Yes, it's perfectly legal. In fact a lot of sea urchin removal efforts involve diving and smashing the urchins without any harvesting at all. You just have to be sure you're not doing it in a protected area.
Red Urchins are vital to the eco system because Purple Urchins are invasive. Please encourage harvesting of purples by sharing locations
