@@TonesDroneVisuals I’m like 500m outside the 5.5km, just out, but I can still fly mine even under the 5.5 just avoiding the runways marked with crosses on some websites/apps. I try and avoid the airports altogether, but god to know what the rules are if I need to be within the 5.5

Must admit, that's a new one on me. So according to that diagram you've got to keep it under 45m in that traditional 5.5km zone if you're using a sub-250g drone. Wonder why they don't mention that in the information for the public.
Have to bear in mind if the drone in question is a DJI there’s the GEO-fencing to overcome. I was faced with the red ‘Authorization Zone’ warning when trying to do a low level flight over the mangrove swamps on the outskirts of Brisbane airport and just figured it’s way too much trouble☹️

Hi Andy Very new drone owner About the 120m high ruling Where I live you have a lake and a nice lookout overlooking the lake The lookout is about 150m to 175m above lake level and 350m away If I take off from the lookout and 10 to 20m high from my take off point then fly towards the lake by the time I get to the lake. They can only prohibit you from taking off or landing in the park. They cannot prohibit you from taking off or landing outside the park on public land because they have no jurisdiction over the air above the park whatsoever.

Will a mini pro 3 used for recreational purposes actually allow you to take off within 5.5km of a controlled airport? The dji app seems to ignore the weight and just marks the area as requiring authorisation. I don’t want to do anything stupid.. just fly in a park behind my parents house which is about 5.4km from the airport (just inside the blue zone on the dji flight app).
For the vast majority of commercial drone purposes I honestly don't see a need for RePL. If you wanted the additional certifications (night flying, the reduced people distance etc) then fair enough, but otherwise there's usually no need. :)
i was trying to record my friend at a beautiful swimming pool during quite time, no people inside pool , i was operating from ground floor, and there are people sitting in balcony on second level telling me i cant do that , drone wasn't over those ppl in balcony ,it was literally over my friend in pool, i was taking rocket shot on dji mini 3 pro,really frustrating.
Yea. Legally you're supposed to be 50m away, but assuming there's no restricted airspace and the council or school don't object, there's no reason why not.
Hi Andy, great content, i live here in huskisson and am thinking of getting a dji mini3 pro, what are the rules regarding national parks permission for flying from within a national park as they apply to the jervis bay area and areas such as morton national park and other marine parks.
Thanks mate. Well Booderee is unfortunately a total no-go for drones. I've even sat down with parks management there and plead my case but it was a big fat no unless it was for scientific purposes. As a local, I don't want to get banned from the park so I respect the rules. The other national parks - honestly - they don't give a shit. They say you're supposed to get permission on their website but drone footage gets shot in the parks and posted here on TH-cam on a daily basis and no action is ever taken. On one occasion a ranger saw me flying my drone and came over to see me - but rather than tell me off, he had a look on the screen and wished me well. I think it's basically an arse-covering exercise for them and I don't give it a second thought these days, flying in the national parks.
If using the DJI Mini 3 Pro with the extended life batteries, this I believe puts the drone over 250g (just). If using those batteries, and still just flying recreationally, my read is one needs to apply for an ARN and register the drone, correct? Second question is if you a using the drone to get some footage for promotional material for a non-for-profit organisation, would that be fall under the "commercial" banner? Thanks in advance.
Yea it's just over. It all comes down to how happy you are with rules. I know some people aren't comfortable unless they tick all the boxes. I sometimes take a slightly more flexible attitude personally speaking. As to the footage for a non-profit - if you aren't being paid then it's not commercial. :)

🤦♂️🤦♂️🤦♂️, very informative although I had done my research (or I thought I had, even asking the D1 store but I guess I didn’t ask the right questions) had a Mavic air and then Air 2 but being disabled it’s very difficult to travel outside the 5.5 km airport zone of Mackay Qld, so with frustration I sold both and after a while started looking at the mini 3 pro, I unfortunately live in the take off and landing paths of the airport but get several Ks away quite easily, so my MP3 arrives and thinking I’m 4 Ks away all I have to do is fly or at least unlock a zone …. All good right…. Um no , what I wasn’t told is every time I do want to fly I have to apply for a unlock which only gives you what looks like a 2 day window and time period (I would have thought asking for a unlock would mean I accept responsibility and area awareness) not being tech savvy this first attempt was frustrating and almost 2 hours later without result I packed the drone and now am thinking of selling it with 0 hours flight, I wish instead of the hype that you can fly inside 5.5ks as all the reviewers and advertising states it is not that simple or a “plug and play” type of situation, even you have not delved into the correct information and a novice like me believed was not informed fully of what was required , 😒😏

What if a homeowner tells you to get away and to NOT take videos/photos near their property as it is invading their privacy but you are still way above 30meters from the said property would you still be able to or not? And then gets aggressive and asked for your license etc. What should I do as a sub 250gms drone recrational operator?
They don't have any rights to tell you what to do, so it's entirely up to you. Personally I'd tell them to piss off, but others aren't comfortable with that. One option is to control the drone from within your car - this makes you pretty much invisible and even if some Karen/Ken got annoyed, they wouldn't have a clue who the drone's owner was.
Great video Andy! One question: When you talk about restrictions to flying in Sydney Harbour, are you only referring to flying over water or over the entire Sydney basin?
Mainly the water. But there are other restrictions that make flying on land tough too. For instance you can't take off or land near the Opera House because it's private property or at the Botanic Gardens because they ban take/off landing. Checking OK2fly.com.au is always the first thing I do :)

They can't know but if you are caught by any authority breaking these rules then you can get heavy fines. Flying out of line of sight, flying over 120m and flying over populated area are up to a $10.5k fine Flying at night or 5.5km from an airspace is up to $5.25k fine Flying 30m near a person $2.1k I personally don't think it's worth the risk but it's totally up to you if you wanna risk thousands of dollars for a slightly far away shot or to go really high. (Also extra note according to 9new police officers can only find you up to 1.11k but you can get fined up to 11k in court for these specific drone crimes)

Hi, flying for fun. I'm trying to find something on weight limits. From what ive seen it appears to be 2 kg . Im uncertain I'm looking at something that has a flying weight of 590 grams.

If you're not earning money from it then it's non-commercial. The problem is that when you get over the 1000 subscriber mark and can monetise your video, any footage you earn money from (even if it was shot years ago) counts as commercial. So as and when you do get monetised, just register yourself and your drone.
Rules rules and more rules. Unfortunately, the rule makers are the gate keepers and only too happy to pander to the whims of the complainer people complaining about noise etc etc. The RULES should ONLY be focused on genuine SAFETY especially aviation safety which should NEVER be comprimised. A smaller set of focused rules would be more effective.
So,, in summary, you cant legally fly a drone in Australia. Youve saved me a lot of money ! I owe you a drink,,,,,,,, under 250 G. close to the Airport and in line of sight at all times. . Anyone offering any kind of explanation/excuse? Corona? mmmmm

Not something I've had to do because my Mavic 2 Pro pre-dates the permissions firmware in the more recent DJI drones.

Mini 3 Pro is fine. Just stick to the CASA rules, respect the restricted airspace in places like Sydney Harbour and you'll be fine.

Legally, no. Houses count as property in the eyes of the law. They basically block anything that could cause damage to people or property.

Yes, definitely. If you're having problems consistently with this, then use Litchi instead of DJI Go.
great video, but do still need an RePL? as the ReOC request the chief pilots details. Which would be me, but I haven't done the $3k course.

Yea, size is irrelevent for that rule. In fact even if you have a full remote pilot's licence it still applies.

Same rules apply mate. If the FPV is under 250g then you get to fly within that 5.5km around airports but everything else is the same. :)
Fpv is restricted pretty sure you need a licence and beyond visual line of sight training. Think some of the fpv clubs have exemptions.

Usually means keep an eye on the NOTAMs in case the military close the airspace but otherwise just fly according to the standard flying conditions :)

Great video Andy! One question: When you talk about restrictions to flying in Sydney Harbour, are you only referring to flying over water or over the entire Sydney basin?
Mainly the water. But there are other restrictions that make flying on land tough too. For instance you can't take off or land near the Opera House because it's private property or at the Botanic Gardens because they ban take/off landing. Checking OK2fly.com.au is always the first thing I do :)

No, no need to register and yes, assuming there's no restricted airspace, you can fly over the reef :)
How do CASA enforce these drone rules in Australia? As in if i was do fly my drone over 120m or fly my drone beyond line of sight, how would CASA know?
They can't know but if you are caught by any authority breaking these rules then you can get heavy fines.
Flying out of line of sight, flying over 120m and flying over populated area are up to a $10.5k fine
Flying at night or 5.5km from an airspace is up to $5.25k fine
Flying 30m near a person $2.1k
I personally don't think it's worth the risk but it's totally up to you if you wanna risk thousands of dollars for a slightly far away shot or to go really high.
(Also extra note according to 9new police officers can only find you up to 1.11k but you can get fined up to 11k in court for these specific drone crimes)

If airspace is controlled by CASA, so as soon as the drone is airborne it comes under their jurisdiction, can you legally hand launch/land a drone in a national park?

Unfortunately not Geoffrey. You can launch from a public road outside the park and then fly over it, but you can't launch from within.

Commercial. Doesn't matter how you do it - if you earn money flying the drone it's commercial in CASA's eyes.

Property no (houses, homes, offices etc) - roads yes as long as you're not flying over a car.
Not for houses as it is classed as property. Roads, as long as it's empty.

Does being a non monetised (yet) youtuber counts as commercial?
If you're not earning money from it then it's non-commercial. The problem is that when you get over the 1000 subscriber mark and can monetise your video, any footage you earn money from (even if it was shot years ago) counts as commercial. So as and when you do get monetised, just register yourself and your drone.

Wonder whether there is implications now as TH-cam uses all videos for ad revenue so in effect TH-cam could be making money from videos you upload.

Yep, it's ridiculous really. No other similar country bans them the way Australia does.
Rules rules and more rules. Unfortunately, the rule makers are the gate keepers and only too happy to pander to the whims of the complainer people complaining about noise etc etc. The RULES should ONLY be focused on genuine SAFETY especially aviation safety which should NEVER be comprimised.
A smaller set of focused rules would be more effective.
So,, in summary, you cant legally fly a drone in Australia. Youve saved me a lot of money ! I owe you a drink,,,,,,,, under 250 G. close to the Airport and in line of sight at all times. . Anyone offering any kind of explanation/excuse? Corona? mmmmm
It's very difficult to stay within the letter of the law which is why most people don't bother. :)
