    Im a businessman managing a hardware. acquiring government permits and renewing them is really frustrating and discouraging people from doing business in the country due to red tape. i hope the Anti-Red Tape Authority (ARTA) would look into the matter regarding the issuances of permits by PENRO (CEBU PROVINCE) to sell aggregates. For the whole month of January and until now, suppliers could not sell to buyers aggregates for construction due to red tape! People here could not find any construction supplier that is willing to provide aggregates because their permits are pending and so building or housing constructions are suspended, delayed or cancelled. so much money, time, and effort is wasted due to government business malpractices. the constitution is not the problem. it is the people in government that is the problem.

    As someone who worked for companies doing business internationally, there are many factors to be checked before setting up shop in a foreign country, such as but not limited to:
    Quality and education of the local work force
    (Work ethics, job skills, experience and proficiency, etc.)
    Labor costs
    Bureaucratic red tape
    Supply chains and security
    Energy costs
    Logistics challenges and infrastructure
    Political stability and public safety
    Tax incentives
    property and legal security, court system
    Level of corruption (in the US some bribes can be written off as business expenses, a clue as to how often companies are confronted with this issue in certain parts of the world)
    Distance to markets, another logistics issue and cost factor
    And many more.

    Certain business permits have to go through the Barangay, Municipal govt, Provincial govt and on the the National govts (several Depts. there) because the culture is "everybody must be happy". That is the problem since God was in kindergarten. 😢

    Wow, with former senior justice Carpio's revelations, what else is there in this country to open up to foreign investments? Ours could just be the most economically liberal country in the world. Yet why have we lagged behind the rest, let alone Indonesia, Vietnam, Malaysia and Thailand which all have more severe limits to foreign investment entry than us?
    It is not because of our Constitution. Higj cost of power, bireaucratic red tape, support infrastrictires that leave much to be desired, said Carpio, are what really put off foreign capitalists to come in. And we must add to these: political instability and wanton disregard for the rule of lae. What foreign capital, indeed, would come in with du30's call for Mindanao secession or his call for civil dosobediemce or his fanning a kudeta bythearmed forces. By the same token, what foreign capital or foreign economic accommodations would materialize when the sitting president refuses to cooperate with the ICC with respect to its investigation into crimes vs humanity committed by du30 and his minions, particularly under his brutal Oplan Tokhang which claimed thousands upon thousands of human lives?
    To be blunt about it, the House leaders want the CHACHA not at all in the interest of national dev't but for something else we already know: change the govt form to unicameral parliamentary to make it easier for the ambitious to win the top post and may be to extend term limits without the need for popular election. Selfish! Revolting!

    Marcos Jr’s Cha-cha will only equate to the wanton plunder of our remaining land and natural resources. Instead of devoting our land and resources to the genuine development of domestic agriculture, economy, and industries, ChaCha will allow more foreign-owned extractive industries, logging, ecotourism, real estate projects, expansion of agro-corporation plantations, and other business operations intended for profit-making.
    Furthermore, 100 percent foreign ownership of land may also further drive the displacement and ejection of farmers and indigenous people.
    Land agents will rush into land grabbing, coercive land purchases, land banking, and land selling. This implies a broader displacement of farmers and indigenous people, imposition of higher land rents, further losses for farmers, cessation of farming activities, land conversion, and the dissolution of agricultural livelihoods.
    Ramos added that the proposed Charter Change will end jeopardizing food security and livelihood for Filipinos, leading to widespread hunger, loss of livelihoods, and increased poverty...so NO to charter change.

      Foreign land ownership ban is difficult to be strictly enforced because foreign expats just marry submissive Filipino spouses and have the certificate of land title named after the latter on former's behalf and that arrangement makes financing through mortgaging a bit difficult because commercial banks always demand proof of financial capacity of Filipino spouses to redeem mortgaged lands, otherwise they would be foreclosed. This is the key advantage of freehold vs leasehold land ownership.
      Leasehold lands cannot be sold by a foreign renter, nor can be inherited by their closest blood relative.

    Power is just one aspect of our economy. Mr. Carpio forgot the most important thing, "OIL". In order for us to move forward, we need a stable supply of oil. I don't think that a simple act will suffice in order for us to address our current problems with regards to oil exploration. Ownership, profit sharing, security requirements, environmental compliance and liabilities. Those are just few kinks in our constitution. I'm sure there's more. Our laws should be clearly defined and specific. Too many laws to amend and it's not just the Economic provisions but also laws that affects our military and our society in general.

      @@eadex360 Meron nga. 70's pa lang na-survey na mga lupa at karagatan natin. Ang problema pag extract ng langis. Nasa protected area pa yung ibang location. Problema pa diyan yung mga concessioners na gusto pumasok. Sa ibang bansa tulad ng Thailand halimbawa, pwede ang 100% foreign owned company ang mag extract ng oil. Mas maganda rin ang hatian nila ng kita. Bukod sa langis, may royalties din silang ibabayad sa Thailand. Correct me if i'm wrong. Sa atin yata royalties lang. Walang commitment na sa atin ibibigay yung ibang langis. Ang daming butas ng batas natin. Kaya nakakalusot minsan yung mga investor sa mga liabilities nila sa tuwing magkakaroon ng sakuna. Masyadong vague at general. Halimbawa na lang sa Mining. Laging nabibigyan ng TRO mga mining companies na iresponsable. Ang liit pa ng parusa. Naaalala ko tuloy yung Marcopper. Kahit hindi ako abogado kapag nabasa mo yung ilang provisions sa Constitution natin, mapapatanong ka na lang sa sarili mo kung "Bakit ganyan?".

    Carpio is wrong. Just because we have one of the most liberal foreign investment laws in Asia currently doesn't even mean the Constitution shouldn't be changed. We have to out-compete the rest of ASEAN, who mind you do not even suffer similar antiquated constitutional impediments (save Indoensia's commodity protectionism)!
    And because the letter of the constitution still provides that "No franchise, certificate, or any other form of authorization for the operation of a public utility shall be granted except to citizens of the Philippines or to corporations or associations organized under the laws of the Philippines at least sixty per centum of whose capital is owned by such citizens". (sec. 11)
    Obviously, the letter of the Basic Law is superficially inconsistent with the reforms, as been pointed out in another comment here. Since the Constitution is the superior law compared to the Public Service Act, RTLA, Foreign Investment Act, CREATE Act etc., then later down the line, these liberal reforms allowing foreign ownership can be easily relinquished and ended on the basis of the letter of the Constitution. That's why the Constitution ought to be revised now to guarantee the reforms are permanent.

      A risk foreign investors will not take. Losing their company is a possibility if the law is challenged in the Supreme Court. We need to put a period in all of this and settle the issue unequivocally.
      Besides, as stated above, we must outcompete the rest of ASEAN and the lack of creativity and innovation in our investment laws is not the way to go. We should become smarter, stronger and more determined.

    These laws are technically unconstitutional because of the 60/40 rule in the Constitution restricts 100% foreign ownership. This is why FDI doesn’t come to the Philippines because of the chance that they will lose their business if the law is challenged. Aside from that, he’s absolutely correct about the Power Costs, and the red tape being contributing factors, as well as systemic corruption. Nobody wants to deal with Philippines Customs.

      because the SC refuses to hear the cases brought about challenging the laws. The Constitution specifically states you can't have 100% foreign ownership of businesses. If the Supreme Court decides to hear any cases, they would have to find in favor of the Constitution. To change it, they need a constitutional amendment. Most Countries don't have any economic restrictions written into their constitutions, but they do have restrictions on land ownership. The reason it's in the Philippines Constitution was to protect the Oligarchs who were funding the Coup attempts against Cory. The clause was put in to protect the Oligarchs, most of whom are ethnic Chinese. And these Filipino Chinese won't even allow their kids to marry Filipinos who don't have Chinese ethnicity in their bloodline. Unless it's for financial or political expediency. The clause should be removed so the laws can stand on their own. The Gov't needs to be able to legislate laws that help the Philippines economy to help Filipinos to get employment here, not just overseas as OFWs. By allowing the Oligarchs to control the economy, the Filipino suffers. Interesting that the Filipino news media, floods the market with stories against changing the constitution. And who owns the media companies? The Oligarchs.

    Carpio is wrong. To address backlogs in infrastructure we need to open up our economy more. Power generation and distribution,water management, seaports and airports, logistics, roads and railways all these will be funded by opening up our economy more. It's only partly open just about last year. Capital and technology have not kicked in yet but still we need to sweeten the pot by liberalizing our economy more. Both the UTILITIES and SERVICES should be open to 100% foreign ownership, that's why we need charter change now. We need them to be more committed. We need to industrialize,we need manufacturing. We need to achieve industrial-agricultural scale. These areas require capital, science and technology which the foreigners can provide and will provide if they get to own their corporation 100%. Red tape can be solved by digitalization which the foreign capital and technology can also provide.
    Charter Change is a big part of the solution. Not to see this is foolishness.

    This is misleading. Many are not allowed 100% foreign ownership. China has a multibillion dollar Apple co. A multibillion Tessla company and many others. India has many Multibillion dollar 100% foreign owned business's such as SC Johnson. Frito/Lay and others. No one is willing to invest billions of dollars in a company they do not have 100% control of the land it is on or the person running it. The improvement of the life of Filipino's would benefit greatly due to wages and working conditions. Anyone who is unable to see this does so by choice. By not opening eyes or just plain ignoring what is looking them in the face. The closed market place does not benefit the people. It only benefits the already wealthy in PH who control the work conditions and wages. Competition from outside business would not be beneficial to them alone.

FYI hindi madali mag negosyo ang mga foreigner sa China kailangan joint venture with local compnay. May tinatawag pa na Forced Technology Transfer Policy and China sa mga foreign company. Kaya gusto ng western companies magtayo ng mga kompanya sa China at India daihil cheap labor at sobrang laki ng population nila na potential consumer ng mga products nila

They can force joint ventures because of their strong and broad supply chain. Less fortunate countries need to offer more incentives. The Philippines should operate in a more generous manner to get investment.

Bago ma solve yung mga issues na yan babalik ulit yan sa red tape. Kahit local businessmen nagrereklamo na ang hirap kumuha mga requirements kung saan saan pa sila pumupunta tapos may under the table pa. Manufacturing lang naman ang services ang malaking market ng Philippines. Kahit mag allow ng 100% foreign ownership kung may red tape, undeveloped infra for logistics and unstable internet and power supply wala din mangyayari. Ito lang naman need ng mga negosyante sa Pinas:
      Ease of doing businsss(incentives, easy processing of requirements)
      Cheap labor
      Cheap rate for energy consumption
      Faster internet
      Developed infrastructure
      Pinaka importante no red tape

It’s madness and designed to keep out foreign companies that would provide the Filipino people with cheaper and better products.     It's not liberalized enough that's why we need to open it more. Besides,there's still the damocles' sword hanging over the heads of potential foreign investors regarding 100%foreign ownership legal standing which is still to be decided by the supreme court.
    Plus,we need to sweeten the pot. Let's be more aggressive,smarter and more willing to take risks with bigger rewards. We've got fierce competion in our neighborhood.There's almost no time.Lets dive in and swim.
    Power cost can be lowered down by introducing foreign capital and technology. Lets not call them euphemistically as critical areas connected to national security as this will only deprive the industry with capital and technology. To be honest,Bbm is only mildly successful in his foreign trips.We need him to be wildly successful ,and he can only do that if he's got the ' goods ' to sell.
    We are in a crossroad of our history here.What we decide now will shape the course of the nation in the decades to come ,and the future is about unbridled competition and fierce economic rivalry .
    If the economic provisions are not really that important then why shouldn't carpio allow our legislators to tinker with it?

Again, based on existing laws and regulations, kung ang issue ay percentage ng foreign ownership kaya naman gawan ng paraan through laws and regulations. Ang problema natin sa Pilipinas, red tape, high cost of power, high labor cost, lack of infrastructure. Hindi talaga pupunta ang foreign investors kahit 100% owned nila ang business nila dito kung mas mahal ang power at labor cost natin compared sa Vietnam and Indonesia. Kahit sa China mas mababa ng kalahati power cost nila eh power ang pinaka malaking cost madalas sa operations lalo ng malalaking Factories lalo yung mga heavily automated manufacturing at yung maraming electrical and electronic equipment. Ang Ports natin na nagagamit halos yung sa Manila port lang, konti lang sa Cebu. Traffic pa papunta sa ports. Malala. Kung yung mga nasa gobyerno sana nakafocus sa lalo pang pagpapaganda ng infra natin at sana binibilisan nila ang kilos nila kasya nagpapapirma ng pekeng People's Initiative na hindi naman mga tao ang nagsimula edi sana mas maganda siguro ang kakalabasan. Pati pag open ng business in terms of paperworks ang tagal at mahirap din, Punta ng barangay tapos minisipyo tapos babalik pa ng barangay minsan tapos sa mga ibat ibang government departments tapos more than a week or two bago matapos. Konti na nga ang kikitain mo kumpara kung sa Vietnam or Indonesia ka mag tayo ng business, pahirapan pa. Sana kung gusto ng mga kongresista na payagan ang 100% foreign ownership na sa tingin nila dahilan bakit hindi napunta ang foreign investment dito edi sana gumawa pa sila ng mga batas na papayagan yon pati pag ammend sa foreign investment negative list. Mas busy pa sila mag papirma last time sa mga tao ng People's Initiative kuno.

      Philippine Constitution (1987) restricting foreign ownership to 40 percent (Article XII). Remove this article and then the laws congress have passed are under no threat of being overturned due to any SC decisions rendering them unconstitutional. Further, use the Free Zones of Clark and Subic as test zones, lower the cost of power in those areas, change the way the bureaucracy works there, and create a special Customs Group there who are NOT corrupt, and see what happens. Dubai did this and turned their entire economy around. You can set up a company in Singapore or HK for only $10k, in DXB it's $5K, but in the Philippines Special Economic Zones it's $250k. They need to change the structure and grow those zones as models of efficiency, then have those ideas spread to the wider economy. Why restrict power generation when Ramos already developed very good Build Own Operate Transfer BOOT laws to attract foreign investment into power generation. As long as the economic provisions exist in the Constitution, the laws congress passes are under threat. Further, they need to change the legal system in this country. Cases take decades to be decided, they need to have business courts that just deal with business law. The courts are overburdened with other trivial matters. I liken the Philippines to a land of Trolls and Bridges. When trying to get from one point to another in business, you have to cross many bridges, and at every bridge, there's a troll that must be paid to give you a piece of paper before you can get to the next bridge to deal with the next troll. The Barangay, the Municipality etc etc, before you can do anything. Even the poor OFW, rather than just getting a passport and a job offer overseas, they must cross many bridges here before they can even get to the airport to see the final troll, the Immigration Officer, who can then end the entire effort by denying them their trip, based on the subjective opinion of the Officer. All those trolls that had to be paid to finally get to the airport, and it was worthless because the final troll decided not to let you on the plane. The whole thing is ludicrous.
