A person has sold his landed property surrounded by land of other persons to two persons. The first person is having main road of 16 feet size. But the second person is not having any entrance from that 16 feet road. The land is open, no building construction is done by other owners on any side. So far there is no road provision from any side to the land of second person. Can the second person get easement right or right of way to his land? Please reply me.
Mukut Das If there is any other way that the person is having..he will not get easement ryt..but if there is only one way ..he will get easement. Though there may be no road but if a way is still there though not proper of crooked..on which he can travel...no Easement. But if no way at all..then easement is allowed

But the first person has allowed the third person but not allowing his second person to pass through his property And there is also other way which is more difficult and unrealistic and for the second person has pass through third person's property.. And since the other way is also condtioned with permission of third person... Can he claim easement of necessity through first person's property. If not what are options through eyes of law?
Dear sir/madom I own a land which is located at a distance of 100 meters from village road. In between my uncle land is their, both my uncle and my land ineritencted property, the land was an agricultural land when the partition happened hence there is no details mentioned regarding road in partition deed. There is no direct approach road to reach my land, I have to walk only through neibours land, till now he was allowed us to use the land but now he is refusing us to use the land and he is scolding on us, we don't have any other road to reach our property. What is the solution for this.
आदरणीय सर क्या हम छ्त पर जाने का अधिकार पाने के लिए easement का प्रयोग कर सकते है । हम बिल्डर फलेट मे रहते हैं। जहाँ 30 में से 15 फलैट अलग अलग लोगों के द्वारा खरीदे गये हैं। और 15 फ्लैट मकान मालिक के हैं । 30 फ्लैट्स का रुफ राइट का अधिकार किसका है ' मकान मालिक केवल उन्हीं सदस्यों को उसे उपयोग करने देता है। जो उनकी चापलूसी करता हैं। अगर किसी से उनका विवाद होता है तो वह उन लोगों को छ्त पर जाने से मना कर - देता है। ऐसे में सभी लोग उसके खिलाफ कुछ भी कहने करने से डरते हैं । यहाँ तक की जो लोग आवाज उठाते है उसका भी साथ नहीं देते। ऐसे में सभी लोग अपने सुखी जीवन के अधिकार से वंचित हो रहे हैं। यहाँ यह हमारा ही मसला नहीं है ' यहाँ दिल्ली में अधिकतर लोग इसी समस्या का सामना कर रहे है । दिल्ली में बने ऐसे मकानों में व्यक्ति धूप के लिए तरसते है धूप के अभाव मे लोगों को कई रोगों का सामना भी करना पड़ता है । गर्मियों मे बच्चे बाहर निकल कर खेल नही पाते है ऐसे में बच्चों के विकास पर भी असर पड़ रहा है। क्या इस मसले पर easement का सहारा लिया जा सकती है और क्या उसमे इंसाफ मिल सकता है।
