      The lawyer seems like a mental fool showing his teeth after every sentence unnecessarily. It shows he is doing nothing but wasting time of the court by not being clear and straight forward with his argument. Just look at his attitude tilting his head sideways and smiling like a fool. I mean i would be annoyed as hell if someone behaved that way. What a fool this lawyer is and just looking at this video made me angry.

    Under no circumstances should the judge have used words like "shut up" in that tone. In fact someone who cannot control his emotions in such a manner has no business being in such an exalted position.

      Please see the circumstances under which the judge literally lost his cool... The judge is repeatedly telling the counsel to read section 10 from the police act per se and not the findings of DGP.. Still the idiot counsel is repeatedly annoyingly quoting the DGP... For a judge who is delaing with hundreds of cases daily.. It is not uncommon to get triggered by this irritating act of the counsel

    My prima-facie opinion based on the portion shown in this video:-
    1. No doubt that the lawyer came unprepared. But the Lawyer is also an officer of The court. The lawyer was extremely polite. If The Honourable Court itself abuses its officers by yelling at them, it will create an atmosphere of fear. Hence the way The Honourable Judge shouted at the lawyer is completely uncalled for & inhumane.
    2. It's easier to remove a Prime Minister from his post than a High Court or Supreme Court judge. A High Court judge can be removed from the post only through an impeachment in the Parliament. Thus High Court Judges are vested with huge power & are well protected. So such power has to come with sense of humility. In my opinion, this judge needs to be sensitized by The Honourable Chief Justice of India on controlling his anger.
    3. As a student of law, I would like to give technical answer to the best of my ability to the question asked by The Honourable Judge - "How can a person approach a court for direction to the government officials based on some directive issued by DGP which were not adhered to by another official under DGP?" Ans - If there is incorrect use of the discretionary powers by a government officials, a person may approach The Honourable Court for a remedy by filing a writ of mandamus.

      The Judge has been asking the lawyer what provisions of the act or statute has been violated by the DGP .But the lawyer has been repeating throughout that the DGP has violated section10 of Bihar police Act 2007.But what's section 10 of the Bihar police Act 2007, the lawyer must read out in the court.Very sad he doesn't have the minimum knowledge of how to proceed in a High COURT

      Bro that judge was remarkably patient. He shouldn’t have yelled, but the lawyer must be held accountable for being unprofessional, violating the fiduciary duty he owes to whoever he is representing.
      But yes, if the DGP’s circular has the force of subordinate legislation and the officer under him was ultra vires the circular, Article 14 would be violated and a mandamus can be asked for

    Judges are human beings too.
    I think he seems to have been affected by the number of imposters and frauds that he has to deal with on a daily basis. It has become hard for him to be able to trust anyone. That is why the judge is trying to set examples on any such account. I sympathize with him.

    So in simple what I understood is lawyer was highlighting the rules laid down by igp where judges were trying to explain the lawyer that his rules doesn't effect the court in anyway...the judge warned once but this lawyer didn't get the warned messages well...when the lawyer spoke about igp for second time judge lashed out at him like Roadies raghu 😂

    The lawyer was showing the order of police DGP again and again while he should have read the act regarding the matter. Honorable Judge tried him to understand but he didn't. That's why it's happened. That was right by the Honorable Judge to be threatened lawyer.

      It's called checks and balances. Each branch of government checks on each other to maintain the separation of equal power. For example, the judiciary can check the executive and legislative via judicial review. But the main goal of all of this is to safeguard the independence of the judiciary from any interference.

    I think the judge should not be so arrogant. If the lawyer didnt came prepared, the judge could reject the appeal. The lawyer mentioned the section which was in the circular. The judge shoukd have asked the court staff to take.a printout of the mentioned section.

    People are commenting based on their knowledge.
    The lawyer needs to know the CPC which is a procedural law for courts to follow.
    When the judge asks a question the lawyer has to answer it to the point and not beat round the bush.
    Lawyers are only interest in money.
    Any normal reading of plaints for a case gives away the intentions of the lawyer.
    The supreme Court has also asked the bar council to redraft the law courses.
    Moreover this is a divisional bench so the waisting of court's time counts

      It can be necessary though if the lawyer repeats the same mistake over and over again. The judges have to ensure that they can give their judgements and get the case done. With the lawyer being incompetent, it is only slowing down the judicial process.

Shout is not the way . if shouting is fine then every industry is ok with it and perform against their employee's . For everything there is a fine or simply removing them from a job or suspension can be done .

    Idiots who don't know law are commenting on the deameanour of the judge and didn't realise that more than 5 times the judge has said the same thing that they cannot pass the order as they are not under the dgp but that advocate kept repeating the same thing like 10 times and wasted precious time of the court. You need to understand this is high court not your home friendly grievance redressal forum. Before standing there you need to know law, need to have etiquettes.

    Isnt there a laptop or something where the judge can pull up the relevant section ? From my understanding this issue is because the lawyer is stating a section but not explaining what it contains and therefore the judge cannot pass ruling as he doesn't know what he is talking about

    If you understand how many cases are there in each state’s high court system, include ones that are pressing and urgent that get delayed and pushed back due to such incompetent lawyers you will understand why the judge has the need to shout. Every min of a judge’s active time matters a lot since they could be ruling on a murder/land grabbing/matters of life and death, while cases where lawyers are unprepared and wasting a courts time pushes such cases back and eventually the judges are transferred to a different state bench and the important cases get pushed back even further.

    Not done full Home Work. Looks like a case of Writ of Certiorari which is issued by High Courts or the Supreme Court to quash the order passed by an inferior court or tribunal after hearing. Mandamus is issued to question the Validity / Authority / Source of Power of the Executive order. But internal administrative matters on the Executive side such as Promoton Transfers and Postings ( herein by DGP , unless established to be done mala fide) are a touchy and thorny issue to many Courts. Similar is the issue of Payscale parity cases, i.e., equal work for equal pay , which has great financial budgetsry ramifications for the Executive side if order is issued by Court. Normally Courts order the Executive to conduct Work Study, Cadre Review etc., and dispose the cases as such.

      To be honest, he has a right to say that. In court, no matter which judge is presiding over the case, you will be subjected to scolding and criticisms from them. So it is the duty of the lawyers to act competently and provide sufficient and valid evidence in their case.

    Maybe this lawyer is unprepared, incompetent or maybe he brought up this issue in a wrong way, form or manner altogether, the case can be politely and lawfully dismissed/rejected. The demeanor of this judge is completely unprofessional, unnecessary, unbecoming of a judge and uncalled for. Why do you have to be an arrogant d*ckhead just because you are elevated to a high status in your career? Such arrogance, pride and egotastic mindset are most often seen among legal practitioners, be it a judge or a lawyer. At the end of the day, any profession under the government's pay is 'for the service of the people'. Please be polite and professional.

    The argument made by the lawyer may be improper but the judge's behaviour is intemperate and unbecoming of a judge of High Court. It absolutely ill behoves a HC judge to say Shut up in the court. The lawyer should have shown the guts to shut down this foul mouth Chakradhari. It seems Patna HC Bar is gutless.

      Reaction was according to the action. The counsel was advised and warned multiple times.
      Looks like the counsel is quite a thick skin.

    Such shouting by the Judge is most pathetic and certainly uncalled for ?
    The CJI should definitely take some cognisance and do something about such episodes repeating.
    Why can’t the judges just passed the order of they’re not convinced by the submission of any advocate instead of shouting in such manner.
    Very pathetic to watch such shouting by the judge.

      Judges are human, who deal with 200-300 cases everyday. It is expected from lawyers as a court officer to make proper arguments and give answer to the question to assist the court without wasting the court's time, it's very precious.
