    I used your tips in court today! I won! Thank you so much! I couldn't believe how crazy my landlord sounded! The Judge spent ten minutes explaining to her that she cannot void our purchase agreement just because she wants to. She must abide by the contract she signed.

    Small Claims really does work. I just won a case against Sprint today. The key is to document the hell out of everything-record conversations, journals of conversations, send certified letters, etc. Get a file cabinet or have the digital equivalent, and document everything you do with people/corporations that you do business with.
    If you go into court with a pile of stuff and the defendant/lawyer just says "umm...nuh uh, dunno..." you're going to win.

      Depends on the state, texas requires at least one party to give consent, as lobg as you are speaking on the recording too, you can be the consenting party

      @@karingendreau1847 always have a "contract written before loan" or some "confirmation of contract after after loan"
      eg txt messages admitting he hadn't paid you back and why
      Here in UK we have litigation (claim in court) and prelitigation (before claim in court).
      Prelitigation requires an exchange of information "disclosure to understand each other's position"
      Litigation requires an exchange of information "disclose to support the claim or counterclaim details".
      Prelitigation is set out for main purpose
      - force each litigant to talk, and
      - to identify dispute points,
      - to then resolve all undisputed points leaving just disputed points.
      Then settle disputed points either
      - settle out of court (a trade off or deal) or
      - settle in court (they claim, I defend, judge decides)

      @@sl4983 well I'm in the same boat. when I went and it was continued to 9/2, just be totally confident in your truth, exhibits, proof. watch live trials. but the advice all courts give is don't wear emotions on it sleeve. stand tall and remember there are cameras and people, refer to notes. state solid facts, quote civil codes i. e. harassment, or malicious, retaliatory. and how it sent u to the Dr. changed meds if so, and how your health is poor now, and how u used to be before. Research, ur county has court self help resources.

    I am primarily concerned about how to file the papers after properly filling them out so that the court doesn't refuse to accept the case or throws it out for incorrectly filled out papers. they don't make it exactly simple

      They usually tell you but there are pro Se laws that protect you from this include the laws on your filings and make sure if they have an issue bring it to their attention, it's on your filings.

    No, you can't sue for the sentimental value of an item as that's completely subjective. You can only get the suggested price (auction price, determined value), MSRP, depreciated value, or whatever the judge says.

    What happens when you go
    to small claims and find out during the proceeding that the court *tampered*
    with your evidence (spoliation of evidence)? For example, the judge scolds you
    for the pictures you submitted to the court. However, the pictures he scolds and
    discredits you about you were made known by the judge himself, they had been
    ALTERED by the court and according to the judge, were unviewable. If the pictures you submitted were in COLOR, how could that not be tampering?

    UK litigation must be same as US Litigation.
    I'm going to "get as much detail from as possible" from otherside
    I'm going to state my case to them in a teacher's style "your client has failed to apply x to y as such the impact is z to me"

    I sent defendant, contractor, a notice to pay for damages he caused due to his breach of contract. His response in writing was "He is broke and don't bother to sue me." What happens to my case if he says "He can't pay"? Who investigates if he is telling the truth of not being able to payback? If plaintiff does, are his/her findings admissible?

      sue anyway. it may cause him humiliating and give him a negative rating with the Better Business Bureau.

      There are services or investigators that can run a credit check/background to check the financials, however, you should still carefully consider before sueing because even if, let's say you win, enforcing and collecting judgement is a while other matter. You may not be able to collect anything if a person if bankrupt. Think about that while weighing in your own time and money.

    Is it possible to win some but not all of the financial damages you are seeking in small claims court? For example: I'm seeking $3600. $1000 of that will be easy to prove liability & damages. The rest of the $3600, won't be so easy. Might a judge award me the $1000, but not the full $3600? Does going after the full $3600 hurt my chances of an overall successful outcome?

    Question I let my brother in law borrowed money as family need roof and agreement to pay in 1 year.
    My husband and I gave him cash to his mom's to help pay for half of the roof and my mother in law half with no paperwork and when it's time he didn't give back. Saying business bad no money come in. I have evidence only something on website and record vdo when I asked back money. Some messages on messenger.     I need your help. My landlord has not given our security deposit back even after leaving the house and giving him keys and address.     I was incarcerated for 5 days. I released my property, including house keys to my gf. When I got home,my house was burglarized. I have proof of her signing for my property at the jail. I have text messages from her starting,"I'm not releasing anything until u sign over your parental rights to our 6 month old daughter ". Is that good enough to file?

    I tried to take my landlord to court over ultilties. I truly got my days mixed up and went in the day after my hearing. The court dismissed my case for failure to appear. Now my landlord has filed a counter claim. Is there anything I can file or do to get my case heard?

    All the 'instruction' videos I have watched here on youtube NEVER take one 'step by step' through the process of the court proceeding... I mean, wouldn't that be 'preparing' someone if you really wanted us prepared... the dress conservatively and speak clearly bs is not 'preparation' for anyone other than an idot... this is not judge judy...this is decalare your complaint listen to their response..make notes present your argument and evidence listen to their answer to your complain make notes to rebutt examine the accuracy of their evidence ...object to falsified evidence or questionable...the list could really be on and on about what you perport to claim is helping that you are giving.... fact is its the PROCESS that is crucial to understand that occurs during the hearing .... not whether you wiped your .... ah nose.
