvac units. Many all made in the same factory as you said.

Literally just had my first issue with threats of legal action between me and a customer. Her contractor agreed to pay what John Moore quoted as an $11,000 quote for cleaning her unit, he also agreed if we installed a new unit he'd pay us for what they quoted. We installed 2 XV20i Trane Condenser, coils, and furnaces. Then the contractor refused to pay us the 11k and now, since i didn't have an agreement with him, I am going to have to threaten her with a lien and a lawsuit to pay our invoice. This shit makes me feel sick.

@@SurfBrosHVAC oh yeah she paid the difference and he was to match what the other company quoted to simply clean it. 36 was the total for 2 new units and new ductwork. Still I believe it was a really good deal since equipment and materials probably cost me 22-25k.

If you write your contracts the way you explain and can show that they are the exact same equipment with a model / manuf. cross reference and you install the equipment, you'll be fine. I get this from time to time. If the customer requests a specific model / brand and its in writing, then you put in what is on the paper. otherwise, the court will typically dismiss it.

Yeah it's just weird because up until this he was an awesome customer. I know he knows all this and I had my main contact from within Mitsubishi confirm from his official email that they are the same product but he still wants the other one. Buyer's remorse I think but who knows

That happens a lot man. Over the years I’ve had lots of people complain or want money off. Once they see your willing to continue to come out and handle their “problems” they give up. They’re just looking for money off or the in-laws or wife’s brother comes to visit and they say oh I would never get that I would get this. It’s amazing how much run around I’ll get. Handle everything then a year later they call you back for more work or give you a referral and they’re very happy. Think people just try to get some money off or have a little buyers remorse, they get over it and life’s back to normal

I suspect he felt he paid too much, after talking to his “master HVAC buddy, neighbor, cousin”.
And was talking his way to a partial refund. But started a little too aggressive and nitpicking nonsense. I had a few similar stories where customers basically felt they paid too much and wanted a partial refund. They never say that directly. Just remember it will cost them money to get a lawyer to sue, most ppl make the threat do actually follow through after realizing cost and headache. I have had ppl send letter from their lawyers to my business, and when my lawyer contacted the opposing law , never got response. Hold ur ground, u will be fine.

Back in 2008ish this same exact scenario happened with my parts. They ordered a York, but got a luxaire. My parents did not care, as long as it cooled and heated the house. They were made by the same company. People are dumb. That same hvac unit is going strong. Except it had to get serviced 2 years ago. A weedwacker hit the line set, and that had to be replaced

Could you please post both part numbers? A 3 ton unit on a 20 A circuit is pretty amazing. As far as the American Standard thing, this should blow over. The new company is METUS (Mitsubishi Electric Trane United States) obviously Trane is where the American Standard comes in. It’s clearly a Mitsubishi unit.

      Trane/AS model = NTXAMT36A112AA & NTXSKS36A112AA
Same guts just a different model to meet their sku system needs. Mitsubishi is actually no longer manufacturing JV models until the new refrigerant phase out. So Trane and AS are starting to sell Mitsubishi model numbers when the Trane/AS model units run out.

It was only $300 so it wasn't really worth pursuing. The way I met the guy though was doing work for the business he worked at. Next time I was there for a maintenance I called him out in front of all his coworkers and he paid me cash plus extra. A little public humiliation works wonders. I was very direct and loud in front of everyone about what happened and he was like a deer in the headlights shocked that I was calling him out
