I doubt he's sober, but he's at least more sober than he used to be. With more sober brain time on the agenda, I think in time Nick will navigate toward something approximating a plea deal. He's going through something like the 7 stages of grief. Alford pleas are uncommon and he's already said things that would make the court reluctant to accept one. But at the end of the day, the state is still going to want to avoid trial if possible and I bet Nick will come around to a plea where he accepts SOME level of responsibility. For instance, maybe plead guilty to the drugs if the child abuse is dropped and he agrees to complete a treatment program and a couple years of probation. He's pissed a lot of important people off, but they still won't want to go to war with him unless they have to. Of course, my guesstimate is subject to change if more information is revealed. If it's revealed the child was intentionally given cocaine, all bets are off. But if Nick can't make the decision to get sober for a while (which is entirely possible), it's going to be rough sledding for him, because pretty much everything they're going to ask him for in lieu of prison is going to involve regular testing. I bet Nick will find some way to get prescribed enough legal fun drugs (adderall, etc) to satiate his desires. With pending drug charges, he'll have to find a shady doctor, but that's never been easier and he's been prescribed those drugs in the past, which will make them easier to get a script for again.
