    The case mentioned for the requirements of an easement is Re Ellenborough Park [1956] Ch 131. The case sets out four requirements for an easement to exist:
    1. There must be a dominant (benefited) tenement and servient (burdened) tenement;
    2. It should confer a benefit on the dominant land;
    3. The dominant and servient lands must be in different ownership; and
    4. The easement must create the subject-matter of the grant.

    What about if the person utilizing the easement is living at the location (not a rental), but is not on the title of the home? Are you able to not allow that person to use the easement if there is another way to access the home?

    My neibors an I have a shared driveway I own 80% of it! This is one of two driveways on there property I have no easement an want them to stay off my land! What do I do? Law Sessions

      Here we grow you can claim an easement via necessity. refer to cases such as Manjeng v Drummeh & Union Lighterage v London Graving

    If a person dies and made a will during his life that he wants to be burried in his own house , so legal heirs burried him in one of the room now people used to come daily to see his graveyard and his grave becomes a little sort of tomb thing and crowd used to come on daily basis so what remedies legal heirs have because they're getting disturbed by this suituation

      the requirement in the will is satisfied or fulfilled. now the legal heirs has the right and full authority, just like a legal owner of the land ,they can dig up the grave and put him out ..take his remains and bury him somewhere else ...simple case solved :P
