I don't think they could technically use him, since they've been playing with a rule that they have to use one starter from every (current) team and there's only 5 starters. However, I think they could have justifiably used, say, Billy Wagner or Octavio Dotel.

My suggestion for a draft like this would be that you are permitted to choose a Houston SP in place of another team, but then you must take a reliever from the missing team.
