      Judge does not know medical facts he is just pretending that he knows everything. 1) The term primi gravida means first pregnancy. And he is saying that the doctor should mention fetus in uterus. Primi gravida itself means first pregnancy and pregnancy means fetus in uterus.
      2) there is no protocol to send histopathological sample for bite marks of skin. The government and court should send guidelines to implement such practice to textbook of medical students.
      There are many such things that are not implemented in medical education.
      This pocket is because the education board have not set proper guidelines.
      The doctor report is not nefarious in any way.

      Judges are taught about forensic during thier training. Plus since he is a High Court Judge he might have seen various cases of poisoning and snake bite.

      It is a result of practicing criminal law with passion all your life as an advocate. As almost all HC and SC justices are former advocates. In advocacy you are expected to be master of almost all trades be it Medicine, corporate, white collar crimes, company law so on and so forth.

    It's not surprising that the Justice has a deep knowledge of the medico-legal aspects. As someone who has been in the Courts a few times, they're a matter of discussion pretty much everyday.
    Our judges indeed are a treasury of a lot of knowledge.

      ....nandhi... But many of such practising Advocates are very reluctant to become a Judge for various reasons. I worked for some years as a Stenographer ( by the by I am a high speed Stenographer with 150 wpm in English Shorthand and 75 wpm in typing) in Law Firms after my retirement from Government and they paid me well and treated me well. During that period I came across some Advocates who were unwilling to take up High Court Judgeship and politely refused at the initial hinting of the proposition from THE TOP. By casual talk with such knowledgeable people when chance occurred to me in Events , I understood their side. People see things in different ways. But efforts must be made to roap in such people in the interest of Justice and Judiciary as a whole.

    Always thought Indian judges are pompous, verbose, arrogant, poorly read , weak in faculties of logic & reasoning and with doubtful integrity standards. But this one judge belies all such ideas. Complete respect and best of wishes to him! May we have more such judges in our courts. 😊

      That’s because you don’t have an education in critical reasoning. They are there to make sure the evidence presented and the logic of the lawyers are sound, otherwise anyone will say anything and they’ll have to be live it. If you get your idea of judges form movies and tv like most Indians do please don’t. A lawyer will try every possible tactic to defend his client its the judge’s job to make sure it stands in court. This is why not every monkey can become a judge and not everyone can’t understand what he does

    Being a doctor I am assuming what happened.... Actually in Govt Hospitals these PostMortem are not done by Assistant Professor(which is their duty).. Usually Ward Boys or Compounders or let's say Jr Residents perform post mortem and write the name of Assistant Professor. So basically Assistant doesn't even know anything. And what us the name of the Hon'able Judge?

      Thing is viscera is sent for histopathology in all cases , blood is sent to toxicology but how many times sample reaches lab or the proper handling of samples is done .? . I have worked in casualty for years sent n number of samples of blood for alcohol but none of the reports come back .. important thing even doctor does all the work ,documentation is very poor in government hospitals .all the responsibilities come back to him .

    Being a Medical Doctor, I would say Hon'ble Judge is on Right Points.. it's an example of Medical negligence,but it is also important for public to know that Forensic laboratories are low in our country and in many assault/ poisoning cases , MLC is not done which is mandatory...

      As I worked in forensic medicine department, he never should comes into conclusion even if he is confident without visceral and histopathology reports. It's not his problem on getting histopathological and visceral reports it's police headache.

    Time has come that in India we should have separate Judges for Economic, Murder, Medical etc and micro specialisation for Police, Judges at least. Law needs to be more stringent and punishment equal to USA laws this will not require any money to do it

    It Seems this Judge is having an mbbs and forensic science degree .. we need these kind of people in our entire system..not the power hungry UPSE Babu type( with no technical) or culture.

      Judges study from a book named Medical Jurisprudence and Toxicology by JP Modi so that they can handle such technicalities and doctors won't be able to fool the court.

      Why ? Not every case revolves around Engineering or medicine. Other individuals are equally good in their respective fields or deserve being judge as per their capacity even if they are from non science background.
