Hello Atty Chato, thank you for your useful video. I have one question if you could please clarify. I live in Cebu and loaned to someone who lives in Davao. We signed a promissory note and I notice it says all legal action must be made in Davao. Does that mean I am legally required to lodge a small claim where the defendant lives? Or do the rules still allow me to lodge where I live? Thank you.

Hi. It depends on whether the PN states that all legal actions must be filed exclusively, solely or only in Davao (or similar words of exclusivity). If it doesn't use words of exclusivity, you may file where you live.

@@easylawonline Thanks for your information. Yes, it does says exclusively in Davao. However, I read this from FAQs of the revised rules which state "If the contract of loan between the plaintiff
and the defendant has an express provision
that venue is stipulated in a specific area,
which is controlling - the stipulated venue or
2nd paragraph of Section 7?
Section 7 shall apply. Since the Revised Rules is
a special rule of procedure, the same is
controlling over stipulations in a contract. Section
7 states that the regular rules on venue shall
apply, but “if the plaintiff is engaged in the
business of lending, banking and similar
activities, and has a branch within the
municipality or city where the defendant resides,
the Statement of Claim/s shall be filed where that
branch is located.”
Doesn't that mean that the revised rules overrides the statement of location exclusivity in the PN??

May decision po ng judge sa Small claims na ikinaso ko kay defendant kasi po hindi cya nagpasa ng sagot at hindi rin po pumunta sa hearing,then nag file po cya ng petition for certiorari at na dismissed then nag file ulit po sya ng motion for reconsideration.posible po ba yun? Hi. If the certiorari petition was dismissed, there's a small chance na ma reconsider depende kung gaano kalakas ang legal position nya.
