      B. As a law student , he really should know not use misleading , and maybe law breaking , claim on the package , as he have no proof to the claim.(If he do have a scientific proof (on this product , not the individual ingredient) ,than it's legal to have those claims.)

    There is so much science investigating the effects of all the individual supplements and ingredients, so as long as they cite that research as the basis to their claim, they are fine.

    I tried a similar chocolate once, it was pretty disgusting, so I'm glad somebody has improved the recipe! But what on earth was Janine thinking when she told them the French live a lot longer because of their chocolate, & in the next breath tells them not to make false health claims.

If they maybe say "creatine" and such and such have been proven to help muscle gain, that might be a way around the restictions. If you say "Sports bar, *with ingredients* that make your muscles grow" You're not claiming the product itself is going to make your muscles grow, just those specific ingredients. But again, it's a grey area.

      There's no scientific proof for the product, only for the ingredients. They said they didn't test the finished product. I don't know how all the stuff that goes in it interact with each other. It might work but it might not and by law they can't put something that hasn't been specifically proven in the package. If they said "made from substances proven to do this" they would be alright. I didn't look for it but someone said somewhere in this comment section that they took that off the package. I won't claim they did though because I have no proof of it.

      @@izumirukiIts country depedent. in U.S, there is no regulation on supplements and there is no need to conduct testing or proof on the final product to make these claims. If the components have scientific data backing it up, you just have to adjust the wording to make sure it represents the components. However, for pharmaceuticals, it is heavily regulated and each and every change gets a new trial and new patent. Not sure in australia, but this product would not be considered false advertising in the U.S. as creatine and BCAAs are all supplments and unregulated.

      Saying a product does something is different than saying a product is made of ingedients that do something. When combined the ingredients can interact with each other changing their properties. Beacause of that, the regulations will make a company be specific about that kind of stuff. An egg can be used to make an omelet but you can't sell a cake claiming it's good to make omelets because there's egg in it. Maybe their claim is true maybe it's not. We can't really know because there's no clinical trial that tested how the finished product works.

      @@julianalopes3161 That's actually not true. Take for example NSAIDs. They are proven to work in combating inflammation and pain. Changing the binder material for the pill to another common one would not require proving that the new pill works as it contains the same NSAID. If you claimed your new binder was actually better you might have to prove that. Everything she said was basically bull. There's absolutely no reason that creatin, BCAAs and caffeine wouldn't work when infused in chocolate. If anything they would be taken up faster as caffeine usually speeds up the uptake of other chemicals. Also the laws on supplements aren't really that strict. Companies claim a lot of shit without getting into legal trouble and what they printed on their packaging was 100% true.

In the US at least, this kind of language would never be approved by the FDA unless they had clinical trials that showed increased muscle mass from this particular chocolate.     firstly, these shows are always dramatized just for entertainment. I know of someone who was rejected on screen but actually still got a deal, so it’s not actually this bad. secondly, they’re worried about lawsuits and what happens when they’re finally legally obligated to show studies that actually demonstrate the intended effects. medicine is fickle, and while the ingredients work to do what they’re saying it does, it may not work together or may cause unwanted side effects. it’s all about the liability in this case.

    The big problem with these is compliance not product quality. Slap the words "This product is not intended to prevent or treat any disease" or the Australian equivalent on it and you're golden. All they need to do is make their labeling consistent with supplement ingredient listing and nutrition labeling like every other non-drug workout product. I would totally buy a chocolate bar that was both tasty and contained caffeine and BCAAs.

      The problem arises when you combine all of them together. This creates a completely new product whose safety and health benefits have not been tested. Organic compounds do not necessarily 'stack' health benefits, if compound A is good for you, and B is good for you, that doesn't mean that when combining the two, some weird chemical reaction doesn't turn compound C which consists of A+B into something hazardous for your health.

And no I wouldn't say I know much in comparison to a chemist - I did do a few biochemistry modules in my degree but it wasn't my favourite subject.

      It probably works but they 100% needed to have a real lawyer look at the package and make a recommendation about whether they were in compliance or whether they needed to run their own scientific studies. It’s a major red flag as an investor that they didn’t at least consult a lawyer before selling because that opens them up to lawsuits and regulatory action.

      Creatine does fckall dude. It’s effects are temporary at best and just due to extra cellular water and increased ATP production but it doesn’t build muscle.
      Also creatine is only stable in a raw unprocessed form. This has been mixed with liquid chocolate and so on and long LONG would have become creatinine, which actually does absolutely nothing. It’s why you can’t have creatine in pre mixed liquid form supplements because it’s inactive so the tiny amount of creatine you’re gonna get in this for a few squares of chocolate (if it had much in it it would adversely affect the taste too much) wouldn’t do much as best anyway, but it’s also completely inactive

    Am I missing something about janine's concern with the health claims? If i put protein powder in my smoothie I can absolutely claim it will help with muscle growth. What's the difference with what these guys have done?

If you use ingredients that are scientifically proven to help muscle growth then you can say about your product that it does the same. she has no clue about the law. at all. she just wanted the others out to make a better deal and then still didn't do it. what a biatch.

      Marshmallowman, no.. that’s not how it works. The question, like others pointed out, is if the PRODUCT does what they say, not one ingredient by itself.
      So, we can just mix protein powder with rat poison and say it improves muscle growth? IT doesn’t improve muscle growth, the protein does. What does the PRODUCT do? The product kills you.
      Cake has eggs, body builders eat eggs, yet, they don’t eat cake…. I wonder why… what could possibly be the reason? With your logic the cake is just as healthy as eggs by themselves because it contains eggs.. There is a reason you don’t see marketing for bakeries touting the health benefits of their cakes and pastries as good for athletes and body builders because their product contains protein.
      My very real question to you is: how much Windex do you drink to hydrate? Water is the first ingredient, so, it should do what water does, right? We all know the health benefits of water and that it is good for you, hydrates you, windex has water… so, therefore, windex has the same health benefits as water, right?
      I’d hope your concern with that would be to question the product not me just noting one ingredient. This is what people are noting. Fine, the chocolate has protein, but what does the whole product do when consumed? Just the same as I’d hope you’d say fine windex has water, but what would happen if you drank windex?
      Its shocking and surprising that there are so many comments just willing to equate the product to one ingredient. Why aren’t you guys drinking more windex then since we know the health benefits of water?

      When it comes to common sense yes.
      From a legal standpoint it's not enough when you have proof that your ingredients provide those benefits. You need extra proof that your combination of ingredients does that aswell.
      Sounds overcomplicated but I guess it makes sense here and there.

      @@wootwootsoup Think about it like that: you can use eggs to make omelets. Egg is also an ingredient in cakes. I can't sell a cake claiming it's great for making omelets. For that reason the law will require me to have scientific proof that cake can be used to make omelet if I wanna write that in the package.
      Their claim night not be false but they have to test and prove that the finished product still have the same effects the ingredients do. Mixing them might change their properties in a variety of ways.

    For everyone claiming they were right: just because individual products do something, doesn't mean they will have the same effect when mixed together. To make a claim, you need to conduct a study using the same portions of ingredients so you can say definitively what effects the products may have.

      Not really accurate. All of the items in the bars are already proven to have the benefits they spoke about. They don’t counter-act each other in any way. It’s basically a pre/post workout snack. The claim is valid.

This is what he should have answered:) Also, while ingredients like Creatine for instance, while proven to help muscle repair, needs to be at a certain amount and frequency in order to do what it supposed to do. Adding a gram of Creatine to chocolate will not do what Creatine will do when taken everyday at five grams doses

The average dose for a loading phase is 10 grams meaning "most people" would be taking about 10 grams during loading phase and 5 grams 5-7 days later. No one would ever touch 45 grams. That's an insane amount and even 25 grams is obscene. I've been around pro body builders, strength trainers and professional athletes. None of them have ever gone over 15 grams during loading phase. Whether you actually have all the qualifications you'd like me to believe is irrelevant, it's quite obvious you're knowledge on supplements, strength training and body building is severely lacking.

When it comes to creatine I felt it was pretty obvious we were talking about creatine monohydrate. It's the most popular and affordable variant of creatine on the market not many people use anything else. As for the dosage, again 20-25 grams is on the EXTREME side. Most people take about 10 grams as the standard benchmark for a loading phase and then 5 grams daily thereafter. It wouldnt shock me if I heard someone was taking 20-25 grams during their loading phase but that would have to be someone who's an established athlete with dense muscle mass already. Nobody in their right mind would touch 40-45 grams. Let's get back to the product, 1 serving contains 2 grams of creatine. I could easily see someone using this supplement to build muscle mass. 1 serving in the morning and 1 serving prior to a workout could easily maintain creatine levels. Janines accusations were unfounded as the ingredients themselves have many years of clinical research to back up their claims. Those 2 guys should have told her where to shove it.
